This End User License Agreement ("Agreement") is a legal agreement between you ("User") and AI Nail Art ("Company", "we", "us", or "our") concerning your access to and use of the AI Nail Art mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the App.
Subject to the terms of this Agreement, Company grants you a limited, non-exclusive, non-transferable, revocable license to: (a) download, install, and use the App for your personal, non-commercial use on a mobile device owned or otherwise controlled by you; and (b) access and use the content and services made available in or through the App.
The App utilizes artificial intelligence ("AI") to generate images based on your text prompts and selected parameters ("Generated Content").
Ownership: You retain ownership of the prompts you input. You are granted a license to use the Generated Content for personal, non-commercial purposes.
No Guarantee: You acknowledge that AI generation is experimental and may produce unpredictable results. The Company does not guarantee the quality, accuracy, or suitability of any Generated Content.
Prohibited Content: You agree not to use the App to generate content that is: illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or hateful.
Some features of the App may require a paid subscription or the purchase of credits ("Tokens").
subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
Account will be charged for renewal within 24-hours prior to the end of the current period.
You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
You agree not to, and you will not permit others to: (a) License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party. (b) Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App. (c) Use the App for any illegal purpose or in violation of any local, state, national, or international law.
This Agreement is effective until terminated by you or the Company. Your rights under this Agreement will terminate automatically without notice from the Company if you fail to comply with any term(s) of this Agreement. Upon termination, you shall cease all use of the App and delete all copies of the App from your mobile device.
THE APP IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, LOSS OF PRIVACY ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APP).

If you downloaded the App from the Apple App Store, the following terms also apply:
Acknowledgement: This Agreement is concluded between you and the Company only, and not with Apple, and the Company, not Apple, is solely responsible for the App and the content thereof.
Maintenance and Support: The Company is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranty: The Company is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Product Claims: You acknowledge that the Company, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of that App.
Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using the App.
Third Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third party beneficiary thereof.
