On one brisk evening, Santa, dressed in his signature red and white clothes, peeks his head inside car windows and greets visitors. Dozens of cars snake around the block in West Allis, a suburb of Milwaukee. Trees are wrapped in white and red paper to look like candy canes throughout the neighborhood.

The lights aren't the only attraction. There are snacks too, like crates filled with candy and dog treats. Outside one brightly lit home, inflatable snowmen and cartoon characters sway with the cold wind as music plays and volunteers chat with kids.

As retailers of all stripes compete for holiday-season sales, one of the easiest ways to rake in profits amid the cacophony of their rivals' advertising, promotions and sales is to start selling just a little earlier. "When one retailer starts selling Christmas candy early, then the others follow suit to remain competitive," says Jason Dubroy, a Toronto-based independent retail analyst, "because nobody wants to lose customer visits to people that are offering holiday stuff in advance."

Retailers also stock the shelves so early for logistical reasons. Dubroy says businesses negotiate deals with confectioners for candy anywhere from six months to a year in advance. Ordering in bulk to a warehouse, then shipping it out in increments to stores between November and Christmas, is an efficient way of ensuring a steady stream of sweets.

The very quick transition between Halloween and Christmas sales is also about retail display space. In North America, says Dubroy, confectioners pay retailers for the privilege of selling their candy on store shelves. Not all positions in a store are equal. A shelf at the front of the store, or at eye level, drives higher sales than a section at the very back of aisle six. "That sort of becomes their real estate," he says, "as long as they can maintain the integrity of those displays and merchandising over time."

Gummies, gummy candies, or jelly candies are a broad category of gelatin-based chewable sweets. Gummies have a long history as a popular confectionery. The first gelatin based shaped candy was the Unclaimed Babies, sold by Fryers of Lancashire in 1864. By 1918 they were (and still are) produced by Basset's in Sheffield as Jelly Babies. The gummi bear originated in Germany, where it is popular under the name Gummibr (rubber bear) or Gummibrchen (little rubber bear).

Candy darters are a small freshwater fish native to the Gauley, Greenbrier and New River watersheds in Virginia and West Virginia.?Following a review of the best available scientific information, the U.S. Fish and Wildlife Service has proposed to list the candy darter as threatened under the Endangered Species Act. Nearly half of the 35 known candy darter populations have disappeared since the species was first described in 1932.

Candy darters live up to 3 years and begin breeding around 2 years of age. Spawning in mid- to late spring, candy darters are brood-hiding, bottom spawners. Females select areas of finer pebble and gravel among riffles to deposit their eggs. Male candy darters display aggressive, territorial behavior during spawning. After nipping and chasing away competitors, the larger male successfully fertilizes the eggs. Adult candy darters do not care for their young after spawning.

Named for their vibrant colors, male candy darters have five black saddles along their backs and nine to 11 vertical bands that alternate red-orange and blue-green along the sides of their bodies. Though females maintain a similar marking pattern, they appear mostly olive green and black.

The variegate darter is similar to the candy darter, and outcompetes candy darters for habitat, food and mates.?But most critically, the closely-related variegate darter and candy darter can successfully mate with each other. This results in fertile hybrid offspring that are neither pure candy darter nor pure variegate darter.??After multiple, quickly successive generations of this mixing, candy darter genes are effectively diluted out of the population, and only variegate darters remain.?

Variegate darters were once naturally blocked by the Kanawha Falls from traveling upstream to candy darter populations. But in the late 20th century, variegate darters were released above the falls, possibly as a result of their use as live bait for fishing.??While variegate darter hybridization is ongoing in the Greenbrier and Lower Gauley candy darter populations, large dams prevent the natural spread of variegate darters into the candy darter populations of the Upper Gauley and Middle New River watersheds. Preventing the transfer of live baitfish into these watersheds is vital to the continued existence of candy darters in these areas.

Adult candy darters are observed in shallow, freshwater streams near rock cover and may overwinter under the cover of rocks or woody debris. Younger individuals may take shelter in?in stream substrate of slower, shallower streams.?

The candy darter range is endemic to second order and larger streams within portions of the upper Kanawha River Basin. This area is also known as the Gauley and greater New River watersheds in Virginia and West Virginia.?

This guidance provides a recommended maximum lead level of 0.1 ppm in candy[2] likely to be consumed frequently by small children. FDA considers the recommended maximum lead level to be achievable with the use of good manufacturing practices in the production of candy and candy ingredients and to be protective of human health. In addition to announcing the recommended maximum lead level, FDA as explained below, is rescinding the previous 0.5 ppm guideline for considering enforcement action against candy products likely to be consumed frequently by small children. FDA is prepared to take enforcement action against any candy product containing lead at levels that may pose a health risk. Further, FDA is reiterating its enforcement policy toward the use of lead-based ink on candy wrappers as originally stated in its 1995 letter to the industry on this subject.

FDA is recommending that lead levels in candy products likely to be consumed frequently by small children not exceed 0.1 ppm because such levels are achievable under good manufacturing practices and would not pose a significant risk to small children for adverse effects. This recommended maximum level of 0.1 ppm for lead in candy likely to be consumed frequently by small children is consistent with the FDA's longstanding goal of reducing lead levels in the food supply to reduce consumers' lead exposure to the lowest level that can be practicably obtained. This recommendation is further discussed in the supporting document for this guidance noted above.

Because it is no longer regarded as consistent with the agency's policy of reducing lead levels in the food supply to reduce consumers' lead exposure to the lowest level that can practically be obtained FDA is rescinding the guidance it provided in the 1995 letter that stated that, where frequent consumption of candy products by small children could be anticipated, FDA would consider taking regulatory action against candy with lead levels that exceed 0.5 ppm.

FDA is now prepared to take enforcement action against any candy product containing lead at levels that may pose a health risk. FDA intends to consider several factors in bringing enforcement actions regarding lead in candy, including the level of lead present, the best available consumption data, and the lead exposure that would result from consumption of the product.

Suitable non-lead-based printing inks[3] are widely available for use in food packaging, and we continue to strongly urge all candy manufacturers, including those whose products are offered for import into this country, to refrain from the use of lead-based printing inks on their packaging materials. ff782bc1db
