DeepHealth Terms of Service
Effective Date: June 22, 2026
Welcome to the DeepHealth application (the "App"). These Terms of Service (the "Agreement") are entered into between Hong Kong Jiuying Network Technology Co., Ltd ("we", "us", or "our") and you (the "User" or "you") and govern your use of the DeepHealth App and its related services. By accessing or using the DeepHealth App, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions of this Agreement. If you do not agree with any part of this Agreement, please do not use the DeepHealth App.
This Agreement constitutes the final, complete, and exclusive agreement between you and us regarding the use of the DeepHealth App and supersedes all prior discussions and agreements between the parties (including any prior End User License Agreements, Terms of Service, or Privacy Policies).
1. Acceptance of Terms
1.1 Acceptance of Agreement: By using the DeepHealth App, you confirm that you are of legal age to form a binding contract and agree to comply with the terms of this Agreement. If you are under the legal age, you must use the App with the consent and supervision of a parent or legal guardian.
1.2 Changes to the Agreement: We reserve the right to modify this Agreement at any time. Any modifications will become effective upon our posting of the revised Agreement. We may notify you of material changes through in-App notifications, email, or other reasonable means. Your continued use of the DeepHealth App after the effective date of any such changes constitutes your acceptance of the revised Agreement. We recommend that you review this Agreement periodically to stay informed of any updates.
2. Medical Disclaimer
The DeepHealth App is not a medical device and is not intended for medical purposes. All information, content, suggestions, and AI analysis results provided by the App are for general informational reference and health management assistance only, and should not be considered medical diagnoses, treatment plans, or professional medical advice.
You should always consult a qualified healthcare professional before using the DeepHealth App or before making any health decisions based on any information provided by the App. If you believe you may be experiencing a medical emergency, call emergency services immediately or seek professional medical help. Never disregard professional medical advice or delay in seeking it because of something you have read in the App.
We are not responsible for any health problems or damages resulting from your reliance on any information provided by the DeepHealth App.
3. AI Analysis Feature Disclaimer
The DeepHealth App includes Artificial Intelligence (AI) analysis features designed to provide you with personalized health insights and trend analysis. Please note:
3.1 Reference Nature: AI analysis results are generated based on the data you provide and algorithmic models, and are for reference only. AI technology may have limitations, and its results may not be entirely accurate or applicable to all individual circumstances.
3.2 Non-Diagnostic Tool: The AI analysis feature is not capable of diagnosing diseases, evaluating medical conditions, or providing treatment recommendations. Any AI-generated reports or suggestions cannot replace professional medical evaluation.
3.3 Data Processing: To perform AI analysis, some of your health data may be processed. We commit to implementing strict data protection measures, including data anonymization and encryption, to protect your privacy. We will not sell your personal data to third parties, nor will we allow third-party AI service providers to use your data to train their general models or for any other commercial purposes.
3.4 User Control: You can manage whether to enable AI analysis features in the App settings and understand the relevant data processing methods.
4. End User License Agreement (EULA)
4.1 Grant of License: Subject to your compliance with the terms of this Agreement, we grant you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the DeepHealth App on a mobile device that you own or control, for your personal, non-commercial use.
4.2 Restrictions: You shall not:
•License, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the DeepHealth App;
•Modify, translate, adapt, merge, create derivative works of, disassemble, decompile, reverse compile, or reverse engineer any part of the DeepHealth App, except to the extent the foregoing restrictions are expressly prohibited by applicable law;
•Access the DeepHealth App to build a similar or competitive service or application;
•Copy, reproduce, distribute, republish, download, display, post, or transmit any part of the DeepHealth App in any form or by any means, unless expressly provided in this Agreement;
•Remove or destroy any copyright notices or other proprietary markings contained on or in the DeepHealth App.
4.3 Ownership: The DeepHealth App is licensed, not sold, to you. We (and our licensors, where applicable) own all right, title, and interest, including all related intellectual property rights, in and to the DeepHealth App. This Agreement does not convey to you any rights of ownership in or related to the DeepHealth App.
5. User Content
5.1 User Content: Refers to any content that you upload, distribute, or otherwise provide via the DeepHealth App (including, but not limited to, your health data, images, text, etc.). You are solely responsible for your User Content. You assume all risks associated with the use of your User Content, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of your User Content that makes you or any third party personally identifiable.
5.2 License: You grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, publish, process, and display your User Content solely for the purpose of providing, operating, improving, and promoting the DeepHealth App and its services. We will not use your User Content for other commercial purposes without your written consent.
5.3 Feedback: If you provide us with any feedback or suggestions ("Feedback"), you hereby assign to us all rights in the Feedback and agree that we shall have the right to use such Feedback and related information in any manner we deem appropriate. We will treat any Feedback you provide to us as non-confidential and non-proprietary. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary.
5.4 Acceptable Use Policy: You agree not to use the DeepHealth App to upload, distribute, or otherwise provide:
•User Content that violates any third-party right (including any copyright, trademark, patent, trade secret, privacy right, right of publicity, or any other intellectual property or proprietary right);
•User Content that is tortious, trade libelous, defamatory, false, or intentionally misleading;
•User Content that is harassing, abusive, threatening, harmful, vulgar, obscene, or offensive, or that contains pornography, nudity, or graphic or gratuitous violence, or that promotes violence, racism, discrimination, bigotry, hatred, or physical harm of any kind against any group or individual;
•Any form of unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages;
•User Content that violates any law, regulation, or contractual obligations.
6. Subscriptions and Fees
6.1 Subscription Services: The DeepHealth App may offer subscription services or in-app purchases. All subscriptions and purchases are subject to this Agreement and the terms and conditions of the application store (e.g., Apple App Store) through which you obtained the App.
6.2 Fees: You agree to pay all fees and applicable taxes incurred by you or anyone making purchases through the DeepHealth App. We reserve the right to revise the pricing for goods and services offered through the App at any time. You acknowledge that we are not required to provide a refund for any reason, and that you will not receive money or other compensation for unused virtual items when you close your account or cease to use the App.
6.3 Auto-Renewal: If your subscription includes an auto-renewal feature, you understand and agree that your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current subscription period. You can manage or cancel your subscription through your app store account settings.
7. Third-Party Services and Links
The DeepHealth App may contain links to third-party websites, services, or resources. We are not responsible for the content, privacy policies, or practices of these third-party websites or services. You access and use these third-party websites or services at your own risk and should review their respective terms and policies.
8. Disclaimers
To the maximum extent permitted by applicable law, the DeepHealth App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance. We do not warrant that the DeepHealth App will meet your requirements, operate uninterrupted, timely, securely, or error-free, or that any defects will be corrected. Your use of the DeepHealth App is at your sole risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall we (or our suppliers) be liable to you or any third party for any lost profits or any indirect, consequential, exemplary, incidental, special, or punitive damages arising from or relating to this agreement, our privacy practices, or the DeepHealth App, even if we have been advised of the possibility of such damages. Your access to and use of the DeepHealth App is at your own discretion and risk, and you will be solely responsible for any damage to your computer system or mobile device or loss of data resulting therefrom. Notwithstanding anything to the contrary contained herein, our liability to you for any damages arising from or related to this agreement or our privacy practices (for any cause whatsoever and regardless of the form of the action) will at all times be limited to the amount you paid us in the prior 12 months (if any). In no event shall our suppliers have any liability arising out of or in any way connected to this agreement.
10. Indemnification
You agree to defend, indemnify, and hold harmless us (and our suppliers) from and against any claims, suits, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) brought by third parties resulting from or relating to: (i) your use of the DeepHealth App; (ii) your User Content; or (iii) your violation of this Agreement. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without our prior written consent. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
11. Term and Termination
11.1 Agreement Effectiveness: This Agreement commences on the date you accept this Agreement (as described in the preamble) and will remain in full force and effect while you use the DeepHealth App, unless terminated earlier in accordance with this Agreement.
11.2 User Termination: You may terminate your account and stop using the services at any time through the App settings or by contacting us. Upon termination, your right to use the DeepHealth App will automatically terminate immediately.
11.3 Our Termination: We reserve the right, in our sole discretion, to suspend or terminate your account and access to the DeepHealth App at any time without notice, for reasons including, but not limited to, your violation of this Agreement. Upon termination, your User Content may be deleted from our live databases. We shall not have any liability whatsoever to you for any termination of this Agreement, including the deletion of your User Content.
11.4 Survival: Even after this Agreement is terminated, the following provisions of this Agreement will remain in effect: Section 2 (Medical Disclaimer), Section 3 (AI Analysis Feature Disclaimer), Section 4.2 (Restrictions), Section 4.3 (Ownership), Section 5 (User Content), Section 8 (Disclaimers), Section 9 (Limitation of Liability), Section 10 (Indemnification), Section 11.4 (Survival), Section 12 (Governing Law and Dispute Resolution), and Section 13 (Miscellaneous).
12. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles. Any dispute, claim, or disagreement arising out of or in connection with this Agreement shall first be resolved by friendly negotiation between the parties. If negotiation fails, either party may submit the dispute to the competent courts in Hong Kong for resolution.
13. Miscellaneous
13.1 Entire Agreement: This Agreement constitutes the entire agreement between you and us regarding the DeepHealth App and its services and supersedes all prior oral or written agreements.
13.2 Severability: If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
13.3 Waiver: Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
