Please read these Terms of Use ("Terms") carefully before using Baby Care Tracker Newborn Logs ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you agree to these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
Baby Care Tracker Newborn Logs is a mobile application designed to help parents and caregivers track and log baby care activities, including but not limited to feeding, diaper changes, sleep, growth, and health records.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use this App. By using the App, you represent and warrant that you meet this requirement.
4. User Accounts and Data
4.1 You are responsible for all data you enter into the App.
4.2 You are responsible for maintaining the security of your device and iCloud account.
4.3 You are responsible for backing up your data. We are not liable for any data loss.
5. Acceptable Use
You agree to use the App only for its intended purpose of tracking baby care activities. You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Remove or alter any proprietary notices or labels on the App
- Use the App to collect data about other users without their consent
6. Medical Disclaimer
6.1 The App is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
6.2 The App is designed for informational and tracking purposes only.
6.3 The insights, summaries, and patterns provided by the App are for general informational purposes and should not be considered medical advice.
6.4 Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment regarding your baby's health.
6.5 Do not disregard professional medical advice or delay seeking it because of information provided by the App.
6.6 In case of a medical emergency, call your local emergency services immediately.
7. Intellectual Property
7.1 The App and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
7.2 You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Subscriptions and Purchases
8.1 Some features of the App may require a subscription or one-time purchase.
8.2 Payment will be charged to your Apple ID account at confirmation of purchase.
8.3 Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
8.4 Your account will be charged for renewal within 24 hours prior to the end of the current period.
8.5 You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
8.6 Any unused portion of a free trial period will be forfeited when you purchase a subscription.
9. Limitation of Liability
9.1 The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
9.2 We do not warrant that the App will be uninterrupted, timely, secure, or error-free.
9.3 In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or in connection with your use of the App.
9.4 Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of the App or violation of these Terms.
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
