1. ACEPTACIÓN DE LOS TÉRMINOS

Al descargar y usar la aplicación "Topo PoliTriangulación" (en adelante, "LA APP"), el usuario (en adelante, "EL USUARIO") acepta cumplir con estos Términos y Condiciones. Si no está de acuerdo, no debe usar LA APP.

2. DESCRIPCIÓN DEL SERVICIO
-------------------------------------------
LA APP es una herramienta de cálculo topográfico especializada que permite:
- Calcular polígonos utilizando únicamente distancias entre vértices y diagonales.
- Obtener superficie y perímetro del polígono.
- Calcular ángulos interiores de todos los vértices.
- Calcular la confiabilidad del levantamiento.
- Generar rumbos de todos los lados (opcional, al agregar un rumbo).
- Calcular coordenadas de todos los vértices (opcional, al agregar una coordenada).
- Generar croquis del polígono.
- Generar reportes PDF con los resultados y datos de campo.
La aplicación funciona de manera local en el dispositivo del usuario y no requiere conexión a internet.

3. USO PERMITIDO

EL USUARIO se compromete a usar LA APP de acuerdo con la ley y estos términos, específicamente para fines profesionales o educativos relacionados con topografía, geodesia, ingeniería civil y agrimensura.

4. USO PROHIBIDO
-------------------------------------------
EL USUARIO NO podrá:
- Usar LA APP para actividades ilegales o fraudulentas.
- Intentar acceder al código fuente o realizar ingeniería inversa.
- Distribuir copias no autorizadas de LA APP.
- Usar LA APP para acosar, amenazar o dañar a terceros.
- Modificar o eliminar las marcas de agua o derechos de autor en los reportes PDF generados.

5. PRECIO Y PAGO

LA APP es de pago. El costo se especifica en las tiendas de aplicaciones (App Store y Google Play). Los precios pueden cambiar sin previo aviso. Los pagos son procesados por las tiendas correspondientes.

6. CANCELACIONES Y REEMBOLSOS
-------------------------------------------
Las políticas de cancelación y reembolso son las establecidas por Apple (App Store) y Google (Google Play). EL LICENCIANTE no realiza reembolsos directos.

7. PRECISIÓN DE LOS CÁLCULOS
-------------------------------------------
LA APP proporciona cálculos de polígonos, superficies, perímetros, ángulos interiores, confiabilidad, rumbos y coordenadas basados en los datos ingresados por EL USUARIO.
EL LICENCIANTE no garantiza la precisión absoluta de los resultados. EL USUARIO es responsable de verificar los cálculos antes de utilizarlos en proyectos profesionales.
Los resultados deben ser considerados como aproximaciones y validados por un profesional calificado.

8. REPORTES PDF Y CROQUIS

LA APP permite generar croquis y reportes PDF con los resultados y datos de campo. Estos archivos:
- Se generan localmente en el dispositivo del usuario.
- No se transmiten ni almacenan en servidores externos.
- Son responsabilidad del usuario su correcto uso y respaldo.
- EL LICENCIANTE no se hace responsable por pérdida, daño o uso indebido de estos archivos.

9. PROPIEDAD INTELECTUAL

Todos los derechos de propiedad intelectual sobre LA APP, incluyendo su nombre, logotipo, diseño, código y plantillas de reportes PDF, pertenecen a EL LICENCIANTE. EL USUARIO no adquiere ningún derecho de propiedad al usar LA APP.
Los reportes PDF generados por LA APP pueden ser utilizados por EL USUARIO para fines profesionales, pero no podrán ser modificados en su formato original ni vendidos como producto propio.

10. EXENCIÓN DE RESPONSABILIDAD

LA APP se proporciona "TAL CUAL". EL LICENCIANTE no es responsable por:
- Errores en los cálculos topográficos, de superficie, perímetro, ángulos, rumbos, coordenadas o confiabilidad.
- Daños directos o indirectos derivados del uso de LA APP.
- Interrupciones o fallos en el funcionamiento.
- Decisiones tomadas basadas en los resultados de LA APP.
- Pérdida o daño de reportes PDF o croquis generados.

11. LIMITACIÓN DE RESPONSABILIDAD

En la medida máxima permitida por la ley, EL LICENCIANTE no será responsable por daños de ningún tipo, incluyendo pérdida de datos, beneficios, daños a la propiedad o errores en proyectos profesionales, derivados del uso de LA APP.

12. CAMBIOS EN LOS TÉRMINOS
-------------------------------------------
EL LICENCIANTE puede actualizar estos Términos y Condiciones. La versión vigente estará disponible en esta página. El uso continuado de LA APP después de los cambios constituye la aceptación de los nuevos términos.

13. LEY APLICABLE
-------------------------------------------
Estos términos se rigen por las leyes de México. Cualquier disputa será resuelta en los tribunales de Monterrey, Nuevo León.

1. PARTES DEL CONTRATO

Licenciante: Israel Martínez, persona física, con domicilio en Monterrey, Nuevo León, México, correo electrónico: mcissrael77@gmail.com (en adelante, "EL LICENCIANTE").
Licenciatario: El usuario final que descarga y utiliza la aplicación (en adelante, "EL USUARIO").

2. CONCESIÓN DE LICENCIA

EL LICENCIANTE otorga a EL USUARIO una licencia limitada, no exclusiva, personal, intransferible y revocable para usar la aplicación "Topo PoliTriangulación" (en adelante, "LA APP") en dispositivos móviles con sistemas operativos iOS y Android, únicamente para el propósito para el cual fue diseñada: calcular polígonos utilizando distancias entre vértices y diagonales, obteniendo superficie, perímetro, ángulos interiores, confiabilidad del levantamiento, rumbos de lados, coordenadas de vértices, así como la generación de croquis y reportes PDF.
Esta licencia no constituye una venta del software. EL LICENCIANTE conserva todos los derechos de propiedad intelectual sobre LA APP.

3. MODALIDAD DE PAGO

LA APP es de pago y se adquiere mediante:
- Pago único (compra definitiva)
- Pago mensual (opcional)
EL USUARIO deberá realizar el pago correspondiente a través de las plataformas de distribución (App Store de Apple y Google Play). EL LICENCIANTE no almacena ni procesa datos de pago.

4. RESTRICCIONES DE USO
-------------------------------------------
EL USUARIO NO podrá bajo ninguna circunstancia:
- Copiar, modificar, adaptar o traducir LA APP total o parcialmente.
- Descompilar, desensamblar o realizar ingeniería inversa del código fuente.
- Distribuir, vender, alquilar, arrendar o sublicenciar LA APP a terceros.
- Eliminar o alterar los avisos de derechos de autor o marcas.
- Utilizar LA APP para fines ilegales o no autorizados.
- Transferir sus derechos de uso a otra persona.

5. PROPIEDAD INTELECTUAL
-------------------------------------------
LA APP, incluyendo su código fuente, diseño, interfaz, gráficos, nombres, logotipos y toda la documentación asociada, es propiedad exclusiva de EL LICENCIANTE y está protegida por las leyes de derechos de autor, marcas y tratados internacionales.
El uso de LA APP no otorga a EL USUARIO ningún derecho de propiedad sobre LA APP o su contenido.

6. DESCARGO DE GARANTÍAS
-------------------------------------------
LA APP SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS.
EL LICENCIANTE NO GARANTIZA que:
- LA APP funcione sin interrupciones, sea segura o esté libre de errores.
- Los resultados obtenidos del uso de LA APP sean precisos o confiables.
- Los errores en LA APP sean corregidos.
EL USUARIO asume todo el riesgo asociado con la calidad, rendimiento y precisión de LA APP. Los cálculos de polígonos, superficies, perímetros, ángulos, rumbos, coordenadas y confiabilidad son aproximados y deben ser verificados por el usuario antes de utilizarlos en proyectos profesionales.

7. LIMITACIÓN DE RESPONSABILIDAD

EN NINGÚN CASO EL LICENCIANTE será responsable ante EL USUARIO o terceros por:
- Daños directos, indirectos, incidentales, especiales, consecuentes o punitivos.
- Pérdida de datos, beneficios o ahorros.
- Interrupción del negocio o daños a la reputación.
- Cualquier otro daño derivado del uso o la imposibilidad de usar LA APP, incluyendo errores en cálculos topográficos, de superficie, perímetro, ángulos, rumbos, coordenadas o confiabilidad del levantamiento.
- Pérdida de reportes PDF o croquis generados por LA APP.
Esta limitación aplica incluso si EL LICENCIANTE ha sido informado de la posibilidad de dichos daños. La responsabilidad total de EL LICENCIANTE no excederá el monto pagado por EL USUARIO por LA APP en los últimos 12 meses.

8. INDEMNIZACIÓN

EL USUARIO acepta defender, indemnizar y mantener a EL LICENCIANTE libre de cualquier reclamo, daño, pérdida, responsabilidad, costo o gasto (incluyendo honorarios de abogados) que surjan del uso indebido de LA APP o del incumplimiento de estos términos.

9. TERMINACIÓN
-------------------------------------------
Esta licencia es efectiva hasta que sea terminada. EL LICENCIANTE podrá terminar esta licencia de inmediato si EL USUARIO incumple cualquiera de las disposiciones aquí contenidas.
Al terminar la licencia, EL USUARIO deberá:
- Dejar de usar LA APP.
- Desinstalar LA APP de todos sus dispositivos.
- Destruir cualquier copia de LA APP en su posesión.
La terminación de la licencia no afectará las disposiciones que por su naturaleza deban sobrevivir, incluyendo propiedad intelectual, descargo de garantías, limitación de responsabilidad e indemnización.

10. LEY APLICABLE Y JURISDICCIÓN

Esta licencia se regirá e interpretará de acuerdo con las leyes de México.
Cualquier disputa relacionada con esta licencia será sometida a la jurisdicción exclusiva de los tribunales de Monterrey, Nuevo León, México, renunciando EL USUARIO a cualquier otro fuero que pudiera corresponderle.

11. ACUERDO COMPLETO

Esta licencia constituye el acuerdo completo entre EL LICENCIANTE y EL USUARIO con respecto a LA APP y sustituye cualquier acuerdo previo, ya sea escrito u oral.

12. MODIFICACIONES
-------------------------------------------
EL LICENCIANTE se reserva el derecho de modificar esta licencia en cualquier momento. Las modificaciones serán efectivas cuando se publique la versión actualizada en esta página o dentro de LA APP. Se recomienda a EL USUARIO revisar periódicamente los términos.
El uso continuado de LA APP después de cualquier modificación constituye la aceptación de los nuevos términos.

1. ACCEPTANCE OF TERMS

By downloading and using the application "Topo PoliTriangulación" (hereinafter, "THE APP"), the user (hereinafter, "THE USER") agrees to comply with these Terms and Conditions. If you do not agree, you must not use THE APP.

2. SERVICE DESCRIPTION
-------------------------------------------
THE APP is a specialized topographic calculation tool that allows:
- Calculating polygons using only distances between vertices and diagonals.
- Obtaining area and perimeter of the polygon.
- Calculating interior angles of all vertices.
- Calculating survey reliability.
- Generating bearings for all sides (optional, when a bearing is added).
- Calculating coordinates for all vertices (optional, when a coordinate is added).
- Generating polygon sketches.
- Generating PDF reports with results and field data.
The application works locally on the user's device and does not require an internet connection.

3. PERMITTED USE

THE USER agrees to use THE APP in accordance with the law and these terms, specifically for professional or educational purposes related to topography, geodesy, civil engineering, and land surveying.

4. PROHIBITED USE

THE USER shall NOT:
- Use THE APP for illegal or fraudulent activities.
- Attempt to access the source code or reverse engineer.
- Distribute unauthorized copies of THE APP.
- Use THE APP to harass, threaten, or harm third parties.
- Modify or remove watermarks or copyright notices in generated PDF reports.

5. PRICE AND PAYMENT

THE APP is paid. The cost is specified in the application stores (App Store and Google Play). Prices may change without prior notice. Payments are processed by the corresponding stores.

6. CANCELLATIONS AND REFUNDS

Cancellation and refund policies are those established by Apple (App Store) and Google (Google Play). THE LICENSOR does not issue direct refunds.

7. ACCURACY OF CALCULATIONS

THE APP provides polygon, area, perimeter, interior angle, reliability, bearing, and coordinate calculations based on the data entered by THE USER.
THE LICENSOR does not guarantee absolute accuracy of the results. THE USER is responsible for verifying calculations before using them in professional projects.
Results should be considered as approximations and validated by a qualified professional.

8. PDF REPORTS AND SKETCHES

THE APP allows generating sketches and PDF reports with results and field data. These files:
- Are generated locally on the user's device.
- Are not transmitted or stored on external servers.

- THE LICENSOR is not responsible for loss, damage, or misuse of these files.

9. INTELLECTUAL PROPERTY

All intellectual property rights over THE APP, including its name, logo, design, code, and PDF report templates, belong to THE LICENSOR. THE USER does not acquire any ownership rights by using THE APP.
PDF reports generated by THE APP may be used by THE USER for professional purposes, but may not be modified in their original format or sold as their own product.

10. DISCLAIMER OF LIABILITY

THE APP is provided "AS IS". THE LICENSOR is not responsible for:
- Errors in topographic, area, perimeter, angle, bearing, coordinate, or reliability calculations.
- Direct or indirect damages arising from the use of THE APP.
- Interruptions or malfunctions.
- Decisions made based on THE APP's results.
- Loss or damage of generated PDF reports or sketches.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, THE LICENSOR shall not be liable for damages of any kind, including loss of data, profits, property damage, or errors in professional projects, arising from the use of THE APP.

THE LICENSOR may update these Terms and Conditions. The current version will be available on this page. Continued use of THE APP after changes constitutes acceptance of the new terms.

These terms are governed by the laws of Mexico. Any dispute shall be resolved in the courts of Monterrey, Nuevo León.

1. PARTIES TO THE AGREEMENT

Licensor: Israel Martínez, individual, with address in Monterrey, Nuevo León, Mexico, email: mcissrael77@gmail.com (hereinafter, "THE LICENSOR").
Licensee: The end user who downloads and uses the application (hereinafter, "THE USER").

2. GRANT OF LICENSE
-------------------------------------------
THE LICENSOR grants THE USER a limited, non-exclusive, personal, non-transferable, and revocable license to use the application "Topo PoliTriangulación" (hereinafter, "THE APP") on mobile devices with iOS and Android operating systems, solely for its intended purpose: calculating polygons using distances between vertices and diagonals, obtaining area, perimeter, interior angles, survey reliability, side bearings, vertex coordinates, as well as generating sketches and PDF reports.
This license does not constitute a sale of the software. THE LICENSOR retains all intellectual property rights over THE APP.

3. PAYMENT METHOD

THE APP is paid and is acquired through:
- One-time payment (permanent purchase)
- Monthly payment (optional)
THE USER must make the corresponding payment through the distribution platforms (Apple App Store and Google Play). THE LICENSOR does not store or process payment data.

4. USE RESTRICTIONS

THE USER shall NOT under any circumstances:
- Copy, modify, adapt, or translate THE APP in whole or in part.
- Decompile, disassemble, or reverse engineer the source code.
- Distribute, sell, rent, lease, or sublicense THE APP to third parties.
- Remove or alter copyright or trademark notices.
- Use THE APP for illegal or unauthorized purposes.
- Transfer their usage rights to another person.

5. INTELLECTUAL PROPERTY

THE APP, including its source code, design, interface, graphics, names, logos, and all associated documentation, is the exclusive property of THE LICENSOR and is protected by copyright laws, trademarks, and international treaties.
Use of THE APP does not grant THE USER any ownership rights over THE APP or its content.

6. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
THE LICENSOR DOES NOT WARRANT that:
- THE APP will function uninterrupted, securely, or be error-free.
- The results obtained from using THE APP will be accurate or reliable.
- Errors in THE APP will be corrected.
THE USER assumes all risks associated with the quality, performance, and accuracy of THE APP. Polygon, area, perimeter, angle, bearing, coordinate, and reliability calculations are approximate and should be verified by the user before use in professional projects.

7. LIMITATION OF LIABILITY

IN NO EVENT SHALL THE LICENSOR be liable to THE USER or third parties for:
- Direct, indirect, incidental, special, consequential, or punitive damages.
- Loss of data, profits, or savings.
- Business interruption or reputational damage.
- Any other damages arising from the use or inability to use THE APP, including errors in topographic calculations, area, perimeter, angles, bearings, coordinates, or survey reliability.
- Loss of PDF reports or sketches generated by THE APP.
This limitation applies even if THE LICENSOR has been informed of the possibility of such damages. THE LICENSOR's total liability shall not exceed the amount paid by THE USER for THE APP in the last 12 months.

8. INDEMNIFICATION

THE USER agrees to defend, indemnify, and hold THE LICENSOR harmless from any claim, damage, loss, liability, cost, or expense (including attorneys' fees) arising from the misuse of THE APP or breach of these terms.

9. TERMINATION
-------------------------------------------
This license is effective until terminated. THE LICENSOR may terminate this license immediately if THE USER breaches any of the provisions contained herein.
Upon termination of the license, THE USER must:
- Stop using THE APP.
- Uninstall THE APP from all their devices.
- Destroy any copies of THE APP in their possession.
Termination of the license shall not affect provisions that by their nature should survive, including intellectual property, disclaimer of warranties, limitation of liability, and indemnification.

10. GOVERNING LAW AND JURISDICTION

This license shall be governed and interpreted in accordance with the laws of Mexico.
Any dispute related to this license shall be submitted to the exclusive jurisdiction of the courts of Monterrey, Nuevo León, Mexico, THE USER waiving any other jurisdiction that may correspond to them.

11. ENTIRE AGREEMENT

This license constitutes the entire agreement between THE LICENSOR and THE USER regarding THE APP and supersedes any prior agreement, whether written or oral.

12. MODIFICATIONS

THE LICENSOR reserves the right to modify this license at any time. Modifications shall become effective when the updated version is published on this page or within THE APP. THE USER is advised to periodically review the terms.
Continued use of THE APP after any modification constitutes acceptance of the new terms.
