This Privacy Policy describes how Ultrasound Art Baby AI Scan ("we", "us", or "our") collects, uses, processes, and shares your information. We are strictly committed to protecting your privacy and being transparent about our data practices, especially concerning the use of Artificial Intelligence (AI) services, in full compliance with Apple App Store Guidelines 5.1.1(i) and 5.1.2(i).
To provide our core functionality of generating artistic pregnancy memories, we collect the following specific types of data directly from you within the App:
Ultrasound Images (Photos): With your explicit permission, we access your device's photo library to allow you to select and upload a baby ultrasound image. We only collect the specific image you actively select. We do not scan, read, or upload any other photos from your device.
Textual Input: We collect the text you manually type into our input fields, such as the baby's name, gestational age (weeks), and a specific date.
How it is collected: All data is collected explicitly through direct user interaction. The app will never access your photos or text silently in the background.
The data we collect is used exclusively for one single purpose: To generate your customized baby art.
Your text input (name, weeks, date) is used to personalize the text overlay on the final artwork.
Your selected ultrasound image and style preferences are used as reference points for the AI generation engine to create a personalized, artistic interpretation of the ultrasound.
We do not use your photos or text for marketing, we do not use them to train our own local AI models, and we do not sell your data to any data brokers.
To generate high-quality artwork, our App relies on highly secure, industry-leading third-party Artificial Intelligence services.
Before any data is transmitted, the App clearly identifies these partners and requires your explicit, active consent (via a pop-up modal) to share your data with them.
When you consent and tap "Generate", your data is securely transmitted to the following specific third parties:
OpenAI, L.L.C. (OpenAI)
What is sent: Only the textual style descriptions and prompts (e.g., "Make a watercolor painting"). Your actual ultrasound image and your personal baby details (name, date) are NOT sent to OpenAI.
Why it is sent: To enhance and translate the prompt for better artistic output.
Protection: OpenAI does not use API data to train their models. They retain data only briefly for abuse monitoring and then delete it.
Replicate, Inc. (Replicate / Black Forest Labs)
What is sent: Your selected ultrasound image and the enhanced text prompt.
Why it is sent: Replicate provides the core AI image-to-image generation engine (SDXL/Flux models) that transforms your ultrasound into the final artwork.
Protection: Replicate processes the image securely. They are strictly bound to process the data only for the purpose of generating the requested output and do not claim ownership of your images.
Confirmation of Equal Protection: We have reviewed the privacy and security policies of both OpenAI and Replicate. We confirm that these third-party AI services provide the same or equal level of privacy protection for your data as stated in this Privacy Policy. They are prohibited from using your personal data for their own independent advertising or unauthorized model-training purposes.
In strict accordance with App Store Guidelines, our App utilizes a clear "In-App Consent Modal" that appears before you ever generate an image.
This modal explicitly states what data (ultrasound, text) is being sent.
This modal explicitly states who the data is being sent to (OpenAI, Replicate).
No data leaves your device unless you actively tap the "Agree" button on this consent modal.
Local Storage: Generated images and your text inputs are saved locally on your device's internal storage so you can view your gallery.
Remote Storage: We do not maintain a centralized database or server of your ultrasound photos. Once the third-party AI services generate your image, the temporary data transmitted over secure HTTPS connections is discarded by the APIs according to their strict short-term retention policies (typically within 30 days or less for abuse monitoring).
Depending on your jurisdiction (e.g., GDPR, CCPA), you may have the right to request access to, correction of, or deletion of your personal data. Because we do not store your data on our own servers (everything is kept locally on your device), you can completely delete all your data simply by deleting the App from your device.
We take reasonable measures to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. All API communications with our third-party AI partners are encrypted using TLS/SSL (HTTPS).
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this policy and, if required, seeking your consent again within the App.
