Site Plan and Subdivision Applications along with Re-Development plans presented to many Planning Boards and Boards of Adjustment, especially those seeking variances or exceptions, have become much more complex, and in many cases, adversarial in the past years. As developable land becomes more scare, applicants often "push the envelope" in trying to maximize the development potential of any particular parcel. This often results in applications seeking extensive variances and or exceptions, as well as complex Planning issues related to conditional uses, prohibited aspects, neighborhood impacts and consistency with development regulations, master plans and neighborhood integrity. Decisions made now can impact a community for generations to come.

Municipalities have the ability and obligation to provide their Board with the best possible information when reviewing and hearing these applications. In many cases municipalities have the opportunity to obtain expert advice in reviewing and analyzing applications before their Planning Boards and Boards of Adjustment, all at the applicant’s expense, without any cost to their taxpayers. This will often result in a better outcome for the community and is often welcomed by applicants, since it helps them more clearly understand the land use goals and objectives of the community.

With almost 40 years of experience as a member of a Planning Board, and as a Professional Planner and Professional Engineer, I have often handled the most difficult applications appearing before our Board and usually prepare a fully detailed Resolution during the course of the actual hearing. These Resolutions have virtually all been upheld in their entirety, even when challenged in court. This is especially true when the decision of the Board results in a denial of the application.
