# End-User License Agreement (EULA) of AI Board Game Card Generator

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and the developer of AI Board Game Card Generator ("we", "us", or "our").
Please read this EULA carefully before downloading, installing, or using the AI Board Game Card Generator application ("Application"). By downloading, installing, or using the Application, you are agreeing to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the Application.
## 1. License Grant
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement. This license is for your personal and commercial use, subject to the conditions outlined herein.
## 2. Artificial Intelligence and Generated Content
The Application utilizes Artificial Intelligence (AI) technologies, including third-party services like OpenAI and image generation models, to create board game card designs based on text prompts provided by you.
* **User Responsibility:** You are solely responsible for the text prompts you input into the Application. You agree not to input prompts that are illegal, offensive, discriminatory, or infringe upon the intellectual property rights of any third party.
* **Content Ownership:** To the extent permitted by applicable law and the terms of the underlying AI services, you retain the rights to the images you generate using the Application. You may use these images for personal or commercial board game projects.
* **No Guarantee of Uniqueness:** Due to the nature of generative AI, the Application may generate similar or identical images for different users. We do not guarantee that the generated images are unique to you.
## 3. In-App Purchases and Subscriptions
The Application may offer premium features, credits, or subscriptions ("In-App Purchases").
* All purchases are processed securely through the respective app store (Apple App Store or Google Play Store).
* Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
* You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
* We do not process payments directly and do not store your financial information.
## 4. Restrictions
You agree not to, and you will not permit others to:
* License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application itself (excluding the images you generate).
* Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application.
* Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of the Application or its affiliates, partners, suppliers, or the licensors.
## 5. Privacy Policy
Your use of the Application is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Application, you acknowledge and consent to the collection and use of your data as outlined in the Privacy Policy.
## 6. Modifications to Application
We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
## 7. Term and Termination
This EULA shall remain in effect until terminated by you or us. We may, in our sole discretion, at any time and for any or no reason, suspend or terminate this EULA with or without prior notice.
This EULA will terminate immediately, without prior notice from us, in the event that you fail to comply with any provision of this EULA. Upon termination of this EULA, you shall cease all use of the Application and delete all copies of the Application from your mobile device.
## 8. Warranties and Limitation of Liability
The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE APPLICATION, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
In no event shall we be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Application).
## 9. Governing Law
The laws of the jurisdiction in which you reside, excluding its conflicts of law rules, shall govern this EULA and your use of the Application.
