Introduction to Malaysian Legal System

Course Synopsis

Malaysian legal system is unique. There are three streams of legal systems consisting of secular, religious, and customary law that operate within their assigned spheres. In this course, participants will be introduced to the foundation of the legal system. The discussion includes the historical development of the legal system, the sources of law, as well as the current organs of the government and administration of justice.

DR. NAJWA BINTI ROSLI

Dr. Najwa Rosli is a lecturer at the Faculty of Law, Universiti Malaya. She graduated with LL.B (Honours) from the International Islamic University Malaysia in 2011. After her admission as an Advocate & Solicitor of the High Court of Malaya in 2012, she furthered her studies at the University of Manchester, United Kingdom, and obtained LLM in International Business and Commercial Law in 2013. Before joining the Faculty of Law in 2018, she practiced law and was a member of the Malaysian Bar. Since 2014, she actively involved in various research projects in collaboration with PLANMalaysia on the enforcement of Town Planning law. She recently graduated with Ph.D. from Universiti Malaya. Her main research interests include Town Planning Enforcement Law, Land and Conveyancing matters, as well as Child Law and Protection. Associate Professor Zuraida Rastam Shahrom

Prior to her career as an academician Associate Professor, Zuraida Rastam Shahrom was a Magistrate in the Klang Sessions and Magistrate court where she presided over civil and criminal matters. She also presided over juvenile matters in the Court for Children. After serving as a Magistrate for 7 years she was then promoted to the position of Senior Federal Counsel with the Attorney General's Chambers of Malaysia. In the Attorney General's Chambers of Malaysia, she headed the Human Rights and International Organisations Unit which provided legal advisory services to the Government of Malaysia on various legal issues in general and specifically on issues relating to human rights and international organisations.

During her period of private practice, she handled civil litigation cases. She was the Head of Advisory in the Securities Commission of Malaysia handling various enforcement actions in the form of administrative actions against capital market intermediaries that breached provisions of the securities law. She joined Universiti Malaya in 2017 as an academician in the Faculty of Law. She currently teaches Insolvency Law, Company Law and Advocacy Skills. Her research interest is in the area of sustainable banking aad clinical legal education.
