AGE RESTRICTION

By placing an order with "GL1TCH3DC0LT1C", you agree that you are or are over the age of 18. The client must be 18+ at the time of placing the order. There will be no exceptions to this regulation.

COMPLETION TIMES

Commissions may be completed anywhere between 1 week - 2 months depending on the size and style of the commission in question, as well as the motivation of the artist. This commission period may be extended or shortened if the client requests a specific due date, or if the commissioner is unable to fulfill the commission at the current point in time due to important matters such as life complications (health related or otherwise). If a due date is not specified by the client, the original dates will be used instead. It is the client's responsibility to provide a date if a time limit must be enforced. Please note a time limit cannot be placed after the commission has already been started.

GOOGLE FORM

By submitting a Google form, you agree to the terms listed on both the form and the ToS, and you have agreed to all pricing and creative opportunities listed within. You also agree that you will be able to provide payment for your commission within the first 48 hours after verification has been secured. If you are unable to provide payment within this time period, your commission will be terminated along with the form. You can re-submit your form in the future to try again if desired.

*Please note that at the moment, I am not comfortable drawing FERAL, REPTILIAN, or MECHA CHARACTERS for commissions (due to a lack of practice). This is subject to change in the future.

QUOTES AND PRICES

Payment must be provided within the first 48 hours after your form can be verified. Your commission price will be paid in 2 parts. You must provide half of the agreed upon amount within the first 48 hours. The second half must be provided when the final lineart and colouring or polished sketch have been sent for corrections, or when the first WIP writing has been sent for corrections in the case of writing commissions. Failure to provide payment on time will result in your commission's termination. Prices can be found via our personalized PRICE GUIDE.


As a reminder, my prices are currently listed in USD because I reside in the US. My pages will be updated when I move back home (to Canada).

PAYMENT METHODS

I only accept money for Google form commissions through PayPal or CashApp.


For most of my commissions, I prefer to use CashApp for my own security and personal comfort due to some of PayPal's ToS and the way it handles money I send or receive, as well as the method of which I need to receive money. I will only use PayPal if it is the only service that you have that you can send, or receive (in the case of a refund), money from.

REFUND POLICY

Refunds on digital items: Refunds will not be provided if a client has just 'changed [their] mind.' By filling out the Google form you have agreed that you will be receiving a product from me, and that will be final. If a commission is terminated for any reason, a refund will be provided based on the amount of work completed. Full refunds will be provided if no work on the commission has begun. (Example: You paid 50$ for a commission. I completed the lineart (½ of the process). You decide to terminate the commission. You are refunded 25$ as half of the work was completed.)

SHIPPING INFORMATION

At this time, I do not ship out my commissions as most of my works are digital. If in the future I offer commissions to be printed and shipped out, this section will be updated with all required info. You as the client are free to print out the works you receive to use as stickers, pins, framed photos, or posters. This does NOT give you the rights to resell my pieces as physical merchandise.

ARTISTIC FREEDOM

If you request 'free reign' from the artist, you are agreeing that the artist is free to do as they please with your piece. Free reign, in short, means that the artist is able to decide the background, the pose, the expression, and whether or not to draw optional details as specified on the provided reference sheet. You will receive a WIP sketch for approval, and have the opportunity to request changes ONLY TO THE SKETCH. Linearting, colouring, and shading will be left to the end of the commission and may not have requested changes. This rule applies ONLY if artist's freedom, or 'free reign', has been explicitly stated or requested in the Google form.


The artist may make content showcasing the process of the commission, including but not limited to; speedpaints or live streams. If you do not wish for your commission to be recorded or streamed, you can state such via e-mail or the extra information section of the Google form. By saying nothing, you agree that I am allowed to record or stream my process. If a video or stream has been completed with your commission, you may request for the VOD or video to be deleted. If a speedpaint has been made or is explicitly requested, you as the client can request a song or set of songs to be used in the video. I have a list of artists that I can not use music from, as my video will get blocked worldwide, that I can also provide to you if necessary.

AUTHOR FREEDOM

Author freedom is a writer's variation of artistic freedom. It enables the author to come up with a storyline utilizing the given characters and world provided to their own discretion. The author is allowed to make up a plotline within the designated word count with very little input from the client. The client will be given access to the story outline and/or basic plot summary (for shorter stories) and revisions may be made at this point in time. 

REVISIONS OR CHANGES

Any part of the process can be changed or edited. Only 3 minor changes may be requested at a time. Further changes will come with a 5$ fee. I will keep track of these, and notify you when the limit is reached. The different steps in the process do not have independent counters, and changes from previous steps in the process will stack. (Example: You requested a body part be resized in the sketch. In the colouring, you requested a pair of markings to be redone. In the lineart, you requested thicker lines in a specific part of the piece. These are not counted independently, and all go towards this rule counter. If you requested any further changes, you would be required to pay the fee.)


WIPs / Sketches: You may request a complete redo of the WIP sketch ONCE. If another redo is requested, a 15$ fee will be added to the original agreed upon price to coincide with what I normally charge for a sketch commission.
Writing Corrections: You may request a complete rewrite of the WIP story ONCE. If another redo is requested, a 7$ fee will be added to the original agreed upon price to coincide with what I normally charge for 1,000 words.

Periodic Screenshots: Screenshots of the full desktop program will be provided while I work through the artwork, as I deem necessary. The full desktop is captured to prevent potential theft and prove that I am not using an AI program for my art.* It is also done, in general, to confirm with the client that the artwork is turning out satisfactory.

*If I am recording my art process for a speedpaint, a video of me drawing (not sped up) can be provided on request to the client.

SKETCH COMMISSIONS

When receiving a sketch commission from me, regardless of whether or not the commission is coloured, you are not allowed to line, colour, and/or shade the sketch that I have provided to you*. I consider this to be theft of my art, and an unfair usage of my services. Further commission orders from you will be declined and you will be banned from receiving or using my services in the near future if you have violated this guideline.

*Many people will think that they can purchase and complete a sketch so as to get out of paying the full price for a completely rendered picture. Please do not be like them. This is a form of scamming and it will not be tolerated.

USAGE LEGAL RIGHTS

ARTIST LEGAL USAGE RIGHTS: I retain the full copyright to the image(s) I have created upon their completion. I have the rights to distribute the service publicly with a watermark, unless explicitly requested via the client or Google form. I am allowed to use the image(s) created for personal use, such as an art showcase or advertisement for commissions of said type unless specified otherwise by the client. 

CLIENT USAGE RIGHTS: You have the rights to post the art provided digitally for non-profit and strictly personal use. You are not allowed to create merchandise out of my art such as logos, layouts, prints, stickers, or other such items that may be sold commercially. If you wish to use my art commercially, you may contact me to purchase complete rights over the piece.* Buying the rights to the piece from me does NOT mean you are allowed to claim yourself as the artist or creator of the piece.*

*If you purchased a sketch commission from me, and are willing to pay the fee to purchase full rights over the image, you are allowed to line, colour, and shade the picture to your liking. Do keep in mind that you are still not allowed to claim that you drew the picture, even if you edited parts of the sketch.

Notice: At the moment I am not accepting professional jobs, such as storyboarding, book covers, films, advertisements, or other such jobs. This rule is subject to change in the future. If you are interested in offering me a professional job at any point, I am willing to hear more details. This does not mean I will be accepting immediately after learning more, I only want to know more information for if I do become interested in the future.

MATURE 18+ TOS

THINGS I WILL NOT DRAW/WRITE:

*This rule can be worked around in the form of my writing commissions, namely if the story concept involves a lot of fight sequences.

ABOUT AI ART

At no point in time will you be permitted to use the commission(s) that you receive to train an AI model. If you have used my art/writing for AI training, you will be instructed to remove my art/writing from your program, and I will not work with you again. Failure to comply with these regulations will result in a lawsuit due to unlawful usage of my works. If I do discover that you have assisted in AI art/writing previously or actively use it, I will not accept any commissions from you again, or at all if you have not yet commissioned me but have been interested in doing so. My stance on AI art will not be changed, and it is not up for debate.


Please do keep in mind that my morality regarding AI artwork falls into a grey area, as I can and will encourage AI adopt theft due to the inability to copyright characters 'drawn' by an artificial intelligence. I am willing to draw AI adoptables as commissions from you, however this is a practice that I very seldom delve into. Please do keep in mind that I will not always be 100% comfortable with this concept, and your commission may be rejected if I do not feel comfortable carrying it out.

NFTS AND CRYPTOCURRENCY

Like AI art/writing, you are not permitted to use the commission(s) that you receive to create NFTs or resell my products using cryptocurrency. You will be instructed to remove my art from your websites and social media, and refund anyone who had purchased NFTs using my artwork from you. I will not work with you again. Failure to comply with these regulations will result in a lawsuit due to unlawful usage of my works. If I have been made aware that you create or indulge in NFT content, I will not accept commissions from you again, or at all if you have not yet commissioned me but have been interested in doing so. I will not allow my hard work to engage in harmful content.


I also refuse to accept cryptocurrency as payment for my commissions. I do not have a crypto wallet, and I never will have a crypto wallet. Crypto is unreliable due to being a digital currency. Living in a world rampant with hackers, anyone can easily hack into your account and steal all of the 'money' that you acquired. I would rather take the smart route and refuse to associate with it, to preserve the environment and my money. For anyone interested in NFTs or cryptocurrency that's reading this, please reconsider it, and do some more research on how the cons outweigh the benefits.


To explain in detail; NFTs and cryptocurrency create extremely dangerous greenhouse gasses. Greenhouse gasses trap the heat from the sun in our atmosphere, thereby warming the planet. Yes, climate change is real, and it's our fault. I am not willing to debate this with people who think NFTs and crypto mean anything and climate change isn't real. I refuse to change my opinion


I will not allow my art to be resold as an NFT, and I will not allow you to pay for my commissions with cryptocurrency. I exclusively accept money via PayPal or CashApp at the current point in time. Failure to provide payment via this medium will result in termination of the commission. While PayPal and CashApp both have an option for cryptocurrency, I refuse to use it. I only accept real money that can be transferred and spent via cash.


WRITING COMMISSIONS

I am willing to write stories and entire books for you, as long as I am comfortable with the contents and word count. I charge a fixed price every 1000 words, and am not comfortable with negotiating this at this time. Charging any higher/lower than my current price does not feel fair to me due to the maximum word count I am willing to write, and the price that the story would be worth if sold commercially. 

Like my art, I am willing to sell the rights to my work for a fee. Ghostwriting to me is no different from normal writing, other than the fact I do not expect to be given credit for my work. With that in mind, I would like to remind you, as the commissioner, that my ghostwriting does not mean you get to claim that you wrote the story yourself. Even if it is not specified who the writer is, it is only fair that you give a disclaimer that you did not write the story or book provided to you via your commission.

As a notice, I want to clarify that I only write in fixed genres. I only write stories within the fiction genre, which means that I do not do biographies or historical books of any sort. Most of my writing comes in the form of non-human creatures with human characteristics, such as the ability to speak or walk on two legs. Common genres that I write in include fantasy, adventure, romance, short stories, and young/new adult. Most of my stories will also include LGBTQIA+ characters of some form, even if they are only implied or not directly stated, meaning that almost all of my stories fall under the LGBT genre.

Though I have not written them before/am not the best at writing them, I am willing to experiment with the dystopian, science fiction, literary fiction, and horror genres. Please do keep in mind that these are typically out of the range of what I am used to writing, and you may expect a slightly lower-quality product. However, I encourage asking me to write in these formats, as the only way I will improve in my writing is to do the writing anyways. Research and practice will help me to improve, and my improvement in writing may become obvious as I continue the story with you. 

I am also willing to write books of poems, though it is something I have not practiced in a long time. My poem books will typically be very short, especially if I do not have a wide range of topics to cover.

COLLABORATIONS: I am willing to collaborate on book/story writing, and I will charge half of my set price for this process (7.50$ per 1000 words) as I expect to do half the work, while you are responsible for the other half. My typical collaboration format follows writing every other chapter, but I am willing to work with the format that you are the most comfortable with. 

SELLING & PUBLISHING: Unless otherwise specified, I will be publishing and selling the stories/books that you commission to me, with credits to you, the commissioner, in the opening pages. These stories/books will typically fall between the 40$-50$ price range, or lower depending on the word count. If I have ghostwritten your story, you are free to sell them yourself.

Please do keep in mind that all of my books are saved in a .docx format and are meant to be sold as E-Books. If you want to create hardcover copies of the ghostwritten story to sell physically with a publisher, I cannot help you. When the story/book is finished, and the contents are sent over, I am not legally bound to assist you further. 

Please note that if you would like me to write a series of stories or books that I work on a book-to-book or story-to-story basis. This means that, even if I have written a book or story in this series for you before, I will not work for free. I will charge the same price across each individual story or book. (Example: If you paid me 1200$ for one book in a series, the second book will also cost you 1200$ for me to write. In other words, the price will stack.)

If you choose to continue the series through your own personal writing, I am not obligated to assist you with characters, settings, or plotlines unless I am paid for my work.

BOOKS ON ROBLOX

Several libraries exist on ROBLOX such as the Tearose Library and the ROBLOX Library. These games are avenues where one can post free books and expect to get no money or ROBUX from these postings.

I am willing to negotiate writing short stories that you may publish to these games as books, for the cost of ROBUX instead of real money. I am willing to go through the effort of filling out the forms required for books to be submitted to these games, assuming that I am already familiar with the systems and/or have published books for the game before.

Please be aware that I have only published books to the Tearose Library and the ROBLOX Library. If any other library games exist that you would prefer I publish to, I humbly ask for your assistance in navigating the publishing process.

I am also willing to ghostwrite these stories for you, filling out the form with your information instead of my own. The same rules with my actual ghostwriting do apply, and a fee will be added onto the original total, though the fee is much more forgiving here.

Based on the estimated value of ROBUX to real world money, I start my pricing at 600 ROBUX per 1000 words, or roughly $7.50 USD, as is my usual pricing for real world stories. For ghostwritten stories, a fee of 200 ROBUX, roughly $2.50 USD, will be added. The maximum I am allowed to write for these stories is a little over 3000 words, equatting to roughly 1800 ROBUX at base value, and 2000 ROBUX for a ghostwritten story, or between $22-$25 USD for a full story.

By agreeing to publish these stories on ROBLOX game libraries, you are not permitted to publish these stories in online spaces or real world marketplaces in accordance with ROBLOX's Terms of Service. Failure to cooperate with this matter will result in termination of all future commissions.
