Gift Ban - 8 of 25

Incorrect answer:

YES, because you do not intend to eat or drink anything at the event is INCORRECT.

Amendment 41 prohibits professional lobbyists from giving members of the General Assembly (among others) any gift or thing of value of any kind, regardless of the value. This prohibition expressly includes meals and beverages. Amendment 41 also provides that members of the General Assembly must hold the respect and confidence of the people and must carry out their duties for the benefit of the people of the state. In so doing, the constitution states that members must avoid conduct that is in violation of their public trust or that creates a justifiable impression among members of the public that the trust is being violated. The statutory code of ethics also acknowledges that the holding of public office is a public trust and that members of the General Assembly must carry out their duties for the benefit of the people of the state. See, section 24-18-103, C.R.S. Based on this principle, it would be inappropriate to attend the event paid for by a professional lobbyist, even though you do not intend to eat or drink.
