NOAA Fisheries announced proposed changes to the North Atlantic right whale (Eubalaena glacialis) vessel speed rule to further reduce the likelihood of mortalities and serious injuries to endangered right whales from vessel collisions. NOAA Fisheries accepted public comment on the proposed rule until October 31, 2022. The public comment period is now closed. Comments are reviewed and generally posted in the order they were received and may be viewed here.

Most vessels 65 feet or longer must travel at 10 knots or less in certain locations (called Seasonal Management Areas) along the U.S. East Coast at certain times of the year. This mandatory regulation reduces the likelihood of deaths and serious injuries to endangered North Atlantic right whales that result from collisions with vessels. Vessels of all sizes can strike a whale, so we encourage vessels less than 65 feet long to help protect right whales by slowing to 10 knots or less within these areas as well.

Separate from the federal speed regulations in the Cape Cod Bay SMA, Massachusetts state law requires most vessels less than 65 feet to travel at 10 knots or less in the Cape Cod Bay Vessel Speed Restriction Area from March 1 to April 30. Speed restrictions may be extended by the Massachusetts Division of Marine Fisheries (DMF) if right whales continue to remain present in Cape Cod Bay. Right Whale Slow Zones and Dynamic Management Areas (DMAs) are voluntary programs NOAA Fisheries uses to notify vessel operators to slow down to avoid right whales. Maintaining speeds of 10 knots or less can help protect right whales from vessel collisions. Under these programs, NOAA Fisheries provides maps and coordinates to vessel operators indicating areas where right whales have been detected. For a period of 15 days after a whale is detected, mariners are encouraged to avoid these areas or reduce speeds to 10 knots or less while transiting through these areas.

NOAA Fisheries establishes DMAs based on visual sightings of three or more right whales within a discrete area. Right Whale Slow Zones are based on both visual and acoustic triggers. They are identical to DMAs when triggered by right whale visual sightings.

For ships weighing 300 gross tons or more, a voluntary seasonal Area To Be Avoided (ATBA) is in effect each year from April 1 to July 31, when right whales face their highest risk of ship strikes in this area.

New York Vehicle & Traffic Law  1180-E authorizes the establishment of an automated work zone speed enforcement demonstration program. The NYSDOT and the NYSTA may impose a fine on the registered owner of a vehicle speeding in a work zone on a controlled access highway.

NYSDOT and NYSTA will employ automated speed enforcement units that detect unlawful speeding in a work zone at specified construction and maintenance work sites during specified hours of operation. Designed to comply with state and local laws, the technology also includes all hardware, software, and services required to compile the evidence package to submit to the courts.

The goal of the program is to reduce speeds, improve driver behavior, save worker and traveler lives in work zones, complement existing work zone enforcement by the New York State Police, and promote work zone safety.

When forklifts circulate at high speeds in workplace areas where pedestrians or forklifts work, accidents can happen and/or damage the building. The ShockWatch Low Speed Area (LSA) system places a limit on the speed at which a forklift circulates through different areas of the warehouse on forklifts that have speed-limiting capability. This system is designed to reduce the speed of the forklifts in areas with pedestrian activity or where other forklifts are working. The function of the Low Speed Area system is to prevent accidents that result from forklifts speeding in areas shared by forklifts and working personnel.

The LSA system allows a site to be divided into two different speed zones to limit vehicle speed where there is interaction with pedestrians or vehicles. The system uses a panel of reflective coded bands located over doorways or hanging from the ceiling in areas where a speed change needs to take place. When the forklift drives underneath the panel, the sensors decode the change in zone and proceed to activate the relay corresponding to that zone either Slow or Fast.

How does Low Speed Area work?

The forklift must have on board speed limiting capability.

The LSA kit is installed on every forklift.

An optical sensor recognizes if the vehicle is in high or low speed area when it passes under a wall or roof mounted reflector strip. The reflector strip defines the area as either slow or fast and triggers the unit and forklift accordingly.

Neighborhood Slow Zones are a community-based program that reduces the speed limit from 25 mph to 20 mph and adds safety measures within a select area in order to change driver behavior. The ultimate goal of the Neighborhood Slow Zone program is to lower the incidence and severity of crashes. Slow Zones also seek to enhance quality of life by reducing cut-through traffic and traffic noise in residential neighborhoods.

Neighborhood Slow Zones are established in small, self-contained areas that consist primarily of local streets. Gateways announce the presence of a Slow Zone. A gateway is a set of signs and markings at an intersection to alert drivers to the reduced speed limit.

The zone itself is a self-enforcing, reduced-speed area with speed bumps, markings and other traffic calming treatments. Slow Zones are implemented in areas with low traffic volumes and minimal through traffic, where reducing the speed limit will not cause traffic congestion.
