Taxi Industry is a service oriented industry.
Taxi Passengers must be given a safe and comfortable ride.
Taxi Drivers must be provided with a safe workplace and safer work practices.
Taxis plates are the property of the state and general public.
Taxis licenses must be used for the benefit of the people of New South Wales. Both the commuter and workers within the taxi industry must benefit not just a few privileged “stake-holders” as is the present situation.
The Reality: It is very difficult to summarise the taxi industry problems, reasons and solutions in a simple manner. I therefore would like to present the Preamble first and then the Written Submission as per the Terms of Reference of the NSW Upper House Inquiry with an expectation to make an In Person Presentation later.
Faruque Ahmed: Some people blame Faruque Ahmed for everything including as small as sneezing to something big as Tsunami! Yet, the NSW Taxi Drivers have got more rights and protection than any other state by the statute at least!! It appears people like Justice Edwards, Justice Beattie and a few more decent figures in the past had some respect for justice, fairness and decency. A state by state comparison may reveal more about the Australian taxi industry and even assist us to move forward with reality.

A Public Inquiry is meaningless without spontaneous public participation.
Politicians and the public servants have been throwing bagfuls of money and endless power to the taxi industry mandarins! Yet, the mandarins are refusing to broadcast the NSW Upper House Inquiry details through their radio networks and other propaganda machines!!
They have not broadcasted the NSW Upper House Inquiry Terms of Reference or any other details despite a request form the Inquiry Secretariat to do so.
I have requested the office of the Minister David Borger to instruct the taxi mafia to broadcast the relevant information. A keen person took my idea on board and she promised to pass them on to higher people. Hope some good comes out of this effort.
Further to A Critical Observation re NSW Upper House Inquiry, someone claimed to be a senior official from the above minister’s office rang me up and she kindly volunteered to provide me the address of the website from where I could get the Terms of Reference of the Upper House Inquiry. I replied to her that I have the TOR of the UHI. I also told her that the Minister has (and must have) the power to compel the taxi networks to announce the details including the Terms of Reference of the Upper House Inquiry.
At the end I was not sure that she was either interested or capable to understand my request and reasons and grounds behind such a simple request.
Submission to NSW Upper House Inquiry (Taxi Industry)
a. the adequacy of government reporting standards and regulation of the industry and the impact of this on the provision of quality taxi services for commuters, including for people using wheelchairs,
The NSW Government and relevant departments do not have any reporting system to measure the metrics of the taxi industry. Repeated requests to initiate a reporting system and a request to act accordingly failed to get any acceptance. However, they have used racism and sectarianism to cover up their deliberate incompetence and corruption.
They do not have management tools to measure the industry! They also do not know who got the wheelchair taxis, how many disable people they are compelled to transport or are actually transporting. A request to initiate a system to watch, observe and improve the lot of disabled people has fallen in deaf ear.
My Letter to Brian Langton generated Secrecy of NSW Ministry of Transport! I have collected many more evidence like these two mentioned above! It appears there is much organised chaos! The department is acting against the wishes and interests of the state, public and workers. However, the department appears to serve the taxi mafia very well.
Movement of personal between the NSW Department of Transport and Ministry of Transport is very sinister. These officials swap their positions with taxi and bus mafia organisations like musical chairs.
Recommendation1. Politicians and public servants must uphold the state and public interest first and their decisions and decision making process should be democratic and fact based.
b. the provision of government subsidies to the industry and the allocation and subsequent trading of free "Nexus" plates, including the impact on public revenue,
Again I have been requesting them to comply with “A Nexus Inquiry” for a long time. I went to the NSW ICAC, NSW Ministry of Transport, Department of Transport, Ombudsman and NSW Auditor General without any success! During the Deloitte Inquiry I have contacted a senior Ministry of Transport official and he hoodwinked me regarding this inquiry and pertinent issues altogether. In short the Deloitte Inquiry was more than a joke. It was a humungous cover up at the expense of public, justice, fairness and decency.
For some reason, earlier, the brother of the former Department of Transport official in-charge of WAT was found guilty of wrongdoings! For that reason, taxi drivers in general got the thrashing from everyone but the system remained rotten.
Administration of the "Nexus Scheme" is tragic and requires another Inquiry on why the tax payers’ money was used to confuse public and protect taxi mafia with the subordinate public servants! Mr Taxi's $20 million windfall and related articles are staring at all of us. Ironically, many people do not condemn the mafia for these crimes!! They rather blame poor drivers and migrants for everything!!!
Disabled miss out in taxi plate gains shows an incompetent administration and anti-worker Labor Government who have no respect for justice, fairness and any other cherished values known to mankind.
Nexus Taxi Plates thread was enjoyed by many people for a long time (http://melbourne.indymedia.org/news/2006/03/108568.php)! Yet, the same thread disappeared from Melbourne Indy Media! Is it a co-incidence or conspiracy?
Yet, The Auditor General of NSW gave us nothing!!!
Super Rats, Taxi Council Limited, NSW IPART and Nexus Plates is one more effort to expose the Nexus Scandal without any success!
Recommendation2. All nexus taxi plates and other types of free taxi plates including compensatory taxi plates should be accounted for, recalled and handed back to working taxi drivers directly to improve service to disabled people. Past and present abusers of these taxi plates should be prosecuted.
c. the effect of limits on the supply of unrestricted taxi licences in New South Wales, particularly as it impacts on customer service,
They do not have a system to understand the demand and therefore a policy to match the supply with demand! Relevant departments do not have a concept called “customer service”. They refuse to initiate any regulations to compel the taxi companies/networks/radio companies to improve their game, pay attention to customer service and reduce misery and misfortune of drivers and passengers! Rather they compel taxi owners, operators and drivers to pay these taxi networks/companies unjustifiable radio fees. They also gave them uncheckable and obscene power to subjugate taxi drivers and owners. Repeated requests to rectify the situation failed.
They have a deregulated work force and totally regulated (protected) taxi plates (market)! Why can’t they have a total deregulation? The answer is simple! It will be against the interest of the mafia!!
As mentioned in Stupid Taxi Owners, the regulators even can not compel taxi networks to improve service. They rather reward the taxi networks/companies for not servicing the public and drivers. The taxi owners/operators are not even in a position to question their radio fees and compulsory unionism (without representation) enforced by the regulation against general interest.
Recommendation3. Legislative frame work must be initiated to ensure taxi/radio/communication network accountability in order to improve service to traveling public and working taxi drivers.
d. anti-competitive activities in the industry and the Government's compliance with National Competition Council rulings,
The regulations force taxi owners, operator, lessees, sub- lessees, sub-sub- lessees to join the Taxi Council Limited, NSW Taxi Industry Association, … . However, these people got no say whatsoever about any of these organizations, in reality and all sense of practicality. These organisations also act against the wishes and interests of these so called members!
Stupid Taxi Owners is just one example. Howard Harrison of Taxi Council Limited can incite against working taxi drivers and owners. The WorkCover Authority or anyone for that matter refuses to take action under the Duty of Care provision of the NSW Occupational Health and Safety Act.
Almost every year, whenever the opportunity arises, the taxi mafia spends money and prints colorful brochures to incite the public against taxi drivers. I have forwarded those baseless and offensive materials to some authorities including the NSW WorkCover Authority and they did nothing. I intend to present them properly during my personal presentation.
Legion Taxi Network and Combined Communications Network are above the law and they are not answerable to anyone!
NSW Police-Crime Stoppers refused to answer my letter. However, it appears, they are very close to the taxi mafia! Although, according the NSW Parliament, not many taxi drivers were charged for any alleged crimes exacerbated by the tabloid type media and swallowed by the state instrumentalities.
In short, “d” does not exist in the taxi industry. In fact the mafia rules! They use race, religion and many more baseless grounds to cover up their wrong doings and shift the blame to workers and migrants.
ii. Remove and rewrite the NSW Passenger Transport Act and relevant Regulations that promote and support compulsory unionism (without representation) by stealth.
e. the performance of the wheelchair-accessible taxi fleet, with special regard to Federal disability discrimination laws and their compliance with the 2002 Disability Standards for Accessible Public Transport,
In reality “e” is neither the concern of the taxi mafia nor the regulator! I have written many letters regarding this issue and the result is negative.
i. Commence immediate establishment of accountability and transparency mechanisms within the relevant departments.

Recommendation6. Remove mafia influence and ensure public and worker interest during the decision making process.

NSW Ombudsman said, NSW Department of Transport is “captured by taxi Council” (Limited). NSW IPART also said, NSW Department of Transport is “not forthcoming and evasive”. The NSW Department of Transport hates democracy, openness and accountability! That’s why they refuse to initiate and support a properly represented and meaningful NSW Taxi Advisory Council. They also like their way or highway! The NSW Department of Transport is very uncomfortable with the Taxi Safety Committee.
In a recent meeting when I asked the NSW Transport and Infrastructure Director General and his entourage about the Taxi Advisory Council and Taxi Safety Committee; they liked the idea but they could not commit either way.
However, in a recent letter to the NSW TDA, he has expressed his desire to impose a “congestion tax” (set fare) on taxi workers based on Taxi Council Limited’s instruction!
Jason Morrison of 2GB Drive (Re: Taxi Mafia), Jason Morrison of 2GB Drive (Re: Taxi Mafia) and Beyond, Who is blocking me? and many more examples clearly demonstrate The Power of the Taxi Mafia contrary to public interest and cherished values known to mankind.
The Power of the Taxi Mafia as reported in the Sydney Morning Herald, the industry mobs managed to silence and sabotaged more than 20 inquiries and outcome of those inquiries! Aren’t they examples of mafia power and influence in the NSW politics?
iv. Investigate and prosecute direct and indirect power and influence of taxi mafia to radio, television and print media.
h. the level of transparency and accountability in the regulation of the industry, including the reasons for the failure to make public reports flowing from six out of ten inquiries or reviews over the last decade,
Rod Flaming, Fred Death, Jim Gleeson and many other Ministry of Transport and Department of Transport officials basically worked for taxi mafia and bus mafia during and after their tenure at these departments! That’s why many laws and regulations initiated by them are anti public and worker in nature and pro taxi mafia in every sense.
We already got evidence about Taxi Washer to Taxi Mafia. Let’s examine the route to ‘taxi mafia to bus mafia’! The bus mafia (Deloitte Cabcharge Ltd) was awarded a lucrative contract under J Gleeson regime. As a result a no body of the bus industry has consolidated himself as the biggest bus operator at the expense of the NSW taxpayer. On top of that 50% of the CBD streets are eaten out by the 90% unused bus lanes. During this period, the part time director general Gleeson was the full time employee of the mafia controlled Bus Company!
While these public servants are busy to prosecute taxi drivers for scratching their bum with the wrong fingers, they are pumping bagfuls of money to the taxi mafia and bus mafia in many ways. Beside the Nexus Scandal they are throwing unlimited amount of money to Night Rider Bus Service and other bus subsidy schemes.
Recommendation8: i. Investigate the outcome of traffic between government officials and mafia organisations in regard to nexus taxi plates, Night Rider Bus Subsidies and all other bus subsidies including the city street preferences given to bus industry.
i. the appropriateness and accountability mechanisms associated with the appointment of key Government ministers and bureaucrats to positions in the industry and its impact on Government policy,
Notifying the Revocation of Authorisation failed to convince the ACCC to inform taxi drivers and owners about the Federal Court Decision to revoke Authorisation A30152.
Merger and Acquisition by Cabcharge Limited also failed to convince the ACCC to register me as an interested party!
Cabcharge and Criminals is further evidence of anticompetitive policies and the attitude of ACCC and officials.
The WorkCover Authority or anyone for that matter refuses to take action under the Duty of Care provision of the NSW Occupational Health and Safety Act.
We have communicated with the Law Reform Committee which was initiated by the NSW WorkCover Authority and suggested to them that all moving vessels like planes, ships, trains, trucks and taxis must be declared as work places. We also suggested that the Duty of Care Provision of the NSW Occupational Health and Safety Act must be applied to the taxi industry. They replied to us and said that we are covered under the OH&SA. However, on a separate communication, the then Attorney General wrote to me and said, “… due to bailor bailee relationship the act is not clear …. “! The important fact is that after so many years and so many requests no one is willing to remove the ambiguity and protect taxi workers like all other workers.

i. Public servants and departments must not bend backwards due to rumors and innuendos of private enterprises (in this case ill motivated and false accusations of Taxi Council Limited, NSW Taxi Industry Association and other groups)
ii. Duty of Care provision of the Occupational Health and Safety Act must be enacted and enforced regardless of any relationship including bailor/bailee relationship in the taxi industry.
iii. Public servants and departments must not compromise the spirit of competition, fairness and notion of justice because of lies, racism, prejudice and bigotry cunningly used by “taxi mafia” (to obtain restrictive trade practice authorisation for Cabcharge).
iv. Prosecute taxi mafia for contempt of Parliament as demonstrated in A Critical Observation re NSW Upper House Inquiry and Beyond A Critical Observation re NSW Upper House Inquiry.
v. Initiate immediate investigation and subsequent prosecution for sabotaging and silencing Inquiries and Inquiry Reports mentioned in The Power of the Taxi Mafia
j. regulatory structures in other Australian jurisdictions and the optimal framework required to achieve the best possible taxi service for members of the public in New South Wales,

Taxi cabs, radio set, and all other equipment in the taxi are the property of the bailor. Similarly, an electronic tag should be the property of the bailor too. However, Connor said that from now on E-Tag should be the responsibility of the bailees! During that decision he said, (and I paraphrase) "absence of an E Tag shouldn't disadvantage bailee drivers". Now, the Sydney Harbor Bridge and many other toll ways have removed their cash payment systems and this is disadvantaging bailee drivers all of the time and this disadvantage extends back even at the time Connor made his original decision on this issue. Clearly, Connor did not conduct any so called disadvantage test prior to making his innate anti-bailee deliberation on that occasion too.
I deliberately avoided IRC Travesty. Most years, I stand in front of these people with minimum expectations. I thought they would have some respect for justice, fairness and notion of justice. In reality, I haven’t found any. This time a few close friends of mine said, “let’s try to convince the TWU leadership rather than have a confrontation with them”. I knew they were wrong and the TWU will sell out taxi drivers, no matter what! Well, it happened again!

I have been talking to talk back radios for a long time. Last time I was blocked by some of them due to the 9/11 charade. This time, it appears, I am blocked due to direct and indirect influence of industry mobsters’ advertisement power.

As I mentioned earlier, the TWU gangs (Labor Party) have been murdering taxi drivers’ civil rights and industrial rights! Consequently, taxi drivers hate those gangs and they are voting with their feet! Yet, they are the recognised PARTY at the Industrial Relations Commission and they are raping taxi drivers since 1984!

Representation before the Industrial Relations Commission Concerning Bailee Taxi Drivers was refused to protect the territorial interest of the NSW Transport Workers Union (Labor Party). Union NSW also refused to listen to our valid requests.

Those who departed from the core of the argument have not had real experience and proper historical knowledge. Some of them spoke foolishly against Faruque due to inbuilt prejudice and bigotry and not based on fact.
Anyway, the committee is free to investigate all of these very important issues and recommend legislations to remove any and all ambiguities.

Unlike company registers the taxi register is secret! No one knows who owns what, how and why. A politician, public servant, mafia, drug dealer or anyone may own any number of taxi plates. You see, they love to keep this taxi register secret! It appears to me, it is a deliberate protection racket.
Mac Airport Philosophy and Techniques
Max the Axe Man used to be the director General of the Transport NSW. He also served as the Chief of Staff of former Prime Minister Howard. Now he runs Mac empires. As a taxi industry activist I had to contact him and Silence of Max the Axe Man is a revealing document! I also made enquiries to Transport NSW officials in this regard. Basically, I have requested them not to provide opportunities to Mac Airport to charge the public and workers. You may observe from the Evasive Transport NSW Response they have conspired with the Mac Airport to charge the public and workers to use public property and land! They are also very evasive and obnoxious.
City Pick Ups and Drops and Mighty Cabcharge
98% of CBD streets are no standing, no stopping, …. . Passengers want to get in and out anywhere! Failure to do so will attract many conflicts and penalties for taxi drives. However, far too many promotion minded police and parking inspectors usually take the plate numbers or photograph taxis while taxi drivers are picking up and dropping passenger and they present them with penalty notices for doing their job! To make it worse, to process a Cabcharge card or docket make the taxi drivers’ life much harder. However, my Request to Advise Passengers was totally ignored by the Evasive Transport NSW Response. Whereas the same Transport NSW officials and ACCC generals ruthlessly promotes and protects the Cabcharge empire in many ways! Yet, they do not want to provide a simple protection to miserable workers.
Notifying the Revocation of Authorisation, Merger and Acquisition by Cabcharge Limited, Cabcharge and Criminals and many more documents clearly demonstrate the fact that Cabcharge was created by many illegal and immoral means including the use of lies and racism! Cabcharge profit is based on indentured labor and torture of taxi workers.
Now, these public officials blindly promote and protect Cabcharge. However, they refuse to protect the victims of greed and exploitation, the taxi drivers! Isn’t it ironic?

The Sydney Morning Herald exposed some of the taxi industry corruptions and scams recently. As a result the good officials came out with full force to flog the dead horse i.e. the workers and “wogs”! For details one can snoop around the Daily Telegraph and Ch 7’s raw sewerage outlets!
However, the outcome of the Passenger Transport Amendment (Taxi Licensing) Bill 2009 has strengthened the hand of the taxi mafia and ensured taxis plates are NOT the property of the state and public and taxis licenses must NOT be used for the benefit of state and public in general.
Can we ask who have drafted this Bill, when and after consulting with whom as well for what reason?
Cost Effective Pubic Advertisement
A request to initiate a cost effective public education campaign to reduce mistrust, aggression and violence was ignored by the mafia loving politicians and public servants.
i. Enact unambiguous legislation and ensure supervisory mechanisms including any other measures to stop wholesale destruction of public and workers interests mentioned above.
ii. Enact and enforce legislations to ensure proper taxi worker representation and prosecute the so called union leaders for taking bribes to protect the mafia interest.
iii. Expose and prosecute public officials for not acting to protect the public interest and hoodwinking public to safeguard private enterprise profit and greed.
Because of reasons and grounds outlined above, please recommend a Taxi Industry Royal Commission with widest possible terms of references and power.

My Preamble, A Critical Observation re NSW Upper House Inquiry, Beyond A Critical Observation re NSW Upper House Inquiry, Humorous Submission with Reality and Written Submission contain only 1% of documentations in my possession.
I intend to add another 1% of documentations in my possession during my In Person Presentation. However, some sources say, a powerful group is determined to stop me to do so.
Well, I’ll believe in everything as it is demonstrated in The Power of the Taxi Mafia over the last twenty years!
The NSW TDA President Anne Turner calls herself “princes”. However, the ex NSW TDA president Geoff Coates used to call her “mistress’. Although I am not interested in the past or personal issues! However, Anne Turner and Eddie Diab have attended many meetings with taxi owners and taxi mafia. They failed to provide the attendee, agenda and outcomes of those meetings despite repeated requests. The NSW TDA does NOT represent PLATE OWNERS!, is a small example to explore the situation! Anne Turner also admitted to accept money from the taxi mafia (by mistake I suppose). Please examine May the president please inform the committee should be examined to obtain some evidence in relation to this issue.
The submission to the NSW Upper House Inquiry presented by the NSW TDA banner is contradictory and does not reflect the proper views of the organisation and mission statement of the NSW TDA. Confidential NSW TDA Issues are one more example of Anne’s misadventure.
Since the election, Anne Turner and Eddie Diab have wasted three committee meetings for the blood of NSW TDA committee Member Ted Hirsh. They did this unlawfully and as a secretary I warned them about it.
Naturally, for a number of reasons including the one I mentioned above, Anne Turner and Eddie Diab clique conspired to remove me from the committee without any reason at the fourth committee meeting in my absence.
Now they are unlawfully writing to the NSW Upper House Inquiry Secretariat that I am not the elected Secretary of the NSW TDA! I also note that the written submission under the banner of the NSW TDA and rest of the activities are not inline with the NSW TDA activities, aim and objective.
In short, it is becoming clearer that the so called NSW TDA submission and in person presentation do not represent true values and interests of the working taxi drivers.
Ann Turner – Do Not Destroy the NSW TDA, and Reg Kermode Thugs Went on to Kidnap and Rob Faruque Ahmed are further reasons and grounds to grant me to present my in person submission.
Therefore, I should not be prevented from making an In Person Presentation during the NSW Upper House Inquiry re Taxi Industry.
