Moga – Terms of Use

These Terms of Use (“Terms”) govern your use of the Moga mobile application (“App” or “Platform”), operated by Amar Talwar (“Moga”, “we”, “us”, or “our”).

By accessing or using Moga, you agree to these Terms and our [Privacy Policy]. Please read them carefully. If you do not agree, you must not use the App.

Our Platform and these Terms are intended to comply with Indian laws, including the Indian Penal Code, 1860 and the Information Technology Act, 2000 (as amended). If you access Moga from outside India, you are responsible for complying with local laws.

Updates to Terms and App

Moga is always evolving. We may update services, add or remove features, or change these Terms at any time. Major updates will be communicated, but you should review this page regularly. If a change requires your consent, we will seek it explicitly.

Eligibility – Who Can Use Moga

• You must be at least 18 years old to use Moga.
  
  

• You may only use Moga if you can form a legally binding contract under Indian law.
  
  

• If you represent an organization, you confirm you are authorized to accept these Terms for that entity.
  
  

Using Moga

Moga connects you with a vibrant LGBTQ+ community. To use the App, you must register with a valid mobile number and verify it via OTP.

We will never access your device’s personal files or information without your explicit permission.

Subscriptions, Payments, and Cancellations

• Subscription Plans: Moga offers premium subscriptions billed monthly (30 days), quarterly (120 days), or annually (365 days).
  
  

• Google Play Billing (Android): For Android users, subscriptions and cancellations are managed through Google Play. You may cancel anytime in your Google Play account settings.
  
  

• Apple Billing (iOS): For iOS users, subscriptions are managed by Apple App Store and auto-renew unless cancelled at least 24 hours before renewal.
  
  

• UPI Autopay (India): Subscriptions may auto-renew via UPI. You may opt out in your UPI settings.
  
  

• Recurring Payments: By subscribing, you agree to recurring charges unless you cancel before the renewal date.
  
  

• No Refunds: All payments are non-refundable. If you cancel, you will retain access until the end of your current billing period.
  
  

• In-App Purchases: Moga offers in-app purchases. Pricing and terms are displayed within the App and the relevant app store.
  
  

Privacy

We collect and process certain personal data (e.g., your name, age, and phone number) to provide and improve our services. All information is governed by our [Privacy Policy].

Your Responsibilities

To keep Moga safe and welcoming, you agree to:

• Be truthful: Provide accurate name, age, and phone number.
  
  

• Device safety: Protect your account and device; do not share accounts or create multiple accounts with the same number.
  
  

• Content guidelines: Do not post or share illegal, hateful, obscene, harmful, or abusive content.
  
  

• Lawful use: Do not use Moga for fraud, harassment, or any unlawful activities.
  
  

We may remove content, suspend, or terminate accounts that violate these responsibilities.

Content Ownership and Rights

• You retain ownership of the content you create and share.
  
  

• By posting on Moga, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for operating and improving the App.
  
  

• We do not claim ownership of your uploads, but we may remove content that violates these Terms or the law.
  
  

• We are not responsible for user-to-user interactions, transactions, or disputes.
  
  

Platform Safety and Integrity

You must not:

• Hack, tamper with, or disrupt Moga’s systems.
  
  

• Upload or spread malware, viruses, bots, or malicious code.
  
  

• Scrape or misuse user data.
  
  

Violations may result in suspension, permanent removal, or legal action.

Automatic Updates and Permissions

Moga may require updates to function properly. By installing, you consent to receive automatic updates.

Limitation of Liability

Moga is provided “as is”, without warranties of any kind. To the fullest extent allowed by law:

• We are not liable for indirect, incidental, or consequential damages.
  
  

• Our liability, if any, is limited to the subscription fees paid in the month prior to your claim.
  
  

Indemnification

You agree to indemnify and hold harmless Moga, its developer, and affiliates against any claims, damages, or losses resulting from your use of the App or violation of these Terms.

Feedback and Suggestions

We welcome feedback and ideas, but by submitting them, you agree we may use them without compensation or confidentiality obligations.

Dispute Resolution

• Governing Law: These Terms are governed by the laws of India.
  
  

• Jurisdiction: All disputes are subject to the exclusive jurisdiction of the courts in Goa, India.
