This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and the developer ("We", "Us", or "Our") governing your use of the AI Birthday Cake World mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, do not download, install, or use the App.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a mobile device owned or controlled by you.
The App utilizes Artificial Intelligence (AI) to generate custom 3-tier boutique birthday cake images based on your text inputs (such as profession and hobbies).
Ownership of Output: You retain all rights to the text prompts you input. The resulting AI-generated images provided to you are licensed for your personal, non-commercial use.
Accuracy and Unpredictability: Because the images are generated by AI, the exact results are unpredictable. We do not guarantee that the generated images will perfectly match your expectations.
The App is a premium service. Image generation requires either an active subscription or the purchase of in-app credits.
Auto-Renewing Subscriptions: If you purchase an auto-renewing subscription (e.g., Weekly, Monthly, or Yearly), payment will be charged to your Apple/Google Play account at confirmation of purchase.
Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You may manage or cancel your subscriptions at any time by going to your Apple ID or Google Play account settings.
No Refunds: All purchases, including credit packs and subscriptions, are final and non-refundable, except as required by applicable law.
You agree NOT to use the App to:
Generate, upload, or share any content that is illegal, defamatory, harassing, sexually explicit, hateful, or discriminatory.
Violate the intellectual property rights or privacy rights of any third party.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
Exploit the App for any commercial purpose without our explicit prior written consent.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection, processing, and storage of your information as described in our Privacy Policy. Specifically, text prompts you enter are processed by third-party AI service providers to generate the requested images.
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App.
We reserve the right to modify or update this EULA at any time. Your continued use of the App after any such changes constitutes your acceptance of the new EULA.
