When a disaster strikes, communities must often act quickly to protect life, public health or safety, and property. In such instances, going through a competitive procurement may be impractical and even worsen the potential threat. When faced with emergency or exigent circumstances, the rules allow non-state entities to sole-source or award a contract without engaging in full and open competition.

In the case of an emergency, there is a threat to life, public health or safety, improved property, or some other form of dangerous situation that requires immediate action to alleviate the threat. Emergency conditions are generally more short-lived than exigency circumstances.

Use of the public exigency or emergency exception is only permissible during the actual exigent or emergency circumstances. Exigency or emergency circumstances will vary for each incident, making it difficult to determine in advance or assign a particular time frame when noncompetitive procurements may be warranted. Exigent or emergency circumstances may exist for two days, two weeks, two months, or even longer in some cases. Non-state entities must ensure that work performed under the noncompetitively procured contracts is specifically related to the exigent or emergency circumstance in effect at the time of procurement. Importantly, because the exception to competitive procurement is available only while the exigent or emergency circumstances exist, non-state entities should, upon awarding a noncompetitive contract, immediately begin the process of competitively procuring similar goods and services in order to transition to the competitively procured contracts as soon as the exigent or emergency circumstances cease to exist.

If no efforts were made, explain why. If a conflict of interest is unavoidable, such as due to exigent/emergency circumstances, explain how it was unavoidable and any steps taken to address the impact of that conflict of interest.

Each appeal will be reviewed on a case-by-case basis and final decisions will be based on the details of each unique situation. Be sure to include ample supporting documentation for the Appeals Committee to review. Approval is not guaranteed, and in some cases approval may not result in an increase in aid. The Appeals Committee reserves the right to postpone review until an appropriate amount of time has passed for certain circumstances. When a Judge decides custody between a parent and someone who is not a parent, he or she will consider if there are "extraordinary circumstances". If there are extraordinary circumstances, then the Judge will consider what is in the best interest of the child.

A financial aid appeal is a way for a student and their family to communicate with the Financial Aid Office about financial or household changes that could not be reflected or explained on the FAFSA. Appeals are a request for re-evaluation of an original offer of aid due to extenuating circumstances beyond the student's/family's control.
