Guidelines for Work and Collaboration: These are the specific guidelines regarding prohibited collaborations and partnerships. All other activities for cooperation and participation are welcome, and may God open for us and you all goodness through the purest lawful means.
The origin of all business and transactions is permissibility (Halal) and lawfulness, unless this code or the evidence of Islamic Sharia explicitly prohibits it.
This policy applies to all commercial activities, financial transactions, services, products, and cooperative projects conducted or promoted by us as an individual, company, or institution.
The participation in, promotion of, or dealing with the following is strictly prohibited in any form:
Violation of Sharia: Anything that violates any text or the spirit of Islamic Sharia in all its branches.
Public and Private Harm:
Anything that is inherently harmful to health or leads to confirmed or predominant health damage.
Anything that results in unjustifiable harm to the environment or public or private property.
Injustice, Aggression, and Occupation:
Anything that supports oppression or aids an oppressive entity or entities.
Anything that is directly affiliated with the occupying entity or fundamentally supports it.
Impurities and Vices (Najāsat and Khabā'ith): Anything that is inherently impure (Najis) or results in impurity in the final work or product.
Unfair Competition and Intellectual Property Fraud: Anything related to product piracy, copying protected software or content without permission, or violating legally recognized and Sharia-protected intellectual property rights.
Deception and Electronic Fraud: Dealing with any activities or services that aim at financial fraud, phishing for personal data, spreading malicious software, or creating false identities for the purpose of cheating or harming others.
Dealing in the following items is prohibited based on Sharia or health grounds:
Dead Meat, Blood, and Prohibited Items (Maytah and Dam):
Dead animals (Maytah) of all types (e.g., animals that died naturally or were not slaughtered according to Sharia), excluding sea creatures (fish and similar).
Blood and foods or preparations composed of shed blood or coagulated blood (excluding the liver and spleen of Halal-slaughtered animals).
Pork, carrion, animals that feed predominantly on filth (Jallalah), and non-Halal slaughtered meat.
Intoxicants and Narcotics (Muskirat): Anything that impairs the mind, including alcoholic beverages, narcotic drugs, and intoxicating or weakening chemical compounds.
Harmful Beverages:
All types of carbonated soft drinks due to their health detriment and consumer deception.
Energy drinks or any products that embody the principle of "selling illusion" and false exaggeration of benefits.
Dealing in all financial transactions that involve the following is prohibited:
Riba (Usury) and Riba-based Loans: Anything directly or indirectly related to Riba-based loans and Riba in all its forms (such as increasing the loan amount, trading currencies without spot exchange/hand-to-hand delivery, increasing loan repayment periods for a fee, or imposing Riba-based penalties for delayed payment).
Gambling and Mayṣir: All forms of gambling, lotteries, betting, and competitions based purely on chance.
Excessive Uncertainty (Gharar Fāhish & Jahalah): Selling, purchasing, or promoting any product or service that involves excessive uncertainty (Gharar) and excessive ignorance (Jahalah) leading to dispute, or selling what one does not possess (unless it is a valid Salam or Istisna' contract with its specific Sharia conditions).
Selling Non-existent Goods (Bay' al-Ma'dum): Selling goods or services that are non-existent or not owned by the contracting party at the time of the contract.
Ambiguity in Price or Subject Matter (Jahalah): Failure to clearly define the final price or the essential specifications of the product in a way that eliminates ignorance.
High-Risk Speculation: Dealing in financial or investment contracts that involve extremely high and vague risk, where the contract is not based on a real asset or clear guarantees.
Contracting Without Viewing or Accurate Description: Selling goods that have not been seen and were not accurately described enough to eliminate ignorance, if a "right of inspection" (Khiyār al-Ru'yah) is not granted to the buyer.
Network Marketing, Pyramid Schemes, and Unfair Gains: Anything related to promoting or participating in Pyramid Schemes or Multi-Level Marketing (MLM) systems where profit is fundamentally dependent on recruiting new members (joining fees or membership fees) rather than selling the actual product, or any gains that rely on the losses of others unfairly (Zero-Sum Games).
Fraud and False Promises of Quick Profit: Anything related to promoting or participating in programs, services, or products that rely on explicit fraud or unrealistic and misleading promises of quick profit or "getting rich quickly" without real effort or a clear economic and rational basis.
Trading and Speculation in Digital Currencies and Crypto Assets: Anything related to trading or speculating in encrypted digital currencies (Cryptocurrencies) or digital assets that do not represent a real physical asset or a defined Sharia backing. This is prohibited because it involves excessive uncertainty (Gharar Fāhish) and the risk of falling into Riba and Mayṣir.
Exception: It is permitted to use them strictly as a means of payment for an existing and legitimate good or service after verifying its Sharia compliance and value.
Conventional (Commercial) Insurance: Dealing with Conventional (Commercial) Insurance services (wholly or partially) is prohibited, as it contains elements of Gharar, Riba, and Mayṣir.
The Prohibited (Commercial Insurance): It is a compensatory contract (bilateral contract) aimed at generating commercial profit for shareholders, and it contains elements of Gharar (uncertainty/speculation), Riba (usury/interest), and Maysir (gambling). This often includes life insurance policies based on usurious interest.
The Exception (Takaful / Cooperative Insurance): It is a donation and cooperative contract aimed at distributing risks among subscribers (policyholders), not making a profit from their contributions. It is subject to the supervision of a Sharia board. Dealing is permitted only in Takaful or cooperative property insurance that complies with the aforementioned Sharia regulations.
Dealing with or promoting content or activities that lead to the following is prohibited:
Spreading Immorality, Vice, and Illicit Mixing:
Anything that results in the spread of obscenity, vice, or pornography in all its forms.
Anything that encourages or facilitates illicit mixing between men and women (e.g., dating apps, unregulated mixed voice chat rooms, or live broadcasts not subject to Sharia oversight).
Dress Code and Awrah (Intimate Parts):
Women's Clothing: Any promotional materials, products, or services related to women's clothing that violate Sharia (immodest clothing, sheer, revealing, or describing the body).
Men's Clothing: All promotional materials or products related to men's clothing that violate the Sharia limits of a man's modesty, including anything that describes the severe Awrah, resembles the dress of women, non-Muslims, or the openly immoral, or involves prohibited extravagance and boasting.
Anything Violating Islamic Sharia (Creed): Anything containing symbols of other beliefs, including symbols of the People of the Book, disbelievers, pagans, symbols of polytheism (Shirk), or any ideas contravening the clear tenets of Islamic Sharia or pure Monotheism (Tawḥīd al-Khāliṣ), or participating in doctrinal celebrations or sacred holidays—other than those of Islamic Sharia—or offering congratulations for beliefs that are contrary to or different from Islamic Sharia.
Prohibited Photography and Celebrations: Projects related to photographing women (showing their adornment), mixed weddings, or mixed graduation parties.
Music and Musical Instruments (Ma'āzif): Anything directly related to the promotion of musical instruments, music, and singing (teaching, celebrations, festivals, or gatherings where music is a primary activity).
Women's Sports: Anything related to women's sports or female gym activities that do not adhere to Sharia controls, or the photography of their events or the promotion of their training activities.
Divination and False Clairvoyance: Anything related to the promotion of divination (Kihānah), fortune-telling, or any services claiming knowledge of the unseen or influencing fate through illicit means.
Questioning Foundational Principles (Thawābit): Any content that leads to questioning the definitive facts of the Islamic religion, religious truths, the Prophets, the Companions, or the Mothers of the Believers, or the recognized scholars and figures of the Ummah.
The use or participation in the following commercial methods is prohibited:
Cheating and Concealing Defects (Ghesh): Cheating in goods or services, concealing their essential defects from the buyer, or false and deceptive marketing overstatements/exaggerations.
Short-Changing (Tatfeef): Tampering with scales, measures, and counts (fraud in weight, digital or physical measurement, or the attributes and specifications of services and products).
Monopoly and Price Manipulation (Ihtikār): Monopolizing essential goods and foodstuffs to raise their prices and harm the public.
Governing Principle: We believe that sustainable development and the true empowerment of individuals and communities are achieved through added value, production, and transparent commercial exchange. Accordingly, we have established the following controls:
The participation in, promotion of, or provision of technical or marketing services for any activities related to collecting financial or in-kind donations, or dealing with associations and institutions whose primary activity is based on soliciting and begging for donations, is strictly prohibited, based on:
Avoiding Financial Suspicions: Distancing from any activity with ambiguous funding sources or spending methods to ensure the purity of transactions and keeping them free from any legal or Sharia loopholes.
Preventing the Harm of "Selling Illusions": Being cautious of programs that exploit emotions without providing a tangible product or service of real economic value, in order to prevent falling into unrealistic promises.
Absolving Responsibility (Ibrā' al-Dhimmah): Clearing our conscience due to the difficulty of verifying the final destinations of donations according to strict Sharia controls.
Empowerment, Not Sponsorship: We support initiatives aimed at "training for employment," "supporting startup projects," or "technical empowerment," provided the dealing is professional under clear commercial contracts not dependent on soliciting donations.
Transparency and Accountability: Any cooperating NPO must be officially registered with published, audited financial statements to ensure our services do not overlap with donation collection.
Brand Independence: The use of our name or visual identity in any promotional campaigns aimed at requesting financial support is strictly prohibited, and our public appearance shall be limited strictly to educational and developmental aspects.
We are committed to directing our efforts to support projects based on real commercial exchange, production, and services that add direct social value, away from the "sponsorship economy," in order to ensure building a productive society that relies on sustainable manual and intellectual labor.
Principle: Commitment to technical honesty and administrative clarity to ensure the quality of outputs and eliminate ambiguity (Jahalah) from contracts.
AI and Data Ethics: We commit not to develop or program systems aimed at falsifying facts (Deepfakes), psychological manipulation of consumers, or violating personal data privacy through illegal means. Technology is a tool for building and empowerment, not for deception.
Clarity of Scope of Work (Eliminating Jahalah): A specific Scope of Work (SOW) detailing the tasks, timeline, and financial compensation accurately is a prerequisite in all partnerships; this prevents disputes and clears our conscience from Gharar and Jahalah in contracts.
Limitation of Liability (Disclaimer of Misuse): Our professional and Sharia responsibility ends upon the delivery of the agreed-upon systems or services according to the mentioned standards. We do not bear any legal or Sharia responsibility for the client's misuse of these tools for purposes that violate this code post-delivery.
Transparency of Commissions and Professional Loyalty: In the event of affiliate marketing relationships with programs or tools recommended to the client, we commit to full disclosure. We affirm that tool selection is based on technical efficiency and the project's best interest first, not on the commission value.
Partnership is established in all matters other than the above through detailed, agreed-upon contracts to guarantee the special rights of all contracting parties, subject to mutual agreement, God willing.
