Please be sure to carefully read and fully understand the following terms. When you use the services provided by Background Remover · Cutout, you agree to have read and accepted all terms of this Agreement; otherwise, please do not use the product.
We may revise this User Agreement in due course. In the event that the terms of this User Agreement are amended, we will show you the amended agreement by way of push notifications and/or pop-up windows when you log in or when the App version is updated. Please note that we will follow the updated agreement to collect, use, and store your personal information only after you have tapped on the consent button in the pop-up window.
If you are a minor, please read the agreement and use this service with your legal guardian, paying special attention to the terms of use for minors.
The specific content of the Background Remover · Cutout, service is provided by OI WA LAU (the "Operator") according to the actual situation, including but not limited to image editing, background removal, and related processing tools. The Operator reserves the right to upgrade or adjust the services or products it provides and will update the relevant pages or information in a timely manner.
You agree that Background Remover · Cutout may, by itself or through any third-party advertiser, send you advertising, promotional, or publicity information. The method and scope of such advertising may be changed without prior notice to you. Background Remover · Cutout performs the relevant obligations for advertisers in accordance with the law; however, you should judge the authenticity of the advertising information independently and bear responsibility for your own judgments. Except as specifically provided by law, Background Remover · Cutout shall not bear any responsibility for losses or damages suffered by users arising from advertising transactions or the content provided by advertisers.
You agree and understand that Background Remover · Cutout may need to carry out regular or irregular maintenance on the App or related facilities. Background Remover · Cutout shall not bear any liability for any interruption of services within a reasonable time due to such circumstances. We reserve the right to suspend any part of the Service for maintenance, upgrades, or other purposes without prior notice.
Except as expressly provided in this Agreement, no part of the App and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including "mirroring") to any other computer, server, website, or other medium for publication, distribution, or any commercial enterprise, without OI WA LAU’s express prior written consent.
You are solely responsible for the user content that you post or process. We do not guarantee the accuracy, integrity, or quality of any user content. You represent and warrant that your use of the services shall not:
Cause harm to minors in any way;
Be used to intentionally or unintentionally contravene or non-comply with regional, national, and international laws;
Breach, violate, or infringe upon the intellectual property rights of any third party;
Intimidate, stalk, mock, harass, or otherwise harm another individual;
Overburden, damage, or impair the operation of the App or the Services;
Impersonate any person or entity or falsely state your affiliation with any person or entity;
Harvest or collect personal information from other users for any unauthorized purpose.
Unless otherwise stated, all materials contained within the App, as well as the content arrangement and selection, are protected by copyright, trademark, and other intellectual property laws.
We take your privacy very seriously. We will collect and store your personal information in accordance with the Background Remover · Cutout Privacy Policy. Using our service means that you agree your personal data can be used according to our Privacy Policy. Additionally, by using the App, you acknowledge and agree that internet transmissions are never completely private or secure.
The basic version of Background Remover · Cutout can be used completely free of charge. We also offer premium subscription options to best meet your needs. You can opt to subscribe to our Pro version to access premium services, exclusive features, and ad-free content. Our fees are subject to different subscription plans and promotions, and we reserve the right to update our fees from time to time.
If you purchase a subscription through the Apple App Store, the following conditions apply:
Payment: Payment will be charged to your Apple ID Account at the confirmation of purchase.
Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Manage Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store after purchase.
Cancellations: No cancellation of the current active subscription is allowed during the active subscription period. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
You understand and agree that the Background Remover · Cutout services are provided in accordance with existing technologies and conditions. We will do our best to ensure the consistency and security of the services; however, we cannot foresee or prevent all legal, technological, and other risks, including but not limited to force majeure, viruses, hacker attacks, system instability, or third-party service defects, which may lead to service interruptions or data loss.
We are constantly changing and improving our Services. We may add or remove functionalities, or suspend or stop a Service altogether. You can stop using our Services at any time. We reserve the right to modify, temporarily suspend, or permanently delete your Account and terminate your access to the Services if we have reason to believe you have breached this Agreement.
Background Remover · Cutout will make reasonable efforts to ensure the continuity and security of the service. However, we do not provide complete assurance, including but not limited to:
We are not responsible for the deletion or failure to store your relevant data or processed photos within the App;
You shall be responsible for risks beyond our control, including incomplete data synchronization due to unstable network signals, loss of personal information due to irresistible factors, or issues arising from using an incompatible device.
YOU UNDERSTAND AND AGREE THAT Background Remover · Cutout DOES NOT PROMISE THAT THE APP OR ANY CONTENT, SERVICE, OR FEATURE WILL BE ERROR-FREE OR UNINTERRUPTED. THE APP AND ITS CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
When permitted by law, OI WA LAU will not be responsible for lost profits, revenues, data, financial losses, or indirect, special, consequential, exemplary, or punitive damages. In all cases, we will not be liable for any loss or damage that is not reasonably foreseeable. To the extent permitted by law, our total liability for any claims under this agreement is limited to the amount you paid us to use the Services in the six months prior to the date of the initial claim.
This Agreement and the Privacy Policy govern the relationship between you and OI WA LAU . They do not create any third-party beneficiary rights. If you do not comply with this Agreement and we do not take action immediately, this does not mean we are giving up any rights we may have. If a particular term is found to be unenforceable, it will not affect any other terms.
The formation, entry into force, performance, interpretation, and dispute settlement of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict of law principles. Any dispute arising between you and OI WA LAU shall first be resolved by negotiation; where negotiation fails, you agree to submit the dispute to the competent courts located in Hong Kong.
