# End-User License Agreement (EULA) for AI Neon Sign Visualizer

This End-User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and the developer of AI Neon Sign Visualizer ("Developer", "We", "Us", or "Our"). This agreement governs your use of the AI Neon Sign Visualizer application (the "App"), including all associated media, printed materials, and electronic documentation.
By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the App.
## 1. Grant of License
Subject to your compliance with the terms of this EULA, We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
## 2. Use of the Application
The App provides artificial intelligence-powered tools to generate and visualize neon sign designs based on your text inputs.
* **User Content:** You are solely responsible for the text prompts you input into the App. You agree not to input any prompts that are illegal, offensive, discriminatory, or infringe upon the intellectual property rights of others.
* **Generated Content:** The AI-generated neon sign images produced by the App are provided for your personal visualization and inspiration. You may download and share these images for personal use.
## 3. Subscriptions and In-App Purchases
The App offers premium features accessible via in-app purchases or auto-renewing subscriptions (e.g., Weekly, Monthly, or Yearly Pro Access).
* **Billing:** Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
* **Auto-Renewal:** Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
* **Management:** You may manage your subscription and turn off auto-renewal by going to your Account Settings on the App Store or Google Play Store after purchase.
* **Credits:** Certain plans include a credit system for image generation. Unused credits may expire according to the terms of the specific plan you purchase.
## 4. Intellectual Property Rights
The App, including but not limited to its software, code, UI/UX design, graphics, branding, and all related intellectual property rights, are the exclusive property of the Developer. This EULA does not grant you any ownership rights in the App.
## 5. Third-Party Services
The App relies on third-party services, including but not limited to OpenAI (for text processing) and Replicate / Black Forest Labs (for image generation). By using the App, you acknowledge and agree that your text prompts are transmitted to these third parties solely for the purpose of fulfilling your request. No personal identifiers are linked to the prompts sent to these services.
## 6. Privacy and Data Collection
Your privacy is important to us. We do not collect, store, or share personally identifiable information without your explicit consent.
* **Photo Library Access:** If you choose to save a generated image, the App requires "Add Only" access to your Photo Library. The App does not read, scan, upload, or modify your existing photos.

## 7. Disclaimer of Warranties
The App is provided to you "AS IS" and "AS AVAILABLE" with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the AI-generated images will always be perfectly accurate, reliable, or meet your exact subjective expectations.
## 8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will We, our affiliates, directors, employees, or licensors be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, loss of data, or other damages arising from or related to your use of the App.
## 9. Termination
This EULA is effective until terminated by you or Us. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of the App from your device.
## 10. Governing Law
This EULA and your use of the App are governed by and construed in accordance with applicable international and local laws, excluding its conflicts of law rules.
## 11. Changes to this Agreement
We reserve the right, at our sole discretion, to modify or replace this EULA at any time. We will provide notice of any material changes within the App. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
