PROPOSAL AMENDING MCR 4.201 TO REQUIRE A "RIGHTS & RESOURCES" FORM TO BE SERVED WITH COMPLAINTS FOR POSSESSION ON TENANTS IN A RESIDENTIAL EVICTION ACTION

Why It's Important

Amending MCR 4.201(B)(1) would require the local district court to develop a Tenant’s Rights and Resources Form to be served with a complaint for possession under summary proceedings jurisdictions.

The proposed form would list relevant and geographically-specific resources to: (i) find informational materials about the law and where to obtain legal advice; (ii) access pro bono services; (iii) identify sources of housing-related emergency financial assistance; and (iv) identify emergency housing services, e.g. local shelters.

Given the speed of a summary proceedings action, the tendency of tenants to be unrepresented, and the complexity of housing law, the proposed form strikes the proper balance between the competing interests of due process, landlord's interests, and judicial economy.
