This End-User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and the developer of AI Wedding Band Designer ("Developer", "We", "Our", or "Us"). By downloading, installing, accessing, or using the AI Wedding Band Designer mobile application (the "App"), you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, do not download, install, or use the App.
Subject to your compliance with this EULA, Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
2.1 AI Generation: The App utilizes third-party Artificial Intelligence (AI) services, including but not limited to OpenAI and Replicate (Black Forest Labs), to process text prompts, design parameters, and generate jewelry and ring designs. 2.2 Data Transmission: By using the generation and chat assistant features, you acknowledge and agree that the design parameters, material selections, and text prompts you provide will be transmitted to these third-party AI providers for the sole purpose of rendering the design. 2.3 No PII Transmission: We do not intentionally transmit Personally Identifiable Information (PII) to these AI providers. You are strictly prohibited from entering sensitive personal information (such as full names, addresses, or financial data) into the App’s chat or engraving prompt fields.
3.1 Ownership of Generated Images: To the extent permitted by applicable law and the terms of our third-party AI providers, you are granted a non-exclusive license to use, share, and save the ring designs ("Generated Content") created through your prompts within the App for personal purposes. 3.2 No Guarantee of Copyright: Due to the nature of machine learning and AI, Developer makes no representations or warranties that the Generated Content is unique or that it can be copyrighted or trademarked by you. 3.3 App Intellectual Property: The App’s underlying code, UI/UX design, proprietary graphics, branding, and templates remain the sole and exclusive property of the Developer.
4.1 Credits System: The App operates on a credit-based system. Generating designs or interacting with the AI Assistant may consume credits. 4.2 Purchases: You may purchase additional credits through the App Store or Google Play Store. All purchases are processed by the respective app store platforms and are subject to their terms of service. 4.3 No Refunds: All sales of digital credits are final and non-refundable, except where required by applicable consumer law. Credits have no real-world monetary value and cannot be exchanged for cash.
You agree not to use the App to:
Generate content that is illegal, offensive, discriminatory, or infringes upon the intellectual property rights of third parties.
Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
Bypass, exploit, or tamper with the App's credit and paywall system.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE AI-GENERATED DESIGNS WILL MEET YOUR EXPECTATIONS, BE PHYSICALLY MANUFACTURABLE, OR BE ERROR-FREE. THE DESIGNS ARE CONCEPTUAL VISUALIZATIONS ONLY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This EULA is effective until terminated by you or Developer. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
We reserve the right to modify or update this EULA at any time. Your continued use of the App following the posting of an updated EULA constitutes your acceptance of the changes.
