This Privacy Policy explains how the individual developer of the Are You Dead? | Lonely App ("App"), whose identity and contact details are publicly available on the App’s official Google Play Store listing under the “Developer contact” section, acts as the Data Controller for the personal data collected through the App. By using the App, you consent to the processing of your information as described in this policy.
We collect only the minimum amount of data necessary to provide the service:
User Information: The name and email address you provide to identify yourself.
Emergency Contact Information: The email address of your designated emergency contact.
Activity Data: Timestamps of when you press the "Check In" button.
Legal Basis for Processing: We process your personal data to perform our contract with you (provide the App’s services). The processing of your emergency contact’s email is based on our legitimate interest in providing the core safety functionality of the App.
We use the collected information for the following purposes:
To track your daily check-in status.
To send an automated email notification to your designated emergency contact if you fail to check in within the specified timeframes (e.g., 48 hours).
To maintain and improve the functionality of the App.
Cloudflare: We use Cloudflare services to securely store your data and process the logic of our application. By using the App, you acknowledge that your data may be transferred to and stored on servers maintained by Cloudflare.
We implement reasonable security measures to protect your information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
International Transfers: Since we use Cloudflare, your data may be transferred to and processed in countries outside the European Economic Area (EEA), including the USA. We ensure that such transfers are protected by Standard Contractual Clauses (SCCs) or other legally recognized mechanisms to ensure an adequate level of data protection.
Data Retention: We retain your data only for as long as your account is active. If you delete your account, all personal data and emergency contact information will be permanently erased from our active databases within 30 days.
We do not sell, trade, or rent your personal identification information to others.
Emergency Notification: The only external sharing of data occurs when the App sends an automated email to your emergency contact. This email may contain your name and the fact that you have not checked in.
Right to Access: Request a copy of the data we hold about you.

The App is designed to act as a monitoring tool that sends an email to a contact of your choice if you do not interact with the App for a set period. The App is NOT a replacement for emergency services (911/112), medical monitoring devices, or professional care.
PLEASE READ CAREFULLY:
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
WE ARE NOT LIABLE FOR ANY HARM, INJURY, DEATH, DISTRESS, OR DAMAGES RESULTING FROM:
FAILURE TO NOTIFY: THE APP MAY FAIL TO SEND AN EMAIL DUE TO SERVER OUTAGES, CLOUDFLARE ISSUES, INTERNET CONNECTIVITY PROBLEMS, DEVICE BATTERY FAILURE, OR SOFTWARE BUGS.
FALSE ALARMS: THE APP MAY SEND A NOTIFICATION IN ERROR IF YOU FORGET TO CHECK IN, CAUSING DISTRESS TO YOUR CONTACTS.
BY USING THIS APP, YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR WELL-BEING AND THAT YOU USE THIS SERVICE ENTIRELY AT YOUR OWN RISK.
Accuracy: You are responsible for ensuring the email addresses (yours and your contact's) are correct.
Consent: You represent that you have obtained the consent of your emergency contact to input their email address into this App and for them to receive automated emails from us. You agree that you are solely responsible for notifying your emergency contact that their email will be shared with this App and used for automated notifications. We are not responsible for any disputes or privacy claims initiated by your emergency contact due to your failure to obtain their prior consent.
Device Status: You understand that the App requires an active internet connection to register your check-in.
We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
We reserve the right to modify these Terms at any time. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
6. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the country of the Developer’s registration (as specified in the Developer’s credentials on the App’s Google Play Store listing). Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the city and country of the Developer’s residence/registration, as indicated in the aforementioned Google Play Developer profile.
