Revolvers are for Russian Roulette:
Using a revolver with one loaded chamber and pointing it at someone's
head or your own after spinning the chamber, and pulling the trigger is
known as Russian Roulette. We Americans have changed the rules a bit.

In America, we use products, health care servicesBP Oil Rigs 
nuclear reactors (y, z), food safety, Safety On The Job and labor rights.

Amy thing that can "turn a 
profit", while not being easily 
recognized as the life and 
death gambling for profits
with 
"Red Collar Crimes". And if that becomes apparent,

military industrial complex that

Note that the district attorney that convicted Jeffrey Dahmer  also had
charged ten corporations with negligent homicide. And won every case
(162).

Radioactive Revelations of
Fukushima;

You probably think that it was just an earthquake and
subsequent tsunami that were the cause of the nuclear power
plants problems, in Japan.  How ever, there is more to that.


 The March 15, 2011 New York Times published a story (z) that the
Fukushima: (Japan) Mark 1 nuclear reactor had such serious design flaws
that
35 years ago, Dale Bridenbaugh and two of his colleagues at General Electric
resigned from their jobs in protest, after
becoming increasingly convinced that
the nuclear reactor
design they were reviewing -- the Mark 1 -- were so flawed
that it
could lead to a devastating accident. And that was the same valve that
failed when the reactors blew.
The New York Times article (z) reveals that
the true cause of the nuclear disaster in Japan was a thirty plus year old
corporate cover up by General Electric Corporation.


  And then there are the
"Cyberweapons" (computer worms) that have been deployed on
nuclear reactors (
y).  And were found in Japan during July of 2010.

Additionally, an investigative I-Team report by a news team that was published in
February of 2011 and about a month before the nuclear disaster in Japan showed the
EPA under reports radiation in America's drinking water supplies

Of which was Part 8 of a series of on going reports on naturally occurring 
radiation in our drinking water.  Of which is cumulative with man made radiation, as

A little more in depth;

Such as the estimated fall out from Japan with, airport body scanners, medical X-rays as well as
contaminated areas.  Such as the three State area from the Hanford Nuclear Experiments
on the unsuspecting public, the accidents at Three Mile Island, the La Area.
In fact, many people are unaware of the deaths in America from the Chernobyl Accident.

The simple truth is that the fall out from Japan is cumulative.  It is estimated that one
out of fifteen homes in America are over the allowable limits of Radon. that are low,
compared to the allowable limits in other countries. And the Radon exposures in America
are estimated to be the second leading cause of lung cancer (among other illnesses) with
tens of thousands of deaths per year, in the U.S.A. as it was.

The real cause of the BP Horizon Gulf Oil Disaster
as it relates to "the Red Collar Crimes Of American Roulette":

The 60 Minutes episode about the BP Deepwater Horizon Gulf Oil Disaster.

The interview with a survivor and Professor Bob Bea exposes how a BP exec took control
of the operation (after a heated exchange) and took risks that caused the disaster, in the
hopes of making "more profit".  They did also discuss other safety concerns, such as
the faulty valve and the absence of other safety measures.  Regardless, this 60 Minutes
episode documents that it was ignoring safety procedures in an attempt to increase the
bottom line that actually caused the disaster.  The documentation from 60 Minutes shows
that it was actually the "reckless operation of a corporation that caused the oil well to
explode.

The amount of money that BP has had to spend trying to clean up the
mess and it's "liability" could have been prevented by a law for the
criminal prosecution for the "Reckless Operation of a Corporation". 

It is a scenario that appears to be more that a "common thread"
with such "situations",after researching this, for over a decade.

 One of the strategies (and reference material) that I am reviewing 
is that legislation for "The Reckless Operation of a Corporation" could
dramatically improve the bottom line profits of large corporations. The
basic strategy is that "it is always about the money".  While the CEO's of
large corporations take risks in the hopes of being rewarded for raising
profits, they often ignore the consequences because their "personal risk"
is not that much of a factor.

The prevention of "profit losses" to a corporations stock value is
some thing that I suspect the CEO's of large corporations do not
want the shareholders to consider, when it comes to legislation with 
criminal charges for the "Reckless Operation of a Corporation".


"Class Action" (starring Gene Hackman) is another classic example. A
company knew that people would die, but it was cheaper to pay the wrongful
death suits than to have a recall. So that was what they did and it was exposed
in a court case. The point being that no criminal charges were filed. Not
even for a "Failure in a Duty to Rescue (57), let alone manslaughter.
Not against the corporation or the individuals responsible.


Did you ever ask yourself why there were not any criminal
charges against people for Firestone tires and GM gas tanks
to name two
(1). The movie Erin Brockovich is another example.

The cumulative manifestation of our individual greed:

While "Red Collar Crime" is well explained in an
article by the Corporate Crime Reporter 2006,  the
term was actually coined in conversations with Don
Kelso while we talked about the Firestone Tires
(1) that
were on my truck.

And to be clear, it was a dinner table in a building that had
been first built by survivors of the Donner Party.

The home was added on to and even though it was
an older table, I can not say that it was the families
actual table. 

Don never said and I never did ask.  Things were strange
enough, with out knowing the answer to that.

The important thing that Don Kelso also understood
is the lack of accountability with corporations
and our government.

  One of the other "conversations" that Don Kelso
and myself had on several occasions concerned having
"oil for the troubled waters" (as Don would put it).

The 300 riches and most powerful men in America, are not the only ones
that are responsible for "Red Collar Crime". 
    Some say that it is the large corporations, that are to blame, in general.
My experience with Firestone tires is what revealed the truth to me.  
The victims knew others would die, if they allowed the records to be sealed.
Sure, Firestone knew that too.  But so must have the judges 
that sealed them.  And it happened numerous times.  That is 
the key.  The real problem is the "psychic numbing" of our society.   There 
are many examples of this, in one newspaper story  (1 ).


   It really does not matter if the lives are other American's , or foreigners.  Even 
the majority of Americans fail to realize and or acknowledge this. No war on 
terrorism will succeed, unless the very roots that spawn individuals such as 
Timothy McVeigh and Bin Laden are torn out. 

The people in the Middle East have another perspective on how to deal with such situations. If a house were to collapse and it could be shown that some one's faulty workmanship was responsible for a death, the house would be rebuilt. With the offending "infidel" entombed in the wall. Now try to explain Firestone tires or GM gas tanks to that crowd.

The realization that over 400 "victims" allowed the court records to be sealed in both the Firestone tires and GM gas tanks litigation (1) changed much of my perception. They had to know that others would die, if that information did not get out. So did the judges and Firestone and GM.

This has caused me to wonder exactly how I would respond, if such a large pile of cash was put in front of me? Would I play this game of American Roulette?

I cannot honestly say. Or am I to claim that I am different and special ?

Some how, I can not con myself in to thinking that as the 401st, I would behave differently. See what I mean?

Now add the juries, friends, clerks that knew about it. I would say that twenty people per case is a "low ball figure". So over 4,000 people knew about it, in both cases, before a stop was put to it.

Am I to claim that if I was number 4,001 that I would be the exceptions.  And even though I would hope to be accounted among there numbers, I can not honestly say.

After all, I have never been offered millions or even thousands of dollars just to shut up.

Though there were exceptions.  In some number of these cases, somebody risked loosing all of their "out of court settlement" by leaking the information to the proper agency and putting an end to it.  They were and are by far, the exception.

Of course the victims families (1) were emotionally distraught. And I would not be surprise to find that the thought of other's falling victim were crowded out by a number of self-rationalizing processes. But I suspect that at some point they have or will come to realize the extent of the ramifications of their decision. Then having to justify and rationalize the recurring "pangs of guilt". Even if such thoughts of others had never crossed their minds, before they settled out of court and sealing the records. Some how, I would be extremely surprised if any of their lawyers brought any such concerns up. After all, it is all about the money.

Reining In The Military Industrial Complex:

One of the things we need is legislation to mandate criminal charges for 
"The Reckless Operation of a Corporation". It needs to include
mandatory jail sentences when the CEO of a corporation t recklessly 
operates the corporation and that results in the negligent death of someone.

It amounts to "Negligent Homicide" and it happens all of the time.
The one real difference between you or myself committing reckless
homicide with a vehicle and a CEO recklessly operating a corporation is that
the courts do not charge our car with a crime.  The courts usually charge
us.  But not so with a CEO and their corporation.  Usually, it is only the
corporation that gets charged with a crime., if at all.  Not the CEO and
or other corporate exec's.

   While convictions of corporations for negligent homicide are rare,
it has been done
(162).  Though presently, such "situations" usually result in
 Deferred and Non Prosecution Agreements.  Of which are
usually arranged by way of methods deployed in manipulating health
care with "Tacit Conspiracies" of "the revolving door" and
tractable money trails (MT1, MT2, MT4). It is rather rare, but
on occasion, all of the dots get connects to demonstrate how this

about a case that echoes the Jack Abramoff influence-peddling. The
Times reported that a few Congressman combined their influences to
prevent  the investigations and prosecutions of am (that is one) of the 
S&L banking rip off's  in the 1980s that cost taxpayers $1.6 billion (*MT3*).

Attorney Rob Hager that had represented a Veteran in the Agent Orange cases and helped draw attention to "The Cover Up Guru" has written an

For the most part, Hager says, the plaintiff lawyers representing the veterans were part of the problem.

They were colluding with the companies and with Weinstein and Feinberg to limit the damage to the companies.

You might think that would be a tough case to prove. But the district

the C.E.O.'s of large corporations are not held criminally liable for
their reckless operation of their corporation.

  By the same standards presently granted to the "corporate person
hood", our Constitutional Right to "equal protection under the law"
should amount to my car being charged for any and all negligent
homicides that might occur from my reckless operation of it while
intoxicated, or not.

 

Realistically, the "Corporate Personhood" amounts to 
"Unequal Protection Under The Law" and is what I believe 
to be a violation of our Constitutional Rights to equal protection.

  While explaining this to a friend one I said. "This is like the proverbial

But if you take the time to really research this, you might find that

In 1999 when I first met Don Kelso, I told him about my being 
I did not know at the time that he was the retired 
pharmacist from that very same "Norton 
Psychiatric Hospital".

Just so you know, Don Kelso (now deceased
from prostate cancer at 80+ years of age)
had helped me because of this.  He was more than 
a retired pharmacist that was acquainted with 
Timothy Leary.  The government had told Don that
the LSD they had him making was to cure mental 
illness and alcoholism.

If that was not bad enough, one of Don's daughters
had committed suicide.  He was not happy about
being lied to and misled with the LSD mind control
experiments "PROJECT MKULTRA".

One of the twists here is that Don owned the 
Skippy's Restaurant, in Forestville, on McPeak Ave.

From what Don had told me, the hotel / rrestaurant / bar
had bean added on to  the home built by a family that
were survivors of the "Donner Party". 

Before Don "fell out of grace", his restaurant was
a "Republican political hub", in Sonoma county.
 Down the road several miles is the Bohemian Grove
where many say the Manhattan Project was 
conceived, though not raised there. Don had one
of the Bohemian Groves old canoes, up in the 
rafters, above the dinner table.  People like 
Fred McMurray (from the TV show "My Three Son's") 
used to frequent the establishment.  In dact, Don 
still had McMuray's old saxophone that he 
had left at the bar.

Don and myself used to talk about all of this at
the dinner table.  Especially the

Court or a given State Court.  In so far as "Civil Court" cases go.
Then there are the Criminal Courts systems and the Administrative
Court systems.

President Bush having signed a law that limites (caps) the amount of money that can be awarded in liability law suits (on February 18, 2005.

The Senate Ignored a letter from 46 state Attorney Generals that said the bill will "stop them doing an important part of their job," supporters of the bill said that amending the measure "could possibly derail the whole bill." Reuters has. President Bush signed it anyway. This means that there is no longer a motive of money for lawyers to sue corporations in cases such as Firestone tires and the like.

Now we are really screwed. Unless a "reckless homicide and or other criminal conviction *RICCO?) can be used to barr the LiabilityCap that Bush signed into law.

This section deals with the criminal unaccountability of corporations.
There are three judicial systems in the U.S.A.

Civil Court, Criminal Court and Administrative.  The only real use
of a criminal court that I could find with environmental crimes was
when the FDA flexed its muscles and found four IBT managers 
guilty of mail fraud.   Because they had used the U.S. Mail
when they sent fraudulently produced reports.

But  criminal charges have been used, in some other cases.

Michael McCann, the longtime district attorney of Milwaukee County,(retired 12 / 31 / 2006 )was best known for prosecuting Jeffrey Dahmer. McCann had also prosecuted more than ten corporations for reckless homicide over the last two decades and had won every case 162

In the 1950's, 1960's and 1970's, Industrial Bio-Test Laboratories (IBT) performed about 35-40% of all U.S. Toxicology testing.  Bill Moyers of the Public Broadcasting System did a show named Trade Secrets and has created a web page of the same name (26). There is to much documentation there to list, in regard to "industry" covering up the damage to OUR HEALTH from toxic chemicals, for over fifty years. So the absence of criminal charges is a topic that I felt worth investigating. Virtually all of the well known cases were only tried in Civil Court with out ever being so much as charged in a Criminal Court.  The few that have tried to bring criminal charges have met with rigorous opposition. And is documented in the section of this page titled;

What this comes down to it that a company can be criminally charged and fined. But the criminals (or a excuse me) the Corporate Executives are not. Translation: if you want to be a successful criminal, be a corporate executive. Even when they are caught killing for profit, all they loose are a few bucks. Did you ever ask yourself why there were not any criminal charges against people for Firestone tires and GM gas tanks to name two (1). The movie Erin Brockovich is another example.


The Red Collar Crime of Corporate America.

WHAT IS "RED COLLAR CRIME?

They are white collar crimes when people die and there are usually no criminal charges against the "Corporate Executives", responsible (162). Such crimes are often "Cloaked in a Veil of Secrecy"(l), as documented in an article about Firestone tires and GM gas tanks (l). In these two instances alone (l), over 400 families took the out of court settlement in exchange for sealing the records. Allowing more American's to die, because they did not put a stop to it. They "sealed the records". (l). The Japanese own Firestone tires and much of the delay in the recall appears to have been caused by the Ford Motor Company and their with holding information. Firestone / Bridgestone now refuses to do business with the Ford Motor Company).

 Even so, the corporations could not do this alone. They are not the only ones to blame. After learning of so many people "sealing the records

" how can I say that I would not if presented with the same situation ?

And that is one of the reasons that CEO get such huge salaries and such. This is very true with HMO's, as Linda Peeno's web page and sworn testimony to Congress shows with regard to denying health care to the insured (20a20b).

The movie, "Class Action" (starring Gene Hackman) is an example of Red Collar Crime. A company knew that people would die, but it was cheaper to pay the wrongful death suits than to have a recall. So that was what they did and it was exposed in a court case, that the movie is based on. The movie Erin Brockovich is another examples of "Red Collar Crime".

The point being that no criminal charges were filed. Not even for a "Failure in a Duty to Rescue (57), let alone manslaughter. 

Other cultures simply call such people, "Infidels". Defined as "an individual (or group of people) that fail in their moral obligation to their fellow man". The fact that someone would even argue the legal aspect of "a duty to rescue" (57) just boggles the minds of such cultures, and proves the point, in their minds.

 In short, Red Collar Crimes consist of murder for profit, with out being held criminally accountable. This goes beyond the "this was not a bribe. It was / is a gratuity", echoed among white collar criminals. Because, "only blue collar people take bribes".

It really does not matter if the lives are other American's , or foreigners.
Know justice and know peace; 
  Even the majority of Americans fail to realize and or acknowledge this. 
No war on terrorism will succeed, unless the very roots that spawn 
indivi
duals such as Timothy McVeigh and Bin Laden are 
torn out. 
When there is no justice, there is no peace.

The people in the Middle East have another perspective on how to deal with such situations. If a house were to collapse and it could be shown that some one's faulty workmanship was responsible for a death, the house would be rebuilt. With the offending "infidel" entombed in the wall. Now try to explain Firestone tires or GM gas tanks to that crowd.

"Sunshine Laws" were passed to prevent such things, but have failed.


   Exactly why other District Attorneys rarely use such criminal charges
against corporations can be difficult to discern.

This goes beyond the fact that the laws for charging 
corporations with homicide vary from State to State (162) and the manner in which corporate executives are 
protected by the "corporate personhood".

This begs the question of why Negligent
Homicide charges are not used against
corporations more often?
  And what kind
of politics might prevent them from being used
against Massey?  Or even Toyota,, for that fact.
And this is with regard to criminal charges against
the corporations, not the CEO's and or other
corporate executives that are responsible for the
actions of their corporations.  That is another matter,
called
the "corporate personhood". That perspective
is partially addressed in the reference link
(162).



Please be aware that the example that I use of
concerning Earth First is controversial because of
the"propaganda" that has been used against them. It
is a common tactic.

So far, the California Attorney Generals Office has refused to even

homicide complaint that I filed (hrm49, hrm49b) against the Pacific Lumber Co. 



Two of the responses are scanned and posted at reference (hrm49). A logger was FILMED threatening Earth First Activists that were documenting the fraudulent manner PL was cutting trees. The logger starting falling trees at them" as he had threatened to. A protester was killed and the Humboldt District Attorney says that they "do not have enough evidence to convict".

not talking about "pocket change". It has been estimated that Pacific
Lumber has made millions of dollars from fraudulently harvested trees.

exact or substantiated figures and that estimate is
based, so far, on "hear say". Not
that I would want Pacific Lumber to file
a slander suit against me. Activists that were
trying to document some of
this were charged with "trespassing" in what have become
known as
the 
S.L.A.P.P. Lawsuits. Another story documents break in's at the DA's
home (
G2).

David "Gypsy" Chain  was murdered while documenting crimes of fraud that amount to RICCO violations that has brought illegal profits to Pacific Lumber CO in the millions of dollars

There is no way that anyone could say that the Humboldt County District Attorney's Office is not under undo influence or " impartial" not to prosecute the Pacific Lumber CO for the "reckless homicide" of David "Gypsy" Chain.

We even suggested allowing the logger that dropped the tree that killed Gypsy (after threatening to do so and video taped) immunity from criminal charges in exchange for testimony against Pacific Lumber. That would cinch the case against Pacific Lumber, but the District Attorney does not want to discuss it (as of yet, no response).

This is not "just about Gypsy". There has been a complete failure of the use of criminal charges against such corporations as Firestone, PEG& E, GM and others.

  If a criminal was robbing a gas station and a policeman died in
a car wreck on the way to the scene, the person robbing the gas station 
could 
be charged with the death of that officer.

   The same should be true of an advocate that was documenting the crime
of fraud by a corporation and dies as a result of it, as did David "Gypsy" Chain.

But then Pacific Lumber would first have to be convicted of fraud.  Since 
many 
of the other advocates and David "Gypsy" Chain's own mother do not 
really want 
the logger charged homicide, he could be given immunity, in 
exchange for his 
testimony.  Just as any other past Pacific Lumber 
employee could be given 
immunity from RICCO charges that could also be
