PRIVACY POLICY

END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legally binding contract between you ("User" or "You") and Dellways Logistics Pvt Ltd ("dellways Logistics" or "We") governing the use of the Speedy Logistics hyperlocal delivery application ("Application").

1. ACCEPTANCE OF TERMS

By installing, accessing, or using the Dellways Logistics Application, you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree with any part of these terms, you may not use the Application.

2. LICENSE GRANT

Subject to the terms of this Agreement, Dellways Logistics grants you a non-exclusive, non-transferable, limited license to use the Application for personal, non-commercial use within the Delhi National Capital Region (NCR).

3. USER RESPONSIBILITIES

3.1. You agree to use the Application in compliance with all applicable laws and regulations within the Delhi NCR area.

3.2. Location Tracking: By using the Application, you consent to Dellways Logistics' collection and use of location data for the purpose of providing hyperlocal delivery services within Delhi NCR.

3.3. User Info Sharing: You agree that Dellways Logistics may share necessary user information with delivery personnel and other relevant parties solely for the purpose of completing delivery tasks and ensuring efficient service.

3.4. Package Detail Sharing: Dellways Logistics may share package details, including but not limited to recipient information and package contents, with delivery personnel and relevant stakeholders involved in the delivery process to ensure timely and accurate delivery.

4. PRIVACY

4.1. Your use of the Application is also governed by our Privacy Policy, which is incorporated by reference into this Agreement.

4.2. Dellways Logistics may collect and use information as outlined in the Privacy Policy, including location data, user information, and package details as necessary for providing hyperlocal delivery services within Delhi NCR.

5. OWNERSHIP

5.1. The Application and all related intellectual property rights are and will remain the exclusive property of Dellways Logistics.

6. CONFIDENTIAL INFORMATION

6.1. You agree that any information provided to you through the use of the Application, including but not limited to operational details and technology used, shall be considered confidential information of Dellways Logistics.

7. INDEMNIFICATION

7.1. You agree to indemnify and hold Dellways Logistics harmless from any claims, damages, losses, or liabilities arising from your use of the Application or any violation of this Agreement.

8. RIGHTS AND RESTRICTIONS

8.1. You shall not sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make the Application available to any third party.

8.2. You shall not modify, adapt, translate, reverse engineer, decompile, or disassemble the Application or create derivative works based on the Application.

9. DISCLAIMERS AND LIMITATION OF LIABILITY

9.1. The Application is provided "as is" without warranties of any kind, either express or implied.

9.2. Dellways Logistics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Application within the Delhi NCR region.

10.Refund and Cancellation.

10.1Our focus is complete customer satisfaction. In the event, if you are displeased with the services provided, we will refund back the money, provided the reasons are genuine and proved after investigation. Please read the fine prints of each deal before buying it, it provides all the details about the services you purchase.

In case of dissatisfaction from our services, clients have the liberty to cancel their order and request a refund from us. Our Policy for the cancellation and refund will be as follows:

10.1 Cancellation Policy: The Customer may cancel the order at any time before the courier commences or the order is completed. The beginning of an order is defined by drivers arriving at the pickup point in the order schedule. In such cases only partial refund can be provided..Order completion is defined by the courier moving to pick-up and at least one delivery location within the order schedule. Refunds cannot be initiated in such cases. For cancellation, the Customer can access the cancellation options from the dashboard of the customer account registered in the App or directly on the web portal of the Company.

Please contact us through chat on the website or app for cancellation with the help of customer support agents. Our specialist will attend to customer requests during working hours within the availability waiting period regulated by customer support instructions. Cancellation charges will apply to orders that were initiated or completed in whole or in part as follows.:

If the pickup was done by courier or the courier has reached the pickup address at the scheduled pickup time or if the courier has reached the pickup address 30 minutes before the scheduled pickup time and has contacted the customer to inform him that the courier has arrived: Cancellation In such cases the fee will be equal to Pick-up fee for scheduled orders. In case of cash payment for the Services the cancellation fee will be debited from the Customer Borzo balance in the form of a credit note and will be applied to the Customer's next order. In case of non-cash payment mode the cancellation fee will be directly debited from the customer Borzo Prepaid/Postpaid balance and the same will be reflected as cancellation fee in the customer dashboard and term invoice. Charges will be applied to the same Dellways  order number that was canceled.

10.2 Refund Policy :After confirmation from the investigation team and their positive response the refund will be credited either as a credit note on the customer's balance or directly into the customer's bank account within 7 working days, whichever method is preferred by the customer.Liability on the goods to be delivered can be assumed by the Company only within the limit of the amount guaranteed and only in case the Customer has declared the correct cost and correct contents of the parcel (guarantee amount) during the order placement on the Portal and only In case of security, 0.85% of the declared cost plus GST is paid to the company before order placement. The maximum liability under the Maximum Guarantee Sum Assured is Rs 10,000. Under no circumstances should the Customer place an order exceeding Rs 10,000 without prior written confirmation from the management team of Dellways

11.Use of Company wallet.

11.1 Dellways  provides an e-wallet facility to the customers through which they can place Orders On application and web without any payment interruption.E-wallet can be recharged through 3rd party apps or net banking .Customer Wallet can be used only for payment of order delivery charges.Once the wallet is recharged, the customer cannot transfer it back to his bank account or to any other wallet.

12. Prohibited Goods.
12.1 :You are prohibited from using dellways  Services for delivery of the following Prohibited Items, in respect of which dellways  Logistics accepts no liability whatsoever. We do not accept liability for any consequence whatsoever resulting directly or indirectly from or in connection with any of the following Prohibited Items, regardless of any other contributory cause or event:

Any and all items which are illegal to carry own or transport or which, in the reasonable opinion of dellways  Logistics , may potentially be hazardous or dangerous to the Courier or the general public, including but not limited to:

• Explosives including fireworks

• Pornographic materials

• Illegal drugs or any other contraband

• Weapons, Arms, Ammunition or associated parts, accessories, materials, ingredients or technology, including deactivated and replica weapons

• Blades of any kind longer than 1.5 inches

• Dangerous power tools such as chain saws

• Flammable materials

• Vape products including all components of vape devices, e-liquids, and related accessories

• Any item associated with tobacco and controlled substances

• Any item classified as controlled substances or restricted by any local law or regulation in force

• Any original government-approved documents, including passports, driver’s licenses, or any other official identification papers

• Dangerous chemicals

• Dangerous biological agents

• Computers, Personal computers (so called PC), laptops, tablets, notebook

13. TERMINATION

13.1. This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement.

13.2. Upon termination, you must cease all use of the Application and destroy all copies of the Application in your possession or control.

14. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Delhi NCR, without regard to its conflict of law principles.
