This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and the developer of AI Design: Furniture Maker (“Developer”, “we”, or “us”). By downloading or using the standard Apple applications or our App, you agree to comply with and be bound by the terms of this Agreement. If you do not agree to these terms, do not download or use the App.
1. Acknowledgment You and we acknowledge that this Agreement is concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and the content thereof. This EULA may not provide usage rules that conflict with the Apple Media Services Terms and Conditions.
2. Scope of License The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any Apple-branded product that you do not own or control.
3. Artificial Intelligence and Content Generation The App utilizes Artificial Intelligence (AI) to generate furniture designs, interior layouts, and concepts based on text inputs. a. No Guaranteed Results: Due to the nature of AI, the generated images may vary in quality, accuracy, and realism. We do not guarantee that every generated image will perfectly match your exact expectations. b. User Responsibility: You are solely responsible for the prompts you input. You must not use the App to generate illegal, offensive, harmful, or copyrighted materials. c. Intellectual Property: You are granted a personal, worldwide, royalty-free, non-exclusive license to use the images generated by you within the App for personal or commercial interior design inspiration, provided it complies with applicable laws.
4. Subscriptions and Payments (Premium Features) Subscribing to "AI Furniture Design Pro" unlocks unlimited AI generations and premium features within the App. a. Payment: Payment will be charged to your Apple ID account at the confirmation of purchase. b. Auto-Renewal: Your subscription automatically renews unless canceled at least 24 hours before the end of the current period. c. Cancellation: You can manage and cancel your subscriptions by going to your App Store account settings after purchase. Cancellation takes effect at the end of the current billing cycle.
5. Maintenance and Support We are solely responsible for providing any maintenance and support services with respect to the App. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
6. Warranty The App is provided "as is" and "as available". We disclaim all warranties concerning the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
7. Product Claims You and we acknowledge that we, not Apple, are responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
8. Intellectual Property Rights You and we acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
9. Legal Compliance You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
10. Third-Party Terms of Agreement You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).
11. Third-Party Beneficiary You and we acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
