Tamil Nadu Assembly on Thursday unanimously passed a bill to provide 7.5 per cent reservation in admission to professional courses like engineering, agriculture, and law for students from government schools.

The legislation is modelled on the lines of law that the previous AIADMK government passed by providing 7.5 per cent reservation to students from government schools in admissions to medical and dental colleges.

Explaining in detail, Stalin said of 8.5 lakh students who passed out of plus-two in 2019-2020, 3.45 lakh are from government schools. Of the students who joined the prestigious Anna University in various engineering streams in the 2020-2021 academic year, only 0.83 per cent were from government schools.

He said the government provided 7.5 per cent reservation after carefully considering the recommendations of the Justice D Murugesan Committee which suggested that reservations up to 10 per cent can be accorded to students from government colleges.

ON Thursday, the Madras High Court upheld the validity of 7.5 per cent reservation provided by the Tamil Nadu Government for students from government schools for admission to medical courses in the case of Ms. Preethika C (Minor) vs. State of Tamil Nadu & Ors.

The High Court directed the government to review the quota in five years and take steps to improve the standard of education imparted in government schools, so that the reservation may not further be extended beyond a period of five years.

The petitioners challenged the Tamil Nadu Admission to Undergraduate Courses in Medicine, Dentistry, Indian Medicine and Homeopathy on preferential basis to students of Government Schools Act, 2020 as wholly unconstitutional and void ab initio for having provided 7.5 per cent preference/reservation to the students of government schools in admission to undergraduate medical/dental courses.

(ii) When a common entrance test is provided for all the students, giving preference to the students of government schools, it amounts to discrimination and therefore, violates Article 14 of the Constitution;

The state government, however, claimed that the students of government schools were socially, educationally and economically backward and therefore, the state government, finding the need to provide them equal opportunity to establish a level playing field, enacted the impugned Act, providing them 7.5 per cent reservation, which is permissible under Article 15(4) and Article 15(5) read with Article 46 of the Constitution.

The High Court held that the principles of just expectation cannot be invoked when public interest demands a change of policy, which cannot be barred by invoking promissory estoppel. The High Court held that the impugned enactment only makes horizontal reservation across the various categories in respect of state government school students, that too by following the inter se NEET [National Eligibility cum Entrance Test] merit among them.

The High Court noted that the average annual income of the parents of a government school student is Rs 46,686, while that of a Central Board for Secondary Education student is Rs 4,69,413, and of Indian Certificate of Secondary Education student is 4,77,263. Besides, it noted that 83 per cent of fathers and 65 per cent of mothers of government school students are daily wage labourers.

Tamil Nadu on Thursday introduced a Bill in the assembly to provide 7.5% reservation to government school students for admissions in professional courses. These include engineering, law, veterinary sciences, fisheries and agricultural courses in universities, private colleges, government, and government-aided colleges.

The commission recommended not less than 10% of seats to be set apart for government students in professional courses without affecting the existing reservation of the state. This would apply to students who have studied from class 6 to 12 in state government schools.

Last year, the AIADMK-led government introduced a 7.5% horizontal reservation to government school students who cleared the National Eligibility cum Entrance Test (NEET) for admissions in undergraduate medical colleges.

From admission year 2020, the Tamil Nadu state government implemented 7.5 percent horizontal reservation for Tamil Nadu students who studied in government schools. Under each reservation category, 7.5% seats are reserved for govt school students. This quota is applicable for state government quota in private medical colleges as well.

If candidates studied from 6th to 12th in Tamil Nadu government schools, they are eligible to claim 7.5 percent reservation. Those candidates who claim these seats, should submit bonafide certificate signed by the head of the institution last studied and the chief educational officer of the district covering all govt schools in which the candidate studied.

According to the report, the decision regarding the 7.5% reservation for government school students in professional courses was announced in a cabinet meeting held in August. He also informed the cabinet that legislation in this regard would be brought in the assembly.

The All India Anna Dravida Munnetra Kazhagam-led state government had announced the 7.5% quota for the government school students in October 2020. The government had argued that the reservation is meant to bring equality between students of government and private schools.

The governor's nod came a day after the AIADMK government took the executive route and issued an order for implementing the quota from the current 2020-21 academic year itself, amid pressure from political parties for its immediate enforcement. "This is to inform the people of Tamil Nadu that the honourable Governor has given his assent to the bill," the Raj Bhavan said, in an announcement that came as a surprise since Purohit has only days ago said he would take a decision in 3-4 weeks. The development saw both the ruling AIADMK and the opposition DMK, which last week staged a protest for immediate assent, seeking to claim credit for the governor's approval.

A release from the Raj Bhavan said Purohit sought legal opinion from the Solicitor General of India on September 26 and it was received on October 29. "As soon as the opinion was received, honourable Governor has given assent to the bill," it said. The statement that the assent came as soon as the opinion was received assumes significance as the issue had taken a political overtone after DMK and others questioned the 'delay' and attacked the state government for "not exerting" pressure to get it cleared. As per the bill, 7.5 per cent of seats shall be set apart on a preferential basis to government school students qualifying in NEET, in admissions to MBBS, BDS, BSMS, BAMS, BUMS, and BHMS. With the state assembly elections due during April-May next year, the NEET related issue had once again brought the two major political parties into a straight fight with the DMK attacking the ruling party and the latter accusing it of shedding crocodile tears.

The government sought expeditious clearance of the bill since the quota should be implemented from the current year and a group of Ministers too had called on Purohit at the Raj Bhavan recently, amid calls by most political parties for implementing it from this year. BJP Tamil Nadu unit chief L Murugan had said Purohit should clear the bill immediately, noting the "time taken by him (to examine it) was enough. The Viduthalai Chiruthaigal Katchi had alleged the BJP- led Centre was not interested in providing reservation to students from poor background.

According to the data from the Education Ministry, 65.2 per cent, that is 113 million of total students in the country, study in government schools, either run by the Centre, state or local governments. Presently, Tamil Nadu's literacy rate is above 80 per cent, which is better than the national average.
