Welcome to Bestmy - Heart Rate & Health (hereafter referred to as "the App"). Prior to using the App, please read these Terms of Use (hereafter referred to as the "Agreement") carefully. This Agreement forms a legally binding contract between you ("User") and ON COURSE 021 DOO ("we" or "the Company").
By accessing or using the App, you agree to abide by all terms and conditions outlined in this Agreement. If you do not agree to these terms, please refrain from using the App.
1. Scope of the Agreement
1.1 Application Coverage
- This Agreement governs all features and services offered by Bestmy - Heart Rate & Health, including but not limited to heart rate monitoring functions and health data analysis tools.
2. Data and Privacy Practices
2.1 Data Collection
- The App collects certain types of data, such as heart rate metrics and device-related information. For comprehensive details on how we handle this data, please refer to our separate Privacy Policy.
- You are responsible for ensuring that any data you provide through the App is legal, truthful, and accurate. You shall bear full responsibility for any risks or consequences arising from the submission of inaccurate or unlawful data.
2.2 Data Storage
- By default, your heart rate data is stored locally on your device. We do not proactively collect or retain your health-related data on our servers.
3. Restrictions on Use
3.1 Prohibited Activities
You shall not engage in any of the following behaviors:
- Reverse-engineering, modifying, tampering with, or launching malicious attacks against the App’s code, systems, or functionality;
- Using the App to distribute illegal content, false information, or material that infringes on the intellectual property rights, privacy, or other legal interests of third parties;
- Interfering with or disrupting the normal use of the App by other users, or undermining the App’s stability or security.
3.2 Disclaimer of Medical Purpose
- The heart rate data provided by the App is for reference only and is not intended to serve as a basis for medical diagnosis, treatment, or professional health advice.
- We shall not be held liable for any health risks, damages, or losses incurred by you as a result of relying on the App’s data for medical or health-related decisions.
4. Modification and Termination of Services
4.1 Service Adjustments
- We reserve the right to update, suspend, or discontinue any or all of the App’s services at any time, without being required to provide prior notice to users.
4.2 Termination of the Agreement
- If you violate any provision of this Agreement, we may immediately revoke your access to the App and terminate this Agreement without prior notice.
- You may choose to stop using the App at any time; however, please note that any existing data stored locally on your device may not be recoverable once you cease use, depending on your device settings.
5. Intellectual Property Rights
- All content and materials within the App, including but not limited to source code, user interface designs, trademarks, logos, and textual/graphic elements, are the exclusive intellectual property of ON COURSE 021 DOO.
- Without obtaining written permission from the Company, you are prohibited from reproducing, modifying, distributing, or using any of the App’s intellectual property for commercial purposes.
6. Limitation of Liability
- We shall not be liable for any of the following:
· Interruptions to App services caused by network outages, device malfunctions, or compatibility issues with your device’s operating system;
· Unauthorized access to or disclosure of your data resulting from your voluntary sharing of account information or device access with third parties;
· Losses or damages arising from force majeure events, such as natural disasters, changes in government policies, or other unforeseen and unavoidable circumstances beyond our reasonable control.

Important Notes
- This Agreement may be updated from time to time. Your continued use of the App after any revisions to the Agreement are posted will be deemed as your acceptance of the updated terms.
- In the event of a conflict between the provisions of this Agreement and the Privacy Policy, the terms of the Privacy Policy shall take precedence.
