This End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and the developer of AI Dress Design ("Company", "we", "us", or "our"). This Agreement governs your use of the AI Dress Design application (including all related documentation, the "Application").
The Application is licensed, not sold, to you.
By downloading, installing, or using the Application, you acknowledge that you have read and understood this Agreement and agree to be bound by its terms. If you do not agree, do not download, install, or use the Application.
You acknowledge that this Agreement is concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Application and its content.
We grant you a personal, revocable, non-exclusive, non-transferable license to use the Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
The Application utilizes Artificial Intelligence to generate dress designs based on user text inputs and uploaded reference images.
Acceptable Use: You agree not to upload, prompt, or generate any content that is illegal, offensive, explicit, harassing, or infringes on the intellectual property rights of others.
No Tolerance Policy: We maintain a zero-tolerance policy for objectionable content or abusive users. You are solely responsible for the prompts you enter and the images you upload.
Rights to Output: Subject to your compliance with this Agreement, you may use the AI-generated dress designs created within the Application for your personal use.
The Application may offer auto-renewing subscriptions or in-app purchases ("Premium Features") through Apple's App Store.
Payment will be charged to your Apple ID account at the confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
We are solely responsible for providing any maintenance and support services with respect to the Application, as specified in this Agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
THE APPLICATION IS PROVIDED TO YOU "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE HAVE ANY LIABILITY ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION OR THE CONTENT AND SERVICES.
You acknowledge that, in the event of any third-party claim that the Application or your possession and use of that Application infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the Application.
