•Another Lawsuit for Sunshine Law Violation


Earlier Lawsuit filed against University City for Violation of the Sunshine Law

On January 31, 2011, a lawsuit alleging violation of the Sunshine Law was filed against the City of University City, Police Chief Charles Adams, City Manager Lehman Walker and Mayor Shelley Welsch for failing to provide records requested four (4) separate times: on Dec. 15, 2009, April 5, 2010, October 14, 2010 and finally on November 8, 2010. 

Though a criminal conviction for murder was at the center of the case, it was inactive and the records would have been public records (RSMo §610.100(3)(c)).  If the city felt the records were closed it was the obligation of the custodian of the records to respond to the request no later than 3 business days after receiving it, stating why she felt the records were closed.  No response of any kind to any of the four requests was ever made.  The first request took place under Mayor Joe Adams, but the subsequent 3 requests occurred during Mayor Shelley Welsch's term and the current administration. 

On March 16, 2011, the plaintiff's attorney filed a motion to dismiss with prejudice (a final non-reversible action).  The attorney for the plaintiff said they were given the records, but no copy or search/research fee was charged.  The plaintiff did not ask for and the city did not pay court costs or attorney's fees. 

Why was Mr. Williamson was forced to file a lawsuit in order to obtain his rights to the records, and to force University City to meet its obligations under the Sunshine Law?
