End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and the individual developer of the BananAI : AI Photo Editor application ("we," "us," or "our"). By downloading, installing, or using the BananAI : AI Photo Editor application ("the App"), you agree to the terms of this Agreement. If you do not agree to these terms, do not use the App.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal and commercial purposes on your mobile device, subject to the terms of your subscription plan.
BananAI : AI Photo Editor is an AI-powered application that allows users to:
Generate images and videos using artificial intelligence
Edit and enhance photos with AI technology
Create content from text prompts, images, or combination of both
Access premium templates and high-quality output formats
Save and manage generated content in a personal gallery
You agree not to:
Modify, adapt, reverse engineer, decompile, or hack the App
Distribute, sell, sublicense, or transfer the App to any third party
Use the App for any unlawful purpose or in violation of any applicable laws or regulations
Generate content that violates intellectual property rights of others
Create content that is harmful, offensive, defamatory, or inappropriate
Attempt to bypass usage limitations or subscription restrictions
Use the App to generate content for resale without appropriate commercial license
All content generated through the App is created using artificial intelligence models
You retain rights to content you generate, subject to the terms of your subscription plan
Commercial use of generated content may require an appropriate subscription plan
We do not claim ownership of your generated content, but we reserve the right to use anonymous, aggregated data to improve our services
You are responsible for ensuring your generated content does not infringe on third-party rights
The App offers multiple subscription tiers:
Pro Plan: 100 video generations per month, HD quality, premium templates, priority processing, email support, no watermarks
Unlimited Plan: Unlimited generations, 4K quality, all templates, fastest processing, premium support, API access, commercial license
By subscribing, you agree to:
Pay the specified fees associated with your selected subscription plan
Acknowledge that subscription fees are non-refundable, except as required by law or app store policies
Usage limitations based on your subscription tier
Subscriptions will automatically renew at the end of each billing cycle (monthly or yearly) unless canceled at least 24 hours before the end of the current period. You can manage your subscription and disable auto-renewal through your app store account settings.
The App utilizes third-party AI services (including but not limited to Fal.ai) to provide content generation capabilities. These services are subject to their own terms of service and privacy policies. We are not responsible for the availability, performance, or policies of these third-party services.
The App may collect and process:
Images and prompts you provide for generation purposes
Generated content for service improvement (in anonymized form)
Usage statistics and app performance data
Account and subscription information
Device information and crash reports
Users must not generate content that:
Violates applicable laws or regulations
Infringes on intellectual property rights
Contains harmful, offensive, or inappropriate material
Depicts illegal activities or violence
Violates privacy rights of individuals
Contains adult content involving minors
We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, including for violation of these terms or content guidelines. Upon termination, your license to use the App will immediately cease, and you may lose access to your generated content.
The App is provided on an "as-is" and "as-available" basis. We do not guarantee that:
The App will be uninterrupted, timely, or error-free
Generated content will meet your expectations or requirements
The App will be free from harmful components or viruses
AI-generated content will be accurate or suitable for any particular purpose
Third-party AI services will remain available or unchanged
You acknowledge and agree that you use the App at your own risk.
To the fullest extent permitted by law, we shall not be liable for any:
Direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App
Loss of generated content, data, or profits
Issues arising from third-party AI service limitations or failures
Legal issues arising from your use of generated content
The App is intended for users aged 13 and above. Users under 18 must have parental consent to use the App and enter into this Agreement.
We may update the App and modify this Agreement at any time. Material changes will be communicated through the App or other appropriate channels. Your continued use of the App after such changes constitutes your acceptance of the new terms.
You agree to comply with all applicable export control laws and regulations when using the App.
This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be resolved through binding arbitration in Turkey.
If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
This Agreement constitutes the entire agreement between you and us regarding the use of the App and supersedes all prior agreements and understandings.
