1. Acceptance of Terms
By downloading, installing, or using BuildSmart ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
BuildSmart is a PC building companion application that provides:
PC build creation and management tools
Component library and specifications database
AI-powered component identification via camera
AI chat assistance for build recommendations
Community features for sharing and rating builds
Build evaluation and pricing estimates
Component compatibility checking
3. Account Registration
3.1 Authentication
To use BuildSmart, you must authenticate using either:
Sign in with Apple
Sign in with Google
You are responsible for maintaining the confidentiality of your account and for all activities under your account.
3.2 Account Information
You agree to provide accurate information during authentication. We receive limited profile information (name, email, profile photo) from your authentication provider based on your privacy settings with that provider.
3.3 Age Requirements
You must be at least 13 years old to use BuildSmart. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
4. User Content
4.1 Your Content
You retain ownership of content you create, including:
PC build configurations
Component libraries
Images uploaded for scanning
Build descriptions and names
Ratings and reviews
4.2 License Grant
By using BuildSmart, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content as necessary to provide the Service.
4.3 Community Content
When you publish builds to the Community:
Your build becomes visible to other users
Other users may rate and like your builds
You can unpublish your builds at any time
You retain ownership but grant other users the right to view your shared content
4.4 Content Standards
You agree not to upload content that:
Infringes intellectual property rights
Contains malicious code or harmful content
Is offensive, defamatory, or inappropriate
Violates any applicable laws
5. AI Services
5.1 Component Identification
BuildSmart uses Google Gemini AI to identify PC components from photos. By using this feature:
Your images are processed by Google's AI services
Results are estimates and may not be 100% accurate
We are not responsible for misidentification
5.2 Build Chat Assistant
The AI chat feature provides general guidance and recommendations. AI responses:
Are for informational purposes only
Should not be considered professional advice
May contain inaccuracies
Should be verified independently before making purchasing decisions
5.3 Build Evaluation
The pricing and evaluation feature:
Provides estimates only, not guaranteed prices
Uses third-party market data that may be outdated
Is limited to 100 lifetime evaluations per account
Is limited to 10 evaluations per week per modified build
Should not be relied upon for financial decisions
6. Third-Party Services
BuildSmart integrates with third-party services including:
Firebase (Google) - Authentication and data storage
Google Gemini AI - Component identification and chat
DeepSeek AI - Build evaluation analysis
Serper API - Market pricing research
eBay API - Component pricing data
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or accuracy.
7. Acceptable Use
You agree not to:
Reverse engineer, decompile, or disassemble the App
Use automated systems to access the App excessively
Circumvent usage limits or restrictions
Impersonate others or misrepresent your affiliation
Use the App for any unlawful purpose
Interfere with or disrupt the App's operation
Attempt to gain unauthorized access to our systems
8. Intellectual Property
8.1 Our Property
BuildSmart, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.
8.2 Component Data
Component specifications, benchmarks, and compatibility data are compiled from various sources. This data is provided for informational purposes and we make no warranties regarding its accuracy or completeness.
9. Disclaimers
9.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 No Professional Advice
BuildSmart does not provide professional, financial, or technical advice. All recommendations, evaluations, and information are for general guidance only.
9.3 Hardware Decisions
We are not responsible for any hardware purchasing decisions, compatibility issues, or damages resulting from reliance on information provided by the App.
9.4 Third-Party Accuracy
We do not guarantee the accuracy of pricing, availability, or specifications obtained from third-party sources including eBay and other marketplaces.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless the developer of BuildSmart from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
12. Modifications to Service
We reserve the right to:
Modify, suspend, or discontinue any part of the Service
Change features, usage limits, or functionality
Update these Terms at any time
We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance.
13. Termination
13.1 By You
You may stop using BuildSmart at any time. You can delete your account through the App settings.
13.2 By Us
We may suspend or terminate your access if you:
Violate these Terms
Engage in fraudulent or harmful activity
Abuse the Service or its features
13.3 Effect of Termination
Upon termination:
Your right to use the App ceases immediately
We may delete your data after a reasonable period
Provisions that should survive termination will remain in effect
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BuildSmart operates, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
16. General Provisions
16.1 Entire Agreement
These Terms constitute the entire agreement between you and BuildSmart regarding the App.
16.2 Severability
If any provision is found unenforceable, the remaining provisions shall continue in effect.
16.3 Waiver
Our failure to enforce any right does not constitute a waiver of that right.
16.4 Assignment
You may not assign your rights under these Terms. We may assign our rights without restriction.
