Please read this End-User License Agreement ("EULA") carefully before installing or using the AI Business Card Art Studio mobile application ("the App").
This EULA is a legal agreement between you (the "User") and the Developer of AI Business Card Art Studio. By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, do not use the App.
## 1. License Grant
Subject to your compliance with this EULA, the Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal and commercial business card design purposes strictly in accordance with the terms of this Agreement.
## 2. Artificial Intelligence Services & Generated Content
The App utilizes advanced third-party Artificial Intelligence (AI) APIs (including OpenAI and Replicate) to generate business card designs, text, and layouts based on the prompts you provide.
- **No Guarantees:** AI-generated content is provided "as is." We do not guarantee the accuracy, perfection, physical printability, or uniqueness of the generated business card art, typography, or branding text.
- **Copyright & Commercial Use:** The Developer claims no copyright over the final images generated by the AI on your device. You are free to use the generated business card designs for your personal or commercial projects, print them, or distribute them, provided your original prompts comply with this EULA and applicable laws.
- **Prohibited Prompts:** You agree NOT to use the App to generate content that is illegal, defamatory, hateful, sexually explicit, or infringes upon the intellectual property rights (trademarks, copyrights) of any third party.
## 3. Premium Subscriptions & Billing
AI Business Card Art Studio operates on a premium subscription basis.
- **Purchases:** All billing, subscription management, and refunds are handled exclusively by Apple via your iTunes/App Store account.
- **Auto-Renewal:** Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- **Cancellation:** You may manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase. The Developer cannot cancel subscriptions on your behalf.
## 4. Privacy and Data Usage
Your privacy is important to us. In order to function, the App transmits the text descriptions (prompts) you input to third-party AI providers to generate your designs. No personal identifiers (such as your name, Apple ID, or location) are transmitted with these prompts. By using the App, you consent to this data processing as detailed in our Privacy Policy.
## 5. Restrictions on Use
You agree not to, and you will not permit others to:
- Reverse engineer, decompile, or disassemble the App.
- Modify, adapt, or hack the App or modify another website so as to falsely imply that it is associated with the App.
- Use the App for any illegal or unauthorized purpose.
- Attempt to bypass any paywalls, credit systems, or security mechanisms within the App.
## 6. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your mobile device.
## 7. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. The Developer expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
## 8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to the use of or inability to use the App, even if the Developer has been advised of the possibility of such damages.
## 9. Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement, Apple App Store Terms of Service, OpenAI Terms of Use, and Replicate Terms of Use).
