App Name: AI Book Cover Art Design Maker

This End-User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and the developer ("Developer," "we," "us," or "our") governing your use of the "AI Book Cover Art Design Maker" mobile application ("App").
By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you must immediately delete the App and discontinue its use.
1. ACKNOWLEDGMENT
You acknowledge that this EULA is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and the content thereof. Your use of the App is subject to the Apple Media Services Terms and Conditions (the "Usage Rules").
2. SCOPE OF LICENSE
The Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with the terms of this EULA on any Apple-branded products that you own or control, and as permitted by the Usage Rules.
3. AI SERVICES & CONTENT GENERATION
The App provides AI-powered book cover design generation services.
Third-Party AI Services: You acknowledge that the App utilizes third-party Artificial Intelligence (AI) services to generate images and text.
No Guarantees: AI-generated content is provided "as is." We do not guarantee the accuracy, aesthetic perfection, or physical feasibility of the generated book cover art.
User Responsibility: You are solely responsible for the text prompts you input into the App. You agree not to input prompts that are illegal, offensive, explicit, harassing, or that infringe upon the intellectual property rights (including copyrights and trademarks) of any third party.
Copyright & Ownership: The Developer claims no copyright over the final images generated by the AI on your device. You are free to use the generated book covers for your personal or commercial publishing projects (such as Wattpad, Kindle, or physical books), provided your original prompts comply with this EULA and applicable laws.
4. PREMIUM SUBSCRIPTION AND BILLING
The App operates on a strictly premium, subscription-based model. Access to the App's core functionality requires an active, paid subscription.
Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, identifying the cost of the renewal.
Cancellation: You can manage and cancel your subscriptions by navigating to your App Store Account Settings after purchase. The Developer cannot cancel subscriptions on your behalf.
No Refunds: All payments made through the App Store are strictly subject to Apple’s refund policies. The Developer does not have the ability to process refunds.
5. INTELLECTUAL PROPERTY RIGHTS
You and the Developer acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
6. PRIVACY AND DATA USAGE
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your data as outlined in the Privacy Policy. Specifically, you acknowledge that your text prompts are sent to third-party AI providers solely for the purpose of generating your requested designs. We do not sell your personal data.
7. MAINTENANCE AND SUPPORT
The Developer is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
8. WARRANTY DISCLAIMER
The App is provided to you "as is" and "as available," with all faults and without warranty of any kind. The Developer disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
9. PRODUCT CLAIMS
You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims of the User or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
10. LEGAL COMPLIANCE
You represent and warrant that: (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.
11. THIRD-PARTY BENEFICIARY
You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
