1. Acceptance of Terms
Welcome to the AI Video Generator mobile application (the "App"), operated by DANA SOFT PTY LTD ("we," "our," or "us"). By downloading, installing, registering for, or using our App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Changes to Terms
We reserve the right to modify, update, or change these Terms at any time. Any changes will be effective immediately upon posting the updated Terms within the App or through our update notifications. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
3. Eligibility and Account Registration
Age Requirement: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under the legal age of majority in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf.
Account Security: If the App requires an account or email registration, you are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
4. In-App Purchases and Subscriptions
The App may offer in-app purchases, premium features, and auto-renewing subscription services (e.g., weekly, monthly, or annual plans) to access advanced AI video generation capabilities.
Billing and Payment: All purchases and subscriptions are billed through your app store account (e.g., Google Play Billing). By subscribing, you authorize the platform provider to charge your designated payment method for the applicable subscription fees.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation and Refunds: You can manage or cancel your subscriptions at any time through your app store account settings (Google Play Subscriptions). Cancellation takes effect at the end of the current active billing cycle. Refund policies are governed strictly by the terms and conditions of the respective app store platform.
Price Changes: We reserve the right to adjust subscription pricing at our discretion. Any price changes will take effect at the start of the next subscription period following notice to you.
5. User-Generated Content and Conduct
User Inputs: You may provide text prompts, images, audio, or other media ("User Content") to generate AI videos. You retain ownership of your inputs, but you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit your User Content solely for the purpose of providing and operating the App's video generation features.
Prohibited Conduct: You agree not to use the App to create, upload, or transmit any content that:
Infringes any copyright, trademark, patent, trade secret, or other intellectual property or privacy rights of any third party.
Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable.
Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.
Contains malware, viruses, or malicious code designed to disrupt, damage, or limit the functionality of software, hardware, or telecommunications equipment.
Impersonates any person or entity, or falsely misrepresents your affiliation with any person or entity.
Content Enforcement: We reserve the right (but have no obligation) to review, monitor, or remove any User Content or suspend/terminate your access to the App at any time if we determine that you have violated these Terms.
6. Intellectual Property Rights
All software, user interfaces, designs, text, graphics, trademarks, logos, and service marks contained within the App are the exclusive property of DANA SOFT PTY LTD or its licensors. Nothing in these Terms grants you any right, title, or interest in or to our intellectual property, except for the limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial purposes in accordance with these Terms.
7. Disclaimer of Warranties
THE APP AND ALL AI-GENERATED OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DANA SOFT PTY LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI-GENERATED VIDEOS WILL MEET YOUR SPECIFIC EXPECTATIONS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DANA SOFT PTY LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the courts located in Australia, and you consent to the personal jurisdiction of such courts.
