Executive Order on Dissolution of Immigration and Customs Enforcement and Reassignment of Customs Enforcement Responsibilities to Address Climate Migration and Humanitarian Needs

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Immigration and Nationality Act, 8 U.S.C. 1101 et seq., I hereby order as follows:

Section 1. Purpose and Background

The United States faces pressing challenges, including the urgent need to address climate change and the ongoing humanitarian crisis within Immigration and Customs Enforcement (ICE) facilities. Climate change-induced migration is exacerbating existing vulnerabilities and necessitates a comprehensive response that prioritizes humanitarian concerns and reallocates resources effectively. Recognizing the interconnectedness of these issues, this executive order directs the dissolution of ICE to enhance our capacity to accept climate migrants while ensuring the humane treatment of individuals within our immigration system. Additionally, other government agencies such as the Transportation Security Administration (TSA) and the United States Coast Guard will assume responsibility for customs enforcement activities formerly conducted by ICE, thereby streamlining operations and improving oversight. This action underscores our commitment to upholding humanitarian values, addressing climate-related challenges, and strengthening our immigration system to better serve the needs of all individuals residing in and seeking refuge within the United States.

Section 2. Dissolution of Immigration and Customs Enforcement (ICE)

(a) The Department of Homeland Security (DHS) shall commence the orderly dissolution of Immigration and Customs Enforcement (ICE) in accordance with the provisions outlined in this executive order. This dissolution shall include the cessation of all immigration enforcement activities currently conducted by ICE, including but not limited to detention, deportation, and workplace raids.

(b) All funds previously allocated to ICE shall be reallocated to support initiatives aimed at addressing climate change-related migration and providing assistance to climate migrants. Additionally, funds shall be allocated to address the humanitarian crisis within ICE facilities, including improving living conditions, medical care, and legal representation for detainees.

(c) Personnel currently employed by ICE shall be reassigned to other government agencies or roles as deemed appropriate by the Secretary of Homeland Security. Efforts shall be made to utilize their skills and expertise to support customs enforcement efforts or to assist in addressing the needs of climate migrants and other vulnerable populations.

(d) The dissolution of ICE shall be conducted in a manner that ensures continuity of operations and minimizes disruptions to the delivery of essential services. The Secretary of Homeland Security shall develop and implement a transition plan to facilitate the transfer of responsibilities and resources to other government agencies and ensure the effective implementation of this executive order.

(e) The Secretary of Homeland Security shall submit a report to the President within 90 days of the issuance of this executive order, detailing the progress made in the dissolution of ICE, including any challenges encountered and recommendations for further action. This report shall also include an assessment of the impact of the dissolution on immigration enforcement activities and the ability of other government agencies to assume customs enforcement responsibilities.

Section 3. Reassignment of Customs Enforcement Responsibilities

(a) The Transportation Security Administration (TSA) shall assume primary responsibility for customs enforcement activities at all ports of entry, including airports, seaports, and land border crossings. TSA shall collaborate with other relevant agencies, including Customs and Border Protection (CBP), to ensure the effective enforcement of customs laws and regulations while prioritizing the facilitation of legitimate trade and travel.

(b) The United States Coast Guard shall assume responsibility for customs enforcement activities in maritime areas, including coastal waters and international waters under U.S. jurisdiction. The Coast Guard shall work in coordination with other federal, state, and local agencies to prevent illegal smuggling, trafficking, and other illicit activities that threaten national security and public safety.

(c) The Secretary of Homeland Security shall develop and implement a plan to transfer customs enforcement personnel, assets, and resources from ICE to TSA and the Coast Guard. This plan shall include provisions for training, equipment procurement, and interagency cooperation to ensure a seamless transition of responsibilities.

(d) TSA and the Coast Guard shall prioritize the enforcement of customs laws and regulations in a manner that respects the rights and dignity of individuals and promotes transparency, accountability, and public trust.

(e) The Secretary of Homeland Security shall submit a report to the President within 120 days of the issuance of this executive order, detailing the implementation of the reassignment of customs enforcement responsibilities. This report shall include an assessment of the effectiveness of TSA and the Coast Guard in fulfilling their new responsibilities and any recommendations for improvements or adjustments to the transfer process.

Section 4. Support for Climate Migrants and Addressing Humanitarian Needs

(a) The Department of State, in collaboration with other relevant federal agencies and international partners, shall develop and implement comprehensive strategies to enhance the United States' ability to accept and support climate migrants. These strategies shall prioritize the protection of vulnerable populations, including women, children, and Indigenous communities, and shall include measures to ensure access to humanitarian aid, legal protections, and integration services.

(b) The Department of Health and Human Services (HHS) shall prioritize the provision of medical and psychosocial support services to climate migrants, including access to healthcare, mental health counseling, and trauma-informed care. HHS shall work with state and local governments, non-governmental organizations, and community-based organizations to address the unique health needs of climate migrants and promote their well-being and resilience.

(c) The Federal Emergency Management Agency (FEMA) shall enhance its preparedness and response capabilities to address the needs of climate migrants and mitigate the impact of climate-related disasters and displacement events. FEMA shall collaborate with state, tribal, territorial, and local governments to develop and implement emergency response plans, provide temporary shelter and housing assistance, and facilitate the delivery of essential services to displaced individuals and communities.

(d) The Secretary of Homeland Security, in coordination with the heads of other relevant federal agencies, shall establish a task force on climate migration and humanitarian assistance to coordinate federal efforts to address the needs of climate migrants and ensure a unified and effective response. This task force shall engage with state and local governments, non-governmental organizations, and other stakeholders to identify best practices, share information, and mobilize resources to support climate migrants and affected communities.

(e) The Secretary of Homeland Security shall submit a report to the President within 180 days of the issuance of this executive order, outlining the progress made in implementing the strategies outlined in this section and any recommendations for further action. This report shall include an assessment of the effectiveness of federal efforts to support climate migrants and address humanitarian needs and shall identify areas for improvement or additional investment.

Section 5. Interagency Coordination and Collaboration

(a) The National Security Council (NSC) shall establish a Climate Migration Task Force composed of representatives from relevant federal agencies, including but not limited to the Department of State, Department of Health and Human Services, Federal Emergency Management Agency, Transportation Security Administration, United States Coast Guard, and other agencies as deemed necessary. The task force shall be responsible for coordinating and overseeing the implementation of the initiatives outlined in this executive order.

(b) The Climate Migration Task Force shall develop a comprehensive action plan to guide federal efforts to address climate migration and humanitarian needs. This plan shall include specific objectives, timelines, and performance metrics to measure progress towards achieving the goals outlined in this executive order.

(c) The Climate Migration Task Force shall convene regular meetings to review progress, identify challenges, and coordinate federal agency efforts. The task force shall also engage with state, tribal, territorial, and local governments, as well as with international partners and non-governmental organizations, to leverage resources and expertise in responding to climate-induced migration and humanitarian crises.

(d) The NSC shall provide regular updates to the President on the implementation of this executive order, including progress made by the Climate Migration Task Force and any challenges encountered. The NSC shall also coordinate with relevant federal agencies to ensure that the President is fully informed of developments related to climate migration and humanitarian assistance.

(e) The Secretary of Homeland Security shall submit an annual report to Congress on the implementation of this executive order, including a summary of federal agency activities, expenditures, and outcomes related to addressing climate migration and humanitarian needs. This report shall also include recommendations for legislative or administrative action to further support federal efforts in this area.

(b) Nothing in this order shall be construed to impair or otherwise affect the functions of other government agencies or departments.

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

(d) Any actions taken pursuant to this order shall be done in accordance with all applicable privacy and civil liberties protections.
