Terms of Service

1. Introduction
Welcome to AI Pet ("App", "we", "us", "our"). These Terms of Service ("Terms") govern your ("you", "user") use of our mobile application, website, and related services (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms.
If you do not agree with these Terms, do not use the Services.
2. Age Requirement
You must be at least 13 years old to use this App. By using the Services, you represent and warrant that you are 13 or older.
3. Use of the App
3.1 License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
3.2 Restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code.
- Use the Services for illegal, harmful, offensive, or abusive activities.
- Violate any applicable laws or regulations.
- Interfere with the operation or security of the Services.
- Upload images that contain inappropriate, offensive, or illegal content.
- Use generated images to harass, defame, or mislead others.
4. Image Generation & User Content
4.1 User Content
You may upload photos and images ("User Content") to the App for the purpose of generating AI-styled pet portraits. You retain ownership of your User Content.
By uploading images:
- You grant us a worldwide, royalty-free license to process your User Content solely for the purpose of providing the Services.
- You confirm that you have the rights to upload the photo and transform it using the App.
- You confirm that you have the consent of any individuals appearing in the uploaded photos.
4.2 AI Processing
The App uses artificial intelligence (Google Gemini) to generate stylized portraits based on User Content. The results are AI-generated artistic interpretations intended for creative fun and entertainment purposes only.
4.3 Image Storage
Uploaded images are temporarily processed on our servers and are not stored permanently. Generated images are returned directly to your device. We do not retain copies of your uploaded or generated images after processing is complete.
5. Subscriptions & Payments
5.1 Subscription Plans
The App offers subscription plans (weekly, annual) that grant access to generation credits and premium features.
All payments are processed through the Apple App Store. We do not collect or store your payment information.
5.2 Billing
By purchasing a subscription, you authorize in-app purchases through Apple. Subscription renews automatically unless canceled at least 24 hours before the end of the current period.
5.3 Free Trial
The App may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
5.4 Coins System
Subscriptions include a set number of generation credits ("coins"). Coins are valid only during your active subscription period. Unused coins do not carry over and are reset upon subscription renewal.
6. Privacy
Use of the Services is also governed by our Privacy Policy, which is incorporated by reference. The Privacy Policy explains what information we collect, how it is used, and how it is shared.
7. Intellectual Property
7.1 Our Rights
All content provided in the App (excluding User Content), including but not limited to art style prompts, user interface design, and branding, is owned by us or our licensors and is protected by applicable intellectual property laws.
7.2 Your Rights
You retain all rights in your User Content. Generated images are yours to use for personal purposes, including sharing on social media and printing. You may not sell AI-generated images as standalone products or claim them as original artwork.
8. Disclaimers
The Services are provided "as is" without warranty of any kind, whether express or implied.
We do not guarantee that:
- The App will meet your requirements.
- The App will be uninterrupted, secure, or error-free.
- AI-generated results will be accurate, satisfactory, or free of artifacts.
Your use of the App is at your sole risk.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
- Direct, indirect, incidental, special, consequential, or punitive damages.
- Any loss of data, profits, or business interruption.
- Any claim arising out of your use of generated images.
10. Indemnification
You agree to indemnify and hold harmless our company, affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of:
- Your use or misuse of the Services.
- Your violation of these Terms.
- Your infringement of any third party's rights.
11. Termination
We may suspend or terminate your access to the App at any time without notice, for any reason, including your violation of these Terms.
Upon termination, all licenses granted to you will automatically end.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Poland.
Any dispute relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.
13. Changes to Terms
We may update these Terms from time to time. When this happens, we will revise the "Effective Date" above and notify you within the App or via email. Continued use of the Services after updates means you accept the revised Terms.
