Please read these Terms of Use carefully before using Color Identifier & Analysis. By downloading, installing, or using the app, you agree to be bound by these terms.
1. ACCEPTANCE OF TERMS
By accessing or using Color Identifier & Analysis, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.
2. DESCRIPTION OF SERVICE
Color Identifier & Analysis is a mobile application that allows users to identify colors using their device camera or photo library, generate color palettes, and export color codes in various formats. The app offers both free features and premium subscription features.
3. SUBSCRIPTION TERMS
Premium Features
Some features of the app require a paid subscription. Premium features include unlimited color identification, palette generation, developer code export, and access to all app features.
Subscription Options
We offer the following subscription options:
- Weekly subscription
- Annual subscription
Billing
Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing Subscriptions
You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Price Changes
Prices are subject to change. We will notify you of any price changes before they take effect.
4. USER RESPONSIBILITIES
You agree to:
- Use the app only for lawful purposes
- Not attempt to reverse engineer or modify the app
- Not use the app in any way that could damage or impair the service
- Provide accurate information when required
- Maintain the security of your device and account
5. INTELLECTUAL PROPERTY
All content, features, and functionality of the app, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of Color Identifier & Analysis and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our app or its content without our express written permission.
6. COLOR INFORMATION DISCLAIMER
The color identification and matching features are provided for informational and reference purposes only. While we strive for accuracy, we do not guarantee that color names, values, or matches are 100% accurate. Color appearance may vary depending on your device display settings and lighting conditions.
We are not responsible for any decisions made based on color information provided by the app, including but not limited to paint purchases, design decisions, or professional work.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Color Identifier & Analysis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
In no event shall our total liability exceed the amount you paid for the subscription in the twelve months preceding the claim.
8. DISCLAIMER OF WARRANTIES
The app is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be uninterrupted, secure, or error-free, or that defects will be corrected.
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Color Identifier & Analysis and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the app.
10. MODIFICATIONS TO THE APP
We reserve the right to modify, suspend, or discontinue the app or any part thereof at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the app.
11. CHANGES TO TERMS
We reserve the right to modify these Terms of Use at any time. We will notify you of any material changes by updating the "Last Updated" date. Your continued use of the app after such changes constitutes your acceptance of the new terms.
12. TERMINATION
We may terminate or suspend your access to the app immediately, without prior notice or liability, for any reason, including if you breach these Terms of Use. Upon termination, your right to use the app will cease immediately.
13. GOVERNING LAW
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which the app developer resides, without regard to its conflict of law provisions.
14. SEVERABILITY
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
15. ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement between you and Color Identifier & Analysis regarding the use of the app and supersede all prior agreements and understandings.
