These Terms of Use ("Terms") govern your use of Sports Card Scanner: CardGrade (the "App" or "Service") provided by CardGrade ("we," "our," or "us"). By using the Service, you agree to these Terms.
1. Eligibility and Accounts
- You must be legally able to enter into a binding agreement to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2. License and Acceptable Use
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business use.
- You agree not to: reverse engineer the Service, scrape data in bulk, interfere with operations, upload unlawful content, or violate applicable law.
3. Card Data and Pricing Information
- Card identifications, market prices, comps, and trends are provided for informational purposes only.
- We do not guarantee accuracy, completeness, or timeliness of market data.
- Nothing in the Service constitutes financial, tax, legal, or investment advice.
4. User Content
- You retain ownership of content you upload (such as card images, notes, and collection data).
- You grant us a limited license to host, process, transmit, and display your content solely to operate and improve the Service.
- You represent that you have rights to upload your content and that it does not infringe others’ rights.
5. Subscriptions and Billing
- Some features require a paid subscription.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours before the end of the current period.
- You can manage subscriptions and turn off auto-renewal in your Apple account settings.
- Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
6. Intellectual Property
All rights, title, and interest in the Service (excluding your content) are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works except as expressly permitted.
7. Third-Party Services
The Service may rely on or link to third-party services. We are not responsible for third-party content, terms, or practices.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
10. Indemnification
You agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your content, or your violation of these Terms.
11. Termination
We may suspend or terminate access to the Service if you violate these Terms or if necessary for security, legal, or operational reasons.
12. Governing Law
These Terms are governed by applicable laws of the jurisdiction where CardGrade is established, without regard to conflict-of-law principles, except where consumer law provides otherwise.
13. Changes to Terms
We may update these Terms. Continued use of the Service after updates become effective constitutes acceptance of the revised Terms.
