AI Backyard Design - Garden AI is an artificial intelligence-powered application that allows users to upload images of outdoor spaces and generate landscaping, garden, backyard, and outdoor design concepts.
The App provides visual suggestions and inspiration only and does not constitute professional landscaping, engineering, architectural, construction, or horticultural advice.
You must be at least 4 years old to use the App.
By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
You may upload photographs and images to use the App's AI-powered design features.
You retain ownership of any content you upload.
By submitting content to the App, you grant us a limited, non-exclusive, worldwide license to process, analyze, store temporarily, and display such content solely for the purpose of providing and improving the Service.
You represent and warrant that:
You own or have permission to use the uploaded content.
Your content does not violate any law or third-party rights.
Your content does not contain illegal, harmful, or offensive material.
Designs, renderings, recommendations, and other outputs generated by the App are produced automatically using artificial intelligence.
AI-generated results may not always be accurate, complete, practical, or suitable for real-world implementation.
Users are solely responsible for evaluating and verifying any design suggestions before acting upon them.
We are not responsible for decisions made based on AI-generated content.
Certain features of the App may require a paid subscription.
Subscriptions are billed through your Apple App Store account.
Payment will be charged to your Apple ID upon confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel subscriptions through your Apple Account Settings.
All billing and payment processing are handled by Apple.
You agree not to:
Use the App for unlawful purposes.
Upload content that infringes intellectual property rights.
Attempt to reverse engineer or interfere with the App.
Use automated systems to access the Service.
Upload malicious code, viruses, or harmful content.
Misuse AI-generated content in a way that violates applicable laws.
The App, including its software, design, branding, logos, graphics, and underlying technology, is owned by us and protected by applicable intellectual property laws.
Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the App.
The App is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.
We do not guarantee that:
The App will be error-free.
The App will be continuously available.
AI-generated results will meet your expectations.
Generated designs will be suitable for construction or implementation.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability for any claim relating to the App shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim.
We reserve the right to suspend or terminate access to the App at any time if we believe a user has violated these Terms or applicable laws.
Your use of the App is also governed by our Privacy Policy, which explains how information is collected, used, and protected.
We may update these Terms from time to time.
Updated versions will become effective upon posting within the App or on the website associated with the Service.
Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction where the Service operator is established, without regard to conflict of law principles.
