If you buy the ATV from a person who is not a registered dealer, you must pay the sales tax at a motor vehicle office. To determine the proper amount of sales tax, the DMV needs proof of what you paid for the ATV. Have the seller sign and give you a Statement of Transaction- Sale or Gift of Motor Vehicle, Trailer, All-Terrain Vehicle (ATV), Vessel (Boat), or Snowmobile (pdf) (at NY State Department of Tax and Finance) (DTF-802). You must submit this form to the motor vehicle office, and pay the appropriate sales tax, before registering your ATV:
A GDN is the basic dealer license that allows a person to buy, sell or exchange the type of used vehicle for which the GDN is issued. GDN licenses are divided into several categories. When applying for license, you must select one of the independent license types on the application. If you wish to have multiple types, you may submit multiple applications.
Independent Motor Vehicle - May buy, sell, or exchange any type of used cars, trucks, motor homes, and neighborhood vehicles. May buy, sell, repair, or rebuild salvage motor vehicles and nonrepairable motor vehicles. May use dealer's temporary tags, buyer's temporary tags, and metal dealer license plates on motor vehicles only. Must provide a bond.
Independent Motorcycle - May buy, sell, or exchange any type of used motorcycles, motor scooters or ATVs. May buy, sell, repair, or rebuild salvage motor vehicles and nonrepairable motor vehicles. May use dealer's temporary tags, buyer's temporary tags, and metal dealer license plates on motorcycles, motor scooters or ATVs only. Must provide a bond.
Travel Trailer - May buy, sell, or exchange used travel trailers. May buy, sell, repair, or rebuild salvage motor vehicles and nonrepairable motor vehicles. May use dealer's temporary tags, buyer's temporary tags, and metal dealer license plates on travel trailers only. Exempt from the security requirement.
Trailer/Semitrailer - May buy, sell, or exchange new or used utility trailers and/or semitrailers. May buy, sell, repair, or rebuild salvage motor vehicles and nonrepairable motor vehicles. May use dealer's temporary tags, buyer's temporary tags, and metal dealer license plates on trailers/semitrailers only. Exempt from the security requirement.
Wholesale Dealers - May sell or exchange vehicles only with other licensed dealers. Are NOT required to have a five-vehicle display area. May NOT sell vehicles to retail purchasers. Wholesale vehicle dealers may buy, sell, or exchange used vehicles, including motor vehicles, motorcycles, and travel trailers. May buy, sell, or exchange new or used trailers and/or semitrailers. May use temporary tags and metal dealer license plates. Must provide a bond.
Independent Mobility Motor Vehicle Dealer License - Allows a dealer to offer to sell new mobility motor vehicles. A "mobility motor vehicle" is a motor vehicle designed and equipped to transport a person with a disability.
The bill of sale is basically a document used to prove the ATV was bought or sold. Sometimes referred to as a proof of sale, the bill of sale is considered a valid legal document. The bill of sale should contain all the information needed to register the ATV. Some info to have on your bill of sale includes: buyer and seller information, VIN number, make, model, year, color, agreed price, mileage, and of course signatures.
The new owner will have to reapply for a new title in their name. Either with the bill of sale or the title signed by the seller. Then, if your state requires it, you can register the ATV in your name.
Wear and tear on an off-road vehicle comes with the territory, but tending to some of that before you sell or trade your vehicle can often lead to improved value. Take the time to touch up scratches, fix dents and replace damaged panels or parts, especially if any damage affects the operation or safety of the vehicle.
Of course, making a sale or trade often requires some paperwork on both ends to ensure the legal transfer of property from one party to the other. Be sure to collect any documents you might have dealing with your purchase, title and maintenance of your vehicle and bring them when selling or trading. Also be sure to check with your local or state government regarding title transfers for off-road vehicle sales.
Residents can obtain registrations and renewals from a County Recorder Office. For nonresidents, IDNR User Permits may be obtained at any license vendor (County Recorder Office or participating retailer) that sells hunting and fishing privileges.
Upon transfer of ownership of an ATV or UTV that is registered for public or private use, the seller must give the ATV or UTV registration certificate card to the buyer at the time of the transfer. The buyer must complete an application for transfer within 10 days after the date of the transfer. ATV and UTV dealers are required to submit registration application to the DNR within 5 days after the date of sale and furnish the buyer with a validated (i.e. signed by dealership) registration receipt.

A title to a vehicle is the legal document showing ownership. If the vehicle has more than one owner, and the names are joined by "AND", both owners must sign the title documents for a sale or transfer to be legal. If "OR" or "AND/OR" appears between the owner's name, either owner can sign the title document as the seller or purchaser of the vehicle.
Do not buy a vehicle from an individual unless the seller has the title to the vehicle in their name and can give it to you at the time of sale. Always be sure the vehicle identification number (VIN) on a title matches the vehicle identification number on the vehicle. The vehicle odometer reading must not be less than the odometer reading on the face of the title.
If the vehicle purchased is used, you must have the previous owner's title properly reassigned to you whether it is a West Virginia title or an out-of-state title. Both the seller and the buyer must sign the back of the West Virginia title. If it's an out-of-state title the previous owner must sign the title and the name and address of the new owner should appear on the title. The new owner would then submit the out-of-state title along with the Application for Certificate of Title for a Motor Vehicle (DMV-1-TR).
Model year(s) 2011 and newer will be required to have the current odometer reading and acknowledged with signatures of both buyer and seller, this will be in effect until 2031, at that point any vehicle 20 model years or newer will be required to have the current odometer reading..
When a motor vehicle is sold or transferred, the odometer reading must be recorded in the assignment section of the title by the seller. If the title does not include this section for this purpose, the seller may record the mileage on an odometer statement on a form available from DMV.
To transfer the title of a jointly-owned vehicle (the word "OR" appears between the two names) into the survivor's name, the survivor signs the back of the title as the seller. The survivor also completes the remainder of the title and signs as the purchaser and completes the bottom of the title as the purchaser.
If the title is in the deceased owner's name only, the executor, administrator or legal heir, if applicable needs to sign the title on behalf of the seller. If the title is in joint ownership with the brand "and" appearing between the names, two signatures are required and the surviving spouse signs and then one of the above entities would have to sign on behalf of the deceased owner. If the title is in joint ownership with the brand "or" appearing between the names, the title can be transferred with just the surviving owner's signature. Don't need any other signatures.
The all-terrain vehicle (ATV) bill of sale is a legal document that records the legal sale and purchase of an ATV. This document will provide information with regard to the seller, the buyer, the amount paid, all of the information with regard to the vehicle needed for sale and registration. Once the seller has received payment from the buyer, complete the document for appropriate proof of sale.
When you sell, trade-in, end your lease, donate, or otherwise transfer ownership of your vehicle, you must notify MVD by immediately completing a sold notice. This is a free service. This notice may help protect you from liability if the vehicle is:
1. Application and issuance. A person may not engage in the business of selling ATVs in the State unless that person has registered as a dealer and secured a valid dealer's license from the commissioner. A dealer so registered and licensed need not register individual ATVs.

Generally, you are allowed to sell no more than four vehicles per year without having an auto dealers license under Department of Licensing (DOL) guidelines. However, you are not allowed to title these vehicles in your name without paying either sales tax or use tax. In other words, you are not allowed to privately use these vehicles without paying tax.
