Buying From Our Ebay Store/Website

All goods offered on this website are subject to availability.  If we are unable to fulfil your order due to stock shortages then we will advise you of our expected delivery date or offer similar product/ refund. Note, pictures for none branded/universal accessories are for display purposes only and may differ very slightly from the item pictured on rare occasions.  

We try to ensure that our prices displayed on our website are accurate, but the price on your order will be validated by us as part of our order acceptance procedure.  We will inform you by e-mail if a products correct price is higher than the stated website cost, allowing you to cancel your order or to proceed at the correct price.

When you submit an order for a product/service, your order shall constitute an offer for the products/service chosen.  We are not obliged to accept your order.

The receipt of your order and the automatic acknowledgement creates no formal contractual relationship.

When you offer to buy goods or services you warrant that the user information which you are required to give us via our website is true, accurate, current and complete in all respects.  You agree not to impersonate any other person or to use false details, and that you are over the age of 18 years.

Whilst we take every care to provide accurate information we cannot be held responsible for site errors.

Delivery

All orders are despatched via Royal Mail.  We shall not be held responsible for delays within the Royal Mail delivery service.  All items are checked and sealed before being posted, if the incorrect item has been sent please return within 14 days with an unopened seal.  Do not except delivery if the seals have been broken, once the seal has been broken you have automatically accepted the item purchased and cannot be returned unless faulty. Missing/lost UK deliveries should be reported to TMPS within 30 days of the dispatch date and 44 days for European deliveries, 60 days for worldwide destinations, losses reported after this period will not be eligible for replacement/refund.  Parcels reported missing within the stated time period will only be eligible for a replacement, this does not affect your rights to cancel under change of mind, after the replacement has been received.  

If a delivery is unsuccessful, it will be taken to your local post/sorting office to await your instructions for redelivery or collection.  All deliveries will be made to the credit/debit/Paypal cardholder’s home address.

Your Phone Contract

Contract mobile phones are subject to status and a credit check.  In some cases, proof of address and or identification may be asked for.  The network may require a deposit or decline your application but you will be notified in all cases.

All contracted mobile phones and sim cards are subject to a minimum 12/18/24 months airtime agreement, full terms and conditions of your chosen network can be supplied on request.

Our offers are tariff dependent, therefore you will not be able to change the monthly line rental agreement cost at any point

In the event of your disconnection from any network for whatever reason (other than the 7 day cancellation) within the contracted period, we will charge you the full retail cost of the handset and accessories supplied. 

In the event of the above mentioned, Talkplan changes and disconnections will authorise us to charge the amounts owing to your credit/debit card details that were given at the point of connection.

Your Right To Cancel

Under the consumer protection (Distance Selling) Regulations 2000, you have the right to cancel the contract for the purchase of your mobile phone order within seven days of delivery.  (Starting the day after the receipt of the goods).

To cancel this contract you must return the equipment WITHIN seven days from the delivery date, please e-mail us at returns@tmpsonline.co.uk stating the reason for return, and quoting your order number, you will be issued a returns number and are then responsible for returning the item.  The returns number must be displayed clearly on the packaging.  The item can only be returned if the seal has not been broken.

Please note: if these conditions are not met we may not accept returned goods.  We recommend  you use a Signed For/Special Delivery for returning items; we will not be held responsible for any items lost in transit on their return.  None received handsets will be charged at a minimum of £300.00 plus VAT.  We will refund the total amount of money paid by you for the goods, less any costs of postage plus a £10.00 administration fee, debited from your credit/debit card within 28 days starting from the day on which we received your notice of cancellation.

Refunds by credit cards are made to the same credit card that was used for the original purchase.


Manufactures Warranty

Please contact Customerrelations@tmpsonline.co.uk for details on your nearest warranty repair centre.

We cannot make reimbursements for any loss of data, such as phone book or personal information, which is stored on your mobile phone or Sim card.

 

Fraud

The Mobile Phone Shop will not tolerate any attempts to obtain goods by fraudulent means.  Any fraudulent action will immediately be reported to the relevant authorities and action taken without exception.  Please note that Internet host IP addresses are recorded when placing an order online.

Complaints Policy

We are committed to providing a high quality service and aim to deal effectively and fairly with any complaints.  If you do have a complaint or comment to make concerning our service, please e-mail customerrelations@tmpsonline.co.uk .  

Your complaint will be acknowledged within 5 working days and dealt with appropriately.

Privacy

Any information collected by The Mobile Phone Shop including that gathered at the time of ordering/registration, is collected lawfully and in accordance with the Data Protection Act of 1998.

The Mobile Phone Shop do not sell or transmit any customers personal information, including e-mail addresses, to any organisation for any purpose other than for processing orders placed with us.

The Mobile Phone Shop cannot be held responsible for the result of any credit assessments or for any delays caused by insufficient or incorrect information being supplied by the applicant.

We will take all reasonable care to keep the details of your order and payment secure, but in the absence of negligence on our part we are not liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Pictures of products are as a representation only and should only be used as a guide.  Specifications and /or colours of products may change without prior notice.


Returns

Change of Mind

Accessories sold from TMPS's web site have a fourteen-day money back guarantee.  Accessories are returned at the customers own cost under change of mind within this period. .

Purchased items must be received back at The Mobile Phone Shop within the fourteen-day period in their original packaging with a copy of the original invoice and returns number clearly displayed.  To retrieve a returns number e-mail: returns@tmpsonline.co.uk

Warranty

All electrical products have a 12 month warranty unless otherwise stated.  Cases and other fashion items have a 28 day warranty.  If any goods sold by the Mobile Phone Shop are found to be faulty once opened within this period, you may return them and we will send a free replacement provided that we verify the fault.  Return postage for faulty items will be covered by TMPS in the first 30 days, due to the low value of accessories, items reported faulty over this period will be returned at the customer own cost.

If a product is returned as faulty and has found not to be, a return postage cost will be charged to the customer.


Mobile Phone Insurance

All mobile phone insurance is offered by a third party, we are an introducer only and do not insure any products ourselves.  It is important that you read and understand their terms and conditions should the third party insurance company refuse to insure a product or refuse a subsequent claim, this may not be used as a reason to return said products or break a contract with a mobile phone network or service provider.

Payment Authorisations

By accepting these terms and conditions you agree that The Mobile Phone Shop are authorised to charge your credit or debit card for the goods supplied.  You also agree that we are authorised to charge your card with any other charges specified within these Terms and Conditions.

In the event that any amounts become due (including downgrades, early disconnections, missing or damaged returned goods, credit or debit card charge backs and dishonoured cheques) and remain unpaid for more than 14 days, we reserve the right to engage the services of a debit recovery agent.  Charges incurred as a result of this action will be your responsibility.

 

Liability

The Mobile Phone Shop (TMPS) will not be liable for any business loss including loss of profits, revenue, contracts, anticipated savings, goodwill or wasted expenditure or any other indirect or consequential loss. TMPS can not be held liable for Damages caused by user, of accessory equipment supplied by TMPS.  It is the user's responsibility to check any supplied items prior to use,  any damage caused by the supplied equipment is therefore not the responsibility of TMPS.

These terms and condition do not affect any of your statutory rights.  The Mobile Phone Shop reserves the right to alter the terms and conditions at any time.
