Void in all other jurisdictions and where prohibited by law. IF YOU ARE NOT A LEGAL RESIDENT OF ONE OF THE ABOVE-INDICATED JURISDICTIONS, DO NOT PROCEED, AS YOU ARE NOT ELIGIBLE FOR THIS CONTEST.

1. Contest Schedule: The YouTube Project Report Contest (the “Contest”) begins on or about 12:00:01 a.m. Eastern Time (“ET”) September 8, 2008 and ends at 11:59:59 p.m. ET January 11th, 2009 (“Contest Period”). YouTube’s computer shall be the official clock of the Contest. During the Contest Period there will be three (3) separate Submission Entry Periods followed by three (3) separate Judging Periods as follows (all times indicated below are ET):

**For Judging Periods 2 & 3, the YouTube Community will also vote on videos submitted. Community Voting will start at 12:00:01 a.m. ET on Start Date and end at 11:59:59 p.m. ET on End Date.

2. Eligibility: The Contest is open only to individuals who (a) are legal residents of Australia, Brazil, Canada, France, Germany, Ireland, Italy, Korea, New Zealand, Spain, The Netherlands, the United Kingdom (England, Northern Ireland, Scotland and Wales)  and the fifty United States and District of Columbia; (b) have reached the Age of Majority in their jurisdiction of residence; (c) are registered members of YouTube in good standing, according to YouTube’s Terms of Use; and (d) are proficient in the English language. No group, club, business or organization entries will be accepted. Employees, officers, directors and members of their immediate families (spouse, parents, siblings and children) or households (whether related or not) of Intel Corporation, The Sony Corporation of America (collectively, the “Sponsors”), YouTube, The Pulitzer Center on Crisis Reporting, or their respective parents, affiliates, subsidiaries, service providers, advertising and promotion agencies, or any or all other companies associated with this Contest (collectively, the “Contest Entities”) and professional journalists or documentary filmmakers are not eligible to participate. “Professional” is defined for the purposes of these Official Rules as an Entrant’s primary profession for which Entrant receives regular compensation for documentary filmmaking or journalism.

3. How to Enter Submission Entry Period 1: To enter during Submission Entry Period 1, visit www.youtube.com/projectreport (“Contest Website”), login using your YouTube membership user ID and password and carefully review all the information contained in the Contest Website. Instructions for creation of a Video Entry will be provided on the Contest Website; these instructions, which are made a part of these Official Rules and incorporated herein by reference, must be fully complied with in order to submit an eligible Entry.  Upload a new Video profile (see below), read and accept the Official Rules by checking the “accept” box and submit your Entry. You will receive a confirmation e-mail from YouTube to the e-mail address you used when creating your YouTube membership. Click on the confirmation link included in that e-mail to confirm your identity and finish the entry process.

Prepare and submit a Video profile which focuses on a single, compelling individual in your local community whose story the world should know about using the video upload link on the Contest Website. Be sure to obtain the consent of the individual (if such individual is a minor in his/her jurisdiction of residence, the consent of his/her parent or legal guardian) before creating and submitting the Video profile. Video profile must fully comply with the Community Guidelines of YouTube, as set forth at www.youtube.com/t/community_guidelines. Videos may be no more than 3 minutes in length and a maximum of 100 MB in size. Acceptable video formats include .WMV, .AVI, .MOV and .MPG files. All videos must be in English dialogue or with English Subtitles. Videos not meeting the above conditions, as determined by the Contest Entities or Judges in their sole discretion, will not be eligible for judging and will be disqualified. All materials and information submitted by an Entrant throughout the entire Contest Period constitute that Entrant’s “Entry” or “Entries”.

Limit one (1) Entry per Entrant during Submission Period 1.

Any information collected on the Contest Website shall be used only in a manner consistent with the consent given by Entrants at the time of Entry, these Official Rules, and the YouTube Privacy Notice, which can be found at www.youtube.com/t/privacy. All Contest information is collected and maintained in the United States.

4. Conditions of Entry: By submitting an Entry during any Submission Period, each Entrant agrees to fully comply with YouTube’s Terms of Use, which can be found at www.youtube.com/t/terms, the YouTube Privacy Notice, YouTube’s Community Guidelines, which can be found at www.youtube.com/t/community_guidelines, these Official Rules, and the decisions of all judges. Each Entrant represents, warrants and agrees:

(a) that his/her Entry is the original work of the Entrant and has not been copied in whole or in part from any other work;

(b) that his/her Entry has not previously been published in any medium or submitted to any other competition or contest;

(c) that his/her Entry does not infringe or violate the rights of any third party, including, but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights or any other intellectual property rights or copyrighted material not owned by Entrant or used without permission (including company names, music, photographs, works of art, images published on or in websites, television, movies or other media) and, to the extent necessary to avoid such infringement the Entrant has obtained all necessary approvals, licenses, permits, rights, assignments, waivers, consents and permissions to all underlying elements, use of non-public figures names in whole or in part (including Entrant’s last name) or other works incorporated into the Entry and Entrant will be able to furnish satisfactory proof of such approvals, licenses, rights, assignments, waivers, consents and permissions to Contest Entities upon request;

(d) that his/her Entry is not subject to any third party agreements, and the Contest Entities will not be required to pay or incur any sums to any person or entity as a result of its use or exploitation of the Entry, Video or ideas contained therein;

(e) that his/her Entry contains no defamatory, profane, threatening, hateful, pornographic, obscene, harassing, or otherwise unlawful material or any material that promotes alcohol, illegal drugs, tobacco, firearms or other weapons, is slanderous, libelous, racist, offensive or otherwise derogatory of any ethnic, religious or other group or promotes violence or harm to another living creature, does not contain any content that is likely to be considered offensive by Contest Entities or could adversely affect the name, reputation or goodwill of the Contest Entities, or any other content deemed inappropriate by Contest Entities, in their sole discretion; and

(f) that no laws were broken in the creation of the Entry.

Entrant further represents and warrants that each and every person depicted in, heard in, or otherwise associated with the Entry, including, without limitation, all Entrants, models, photographers, artists, copy writers, performers, producers and directors (“Involved Third Party”), whether they are actually depicted in the Entry, or whether their appearance, voices, or creative contributions are expressed by or incorporated into the Entry, will have executed the Publicity Waiver and Release by the deadline specified herein [if such individual is a minor in his/her jurisdiction of residence, the Publicity Waiver and Release will have been executed by his/her parent or legal guardian] (see Rule 6 below) and that each of the signatures will be submitted as required by the Official Rules. If an Entrant breaches any of these warranties or the Official Rules, he or she is solely responsible for injury caused by the breach. Entrants agree to indemnify, defend and hold all Contest Entities harmless from and against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to their participation in the Contest, receipt of prize(s) and/or breach of representations and warranties. Group or joint Entries will not be accepted; a single individual must be identified as the producer or Entrant for an Entry.
 
The Contest Entities reserve the right to reject any Entry and disqualify any Entrant which, in their sole and absolute discretion, is determined not to meet any of the above criteria. BY ENTERING THE CONTEST EACH ENTRANT REPRESENTS AND WARRANTS THAT HE OR SHE HAS OBTAINED ALL OF THE RIGHTS, LICENSES AND PERMISSIONS FROM EACH PERSON WHO APPEARED IN OR HELPED TO CREATE THE ENTRY. If the Contest Entities determine, in their sole discretion, that an Entrant has breached a representation or warranty, the Entrant will be disqualified.

5. Judging Period 1/Selection of Qualifiers and Semi-Finalists: All eligible Entries received during Submission Period 1 will be judged by representatives from The Pulitzer Center on Crisis Reporting (“The Pulitzer Center” or “Judges”) based on the following criteria:

(1) Interest of the Topic: Is the story compelling? Does the video make the audience care about the subject of the piece? – 100 points,
(2) Unique Perspective: Is the reporter telling a story that wouldn’t otherwise be reported? – 100 points,
(3) Quality of Reporting: Has the reporter done a thorough job in researching and reporting the story? – 100 points,
(4) Storytelling Method: Is the way in which the reporter has told the story engaging? – 100 points,
(5) Technical execution: Has the reporter effectively used the camera, sound, lighting and editing? – 100 points, and
(6) Overall Impression: Is this a good piece of journalism? – 100 points.

In the event of a tie, all tied Entries will be re-scored by an additional judge selected by The Contest Entities based on criterion #6: Overall Impression – 100 points. Judges’ decisions are final.

The Pulitzer Center will determine the top scoring ten (10) Entries, and the Entrants submitting such Entries will become Semi-Finalists.

The 10 Semi-Finalists will be contacted via the YouTube Messaging System on or about October 13, 2008 by an agent of the Contest Entities. At that time the Semi-Finalists will be invited to participate in Submission Period 2 by completing and submitting a second, different, video assignment, to be provided by the Contest Entities at time of notification. If a Semi-Finalist declines to participate for any reason, that Semi-Finalist will be disqualified, will forfeit his/her Semi-Finalist Prize and the Entrant with the next-highest scoring Qualifier Entry will be invited to participate in Submission Period 2, time permitting. If a Semi-Finalist cannot be confirmed and verified, or does not agree to proceed by the start of Submission Period 2 (see above), that Semi-Finalist spot will not be filled and Submission Period 2 will be conducted with fewer than 10 Semi-Finalists.

6. Submission Period 2: The 10 Semi-Finalists will be invited to participate in Submission Period 2 by completing and submitting a second, different, video assignment, to be provided by the Contest Entities. Submission Period 2 Video Entries may be no more than 4 minutes in length and must meet all other requirements set forth in Rules 3 and 4 above.  (In the event of an inconsistency between Rule 3 or 4 and Rule 6 with regard to Submission Period 2 Video Entries, Rule 6 shall govern.) In addition, the Semi-Finalists and any Involved Third Party associated with the Submission Period 2 Video Entry and/or any subsequent Video Entries (as applicable) must complete and sign a Publicity Waiver and Release (“Release Form”); if any such Involved Third Party is a minor in his/her jurisdiction of residence, the Release Form must be filled out and signed by such Involved Third Party’s parent or legal guardian. Semi-Finalists must also complete and sign an Affidavit/Declaration of Eligibility, Liability Release and Prize Acceptance Form (“Acceptance”) and a Grant of Rights/Waiver of Moral Rights in Video Entry (“Waiver”). The Acceptance, Release Form(s) and Waiver must be returned or Entry will be disqualified (TN residents need not agree to the Release Form). These forms must be properly executed and returned via facsimile (and subsequently by mail), by the end of Submission Entry Period 2 as per the directions provided by the Contest Entities at time of Semi-Finalist notification. If a Semi-Finalist fails to properly execute or return the Acceptance, Release Form and Waiver by the deadline, that Semi-Finalist will be disqualified and his/her Entry in Submission Entry Period 2 will not be judged.

Limit one (1) Entry per Semi-Finalist during Submission Period 2.

7. Judging Period 2/Selection of Finalists: The eligible Entries received from the designated Semi-Finalists during Submission Period 2 will be judged based on the same criteria as in Judging Period 1. Entries from the Semi-Finalists during Submission Period 2 will be scored by representatives from The Pulitzer Center.

The Semi-Finalist Entries will also be posted on the Contest Website at www.youtube.com/projectreport. During Judging Period 2, community members may vote for their favorite Entry in accordance with the restrictions outlined in the Semi-Finalist Community Voting section (Rule 8) below.  In the event of a delay in confirmation of the Semi-Finalists, the Contest Entities reserve the right to change the time and/or dates for voting online and such revised times/dates will be posted on the Contest Website.  The Contest Entities reserve the right to disqualify any Semi-Finalist and post fewer than 10 Semi-Finalist videos for Semi-Finalist Community Voting.

Relative to  posting of Semi-Finalist (and Finalist) Entries, Semi-Finalists/Finalists further acknowledge and agree that (a) while the Contest Entities will seek to accurately present Entries on the Contest Website, the Entries as posted on the Contest Website may differ from the Entries as originally submitted by Semi-Finalist/Finalist due to technological malfunction, error, defect, limitation and/or modifications and the Contest Entities and their agencies shall have no liability related thereto; (b) the Contest Entities may post Semi-Finalist/Finalist Entries in any order, format or pattern, at their sole discretion; and (c) the Contest Entities may append comments/commentary of their sole choosing, to one or more Semi-Finalist/Finalist Entries in their sole and absolute discretion.

8. Semi-Finalist Community Voting:  Limit one (1) online vote per person per Entry per day. A day begins at 12:00:01 a.m. ET and ends at 11:59:59 p.m. ET.  Votes generated by a script, macro, or other automated means will be disqualified.  The Entry with the highest Semi-Finalist Community Vote total during Judging Period 2 will be awarded an additional 300 points; the Entry with the second highest vote total will be awarded an additional 200 points; the Entry with the third highest vote total will be awarded an additional 100 points; and the Entries with the fourth and fifth highest vote totals will be awarded an additional 50 points each.  Entries with the sixth through tenth highest vote totals will receive no points. Voting will be tabulated by an independent Contest Administrator, whose decisions are final. The five (5) Entries with the highest aggregate score (score from the Judges and Semi-Finalist Community Voting) will be declared the Finalists. In the event of a tie, all tied Semi-Finalist Entries will be judged based on the same tie-breaker as in Judging Period 1 (see Rule 5 above).

The five (5) Finalists will be notified via the YouTube Messaging System on or about November 17, 2008 by an agent of the Contest Entities. At that time each Finalist will be invited to participate in Submission Period 3 by completing and submitting a third, different, video assignment, to be provided by The Contest Entities at time of notification. If a Finalist declines to participate, that Finalist will be disqualified, will forfeit his/her Finalist Prize, and the Entrant with the next-highest scoring Semi-Finalist Entry will be invited to participate in Submission Period 3, time permitting. If a Finalist cannot be confirmed, verified, or does not agree to proceed by the start of Submission Period 3, that Finalist spot will not be filled and Submission Period 3 will proceed with fewer than 5 Finalists.

9. Submission Period 3: Each Finalist will be invited to participate in Submission Period 3 by completing and submitting a third, different, video assignment, to be provided by The Contest Entities. Video Entries may be no longer than 5 minutes in length and must meet all of the other requirements set forth in Rules 3 and 4 above. (In the event of an inconsistency between Rule 3 or 4 and Rule 9 with regard to Submission Period 3 Video Entries, Rule 9 shall govern.) Videos not meeting the above conditions will not be eligible for judging.

Limit one (1) Entry per Finalist during Submission Period 3.

10. Judging Period 3/Selection of the Grand Prize Winner: The eligible Entries received by the Finalists during Submission Period 3 will be judged based on the same criteria as in Judging Periods 1 and 2. Finalist Entries will be scored by the Judges.

The five (5) Finalist Entries will be posted on the Contest Website at www.youtube.com/projectreport.  During Judging Period 3, community members may vote for their favorite Entry in accordance with the restrictions outlined in the Finalist Community Voting section below. In the event of a delay in confirmation of the five (5) Finalists, the Contest Entities reserve the right to change the time and/or dates for voting online and such revised times/dates will be posted on the Contest Website. The Contest Entities reserve the right to disqualify any Finalist and post fewer than five (5) Finalist videos for Finalist Community Voting.

11. Finalist Community Voting:  Finalist Community Voting is subject to the same conditions and Entries will be scored using the same procedure as in the Semi-Finalist Community Voting; see Rule 8 above. The Finalist Entry with the highest aggregate score (score from The Pulitzer Center and the Finalist Community Voting) will be declared the Grand Prize Winner, subject to verification. In the event of a tie, all tied Finalist Entries will be judged based on the same tie-breaker as in Judging Periods 1 and 2.

12. Secondary Entries: During Submission Periods 2 and 3 (when during each Submission Period to be determined by the Contest Entities in their sole discretion), the video assignments previously given only to the Semi-Finalists (in Submission Period 2) and the Finalists (in Submission Period 3) will be posted for public viewing on the Contest Website. Entrants who were not chosen as Semi-Finalists or did not participate in Submission Period 1 may create and submit an Entry using the assignment for Submission Period 2 during Submission Period 2 (once the video assignment has been posted for public viewing), to compete for a secondary prize. Entrants who were not chosen as Semi-Finalists, Finalists or did not participate in either Submission Period 1 or Submission Period 2 may create and submit an Entry using the assignment for Submission Period 3 during Submission Period 3  (once the video assignment has been posted for public viewing), to compete for a secondary prize. Limit one (1) Submission Period 2 Secondary Entry and one (1) Submission Period 3 Secondary Entry per person.

Secondary Entries must fully comply with the terms and conditions applicable to Semi-Finalist Video Entries (for Submission Period 2 Secondary Entries) or Finalist Video Entries (for Submission Period 3 Secondary Entries), as appropriate, as set forth in these Official Rules above.

Secondary Entries that are timely received and otherwise eligible in accordance with these Official Rules will be judged using the same criteria as in Judging Period 1, with the same weight being given to each criterion (100 points each) and with the same tie-breaker (if necessary); see Rule 5 above. All Secondary Entries will be scored by the same Judges serving as the judging panel for Judging Period 1. The Submission Period 2 Secondary Entry with the highest score will be declared the Submission Period 2 Secondary Prize Winner. The Submission Period 3 Secondary Entry with the highest score will be declared the Submission Period 3 Secondary Prize Winner. Judges’ decisions are final.

13. Prizes: 1 Grand Prize: a $10,000US travel grant and the opportunity to work with The Pulitzer Center in the development of an international reporting project. Grant will be awarded in the form of two (2) separate checks: $5,000US upon The Pulitzer Center's approval of the international reporting project and $5,000US upon the satisfactory completion of that project.
5 Finalist Prizes: 1 Sony® Handycam® Digital Camcorder with case. Manufacturer’s Suggested Retail Price (“MSRP”): $1,250US/$1,325CAD. Additionally, each of the 5 Finalists will receive 5 additional Handycam Digital Camcorders to assist in the completion of the 3rd video assignment (described above). Additional camcorders will be shipped to Finalists at time of Finalist notification and must be returned to the Contest Entities upon completion and submission of Finalist Video Entry. Return instructions (including pre-paid return shipping cartons) will be included at time of delivery.
10 Semi-Finalist Prizes: 1 Sony® Vaio® Z Laptop Computer. MSRP: $2,350US/$2,495CAD, and a 3-day/2-night trip for the Semi-Finalist to attend the Pulitzer Center Journalism Summit December 12 – 14, 2008 in Washington, DC, United States. Travel dates and travel destination are tentative and subject to modification by The Pulitzer Center, therefore, winner must have flexible travel capabilities. Trip includes round-trip coach class air transportation for Semi-Finalist from a major commercial airport closest to winner’s residence and a major commercial airport near the Journalism Summit destination (airports to be determined by The Contest Entities in their sole discretion), 2-nights standard hotel accommodations (single occupancy), attendance at the Journalism Summit, and $300US spending money. Approximate Retail Value (“ARV”) of each trip: $1,500US/$1,590CAD. Actual value of trip may vary, depending on date/time/point of departure/destination, and difference between the stated ARV and actual value will not be awarded. Total ARV of each Semi-Finalist Prize: $3,850XUS/$4,085CAD.

1 Submission Period 3 Secondary Prize: Sony® Vaio® Z Laptop Computer. MSRP: $2,350US/$2,495CAD.

Total ARV of all prizes available: $58,350US/$61,895CAD  

All properly claimed prizes will be awarded provided a sufficient number of eligible Entries are received, but in no event will the Contest Entities award more prizes than are provided for in these Official Rules. Prizes are non-transferable except at the Contest Entities’ sole discretion. No substitutions or cash redemptions except at the Contest Entities’ sole discretion due to unavailability of prize/prize component for any reason, in which case a prize/prize component of equal or greater value will be awarded.  In the event a Prize Winner is located outside of the United States, the Contest Entities may, in their sole discretion, award a pre-paid Gift Card in the amount of the ARV listed above in lieu of indicated merchandise prize. All federal, state, provincial and local taxes, as well as any and all travel insurance and any other unspecified expenses associated with acceptance or use of prize(s) are the sole responsibility of the winners.

For Semi-Finalist prize, all travel arrangements must be made with the Contest Entities’ travel agent. Travel is subject to availability and must be completed on dates specified by the Contest Entities or prize will be forfeited. Some restrictions may apply. Winner must travel on itinerary of the Contest Entities’ sole choosing. No cancellation of reservation or transfer of reservation to another date after reservation has been made. If the Journalism Summit is canceled or postponed for any reason, the Contest Entities shall have no further obligation to the winner other than to provide the travel portion of the prize minus the attendance at the Journalism Summit. Winners are solely responsible for obtaining any necessary travel documents, including passports and visas, if necessary.  If a Semi-Finalist resides within a 100-mile radius of the Journalism Summit location (currently, Washington, DC), ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in prize value.

14. Claiming Prizes:  Awarding of prizes is subject to verification of Entry, and full compliance with these Official Rules. Winners of Grand/Finalist/Semi-Finalist Prizes cannot also win Secondary Prizes. Potential prize winners will be required to execute and return (except where prohibited by law) an Acceptance, Release Form and Waiver (as defined above, collectively, “Verification Forms”) within the indicated time period, per the Contest Entities’ directions. In the event of non-compliance with these Official Rules, if a potential winner or Entry is deemed ineligible, declines prize or fails to complete or return Verification Forms within the time period specified by the Contest Entities, or Verification Forms or prize is returned as undeliverable, prize will be forfeited and awarded to the Entrant with the next highest score in the applicable Submission Entry Period, time permitting.  Prizes will be shipped within 6 – 8 weeks from receipt of Verification Forms. 

By participating in the Contest, all Entrants acknowledge full compliance with and agree to be bound by these Official Rules, the decisions of the Contest Entities and/or Judges, which are final in all respects, and all applicable federal, state, provincial and local laws and regulations.

15. Conditions: Any attempt by any Entrant to submit more than the allowed number of Entries using multiple/different identities or any other methods will void such Entries and that Entrant may be disqualified. By entering this Contest, and to the extent allowed by law, Entrants grant Contest Entities and each of their affiliates licensees, promotional partners and third party marketing entities the absolute, worldwide, perpetual right and permission to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, exploit, create derivative works of and use the content of and elements embodied in the Entries and any other submissions related to the Contest and the Entries themselves, in perpetuity in any and all media, including by not limited to digital and electronic media, computer, audio and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial or any other purposes without further review, notice, approval, consideration, or compensation. Entrants waive and release the Contest Entities and each of their affiliates from any and all claims that Entrant may now or hereafter have in any jurisdiction based on any claims, including, but not limited to, “moral rights” or “droit moral” or unfair competition with respect to Contest Entities’ exploitation or Entries without further notification or compensation to Entrants of any kind, and agree not to instigate, support, maintain or authorize any action, claim or lawsuit against the Contest Entities and each of their affiliates, licensees, or any other person in connection with this Contest, on the grounds that any use of any entry, or any derivative works, infringe or violate any Entrant’s rights therein.  By entering this Contest, Entrants agree that the Contest Entities and each of their affiliates, licensees, promotional partners and third party marketing entities shall have the right and permission to use their name, picture, voice, biographical data, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof), and/or any information contained in his/her Entry  for promotional, advertising and/or publicity purposed in any media, now or hereafter known, throughout the world in perpetuity, without compensation or notice to, or further consent of, to the winner to the extent permitted by law. The Contest Entities are not obligation to enter into any correspondence, including e-mail, with non-winning Entrants. Submitted Entries will not be acknowledged or returned, and no correspondence thereafter will be entered into by The Contest Entities with Entrant. Any Entry or vote not in compliance with these Official Rules, or made via robotic, automated, mechanical, macro, programmed or like method will void all such entries or votes (as applicable) and disqualify any Entrant using such methods (if applicable). The Contest Entities reserve the right to disqualify any person found or suspected of tampering with the Entry process, the Community Voting process or the operation of this Contest, to be acting in violation of these Official Rules, to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. 

16. Authorized Account Holder and Cancellation: In the event of dispute as to who submitted an Entry, the Entry will be deemed submitted by the Authorized Account Holder of the e-mail address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures or any other causes which the Contest Entities deem could corrupt or affect the administration, security, fairness or proper conduct of this Contest, the Contest Entities reserve the right at their sole discretion to cancel, modify, suspend or terminate the Contest and select the winners in a manner deemed fair, equitable and in accordance with these Official Rules by the Contest Entities in their sole discretion. Notice of such action will be posted at www.youtube.com/projectreport.


17. Limitations of Liability: Each Entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Judges and warrants that they are eligible to participate in this Contest. By participating in this Contest, Entrants agree to release and hold harmless Contest Entities, their respective affiliated companies, subsidiaries, printers, advertising and promotion agencies and each of their respective employees, officers, directors, representatives and agents (collectively, the “Releasees”)  from and against any and all claims, injuries, losses, liability and/or damages of any kind, including reasonable attorneys’ fees and expenses asserted against any of them incurred, sustained or arising in conjunction with, to persons, including death, or property arising in whole or in part, directly or indirectly, from acceptance, use or misuse of prize(s), participation or while preparing for participation in, inability to participate in and/or travelling to or from Contest or any Contest-related activity, or from the respective Entrants’ breach or alleged breach of any agreement or warranty associated with the Contest, including these Official Rules. Releasees are not responsible for printing errors nor for lost, late, unintelligible, misdirected, incomplete, damaged or garbled Entries, Acceptance, Waiver or Release Forms, or any other documents. Releasees are not responsible for any: (a) telephone, computer, hardware, software, programming or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process Entries or post Entries on the Contest Website (as applicable); (b) communication disruption or other forces beyond the control of the Contest Entities, including inability to access the Contest Website, submit Entries or other disruption related to Internet traffic, virus, bug, or non-authorized intervention; (c) damage caused by computer virus or otherwise resulting to any computer from entrant's access of the Contest Website, whether human, mechanical or electronic; or (d) incorrect or inaccurate information whether caused by Contest Website users or by any of the programming or equipment associated with or used in the Contest. Proof of submitting information at Contest Website is not considered proof of delivery or receipt.

Any attempt by an entrant to deliberately damage any Website or undermine the legitimate operation of this Contest (including, but not limited to, attempts to manipulate the voting or otherwise defraud the Contest Entities) is a violation of Criminal and Civil Laws. Should such an attempt be made, the Contest Entities reserve the right to seek damages from any such individual to the fullest extent permitted by applicable law in addition to disqualification of such individual (if applicable).

Releasees shall not be liable to any winner or any other person for failure to supply a prize or any part thereof, by reason of any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entities (whether or not they prove to be valid); equipment failure; terrorist acts; earthquake; fire; flood; war; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond the Contest Entities' sole control. Releasees shall not be liable to any winner or any other person for damage to such person’s computer or its contents.

18. Choice of Law/Disputes: To the fullest extent permitted by law, Entrants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with these Official Rules or this Contest (and/or the rights and obligations of The Contest Entities and/or Entrant in conjunction therewith) shall be resolved individually, without resort to any form of class action, and exclusively by an action in state or federal court in the State of California, USA (and, Entrants expressly waive any objection based on venue, forum non conveniens or similar right and expressly accept the personal and subject matter jurisdiction of such courts); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys’ fees; (c) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (d) TO WAIVE AND HEREBY DO WAIVE THEIR RIGHT TO A TRIAL BY JURY IN ANY SUCH ACTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or this Contest (and/or the rights and obligations of The Contest Entities and/or Entrant in conjunction therewith) shall be governed by, and construed in accordance with, the laws of the State of California, USA except for the Choice of Law/Conflict of Law Rules of California or of any other jurisdiction. If any provision of these Official Rules is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Official Rules, which shall remain in full force and effect.

19. Non-Confidentiality: Each Entrant herby acknowledges and agrees that the relationship between the Entrant and the Contest Entities is not a confidential, fiduciary or other special relationship, and that the Entrant’s decision to provide an Entry via YouTube for purposes of this Contest does not place the Contest Entities in a position that is any different from the position held by members of the general public with regard to elements of the Entry, other than as set forth in these Official Rules. Each Entrant understands and acknowledges that the Contest Entities have wide access to ideas, stories, designs and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each Entrant further acknowledges that many ideas or stories may be competitive with, similar to, or identical to his/her Entry and/or each other in theme, idea, plot, format or other respects. Each Entrant acknowledges and agrees that such Entrant will not be entitled to any compensation as a result of the Contest Entities’ use of any such similar or identical material that has or may come to the Contest Entities, or any of them individually, from other sources. Each Entrant acknowledges and agrees that the Contest Entities do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory or otherwise, with respect to the infringement or protection of that Entrant’s copyright in and to the submission. Finally, each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of any Contest Entities’ actual or alleged exploitation or use of any submission or other material submitted in connection with this Contest, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of any program, website, advertising, materials or other thing based on or allegedly based on the Entry, and Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action of law.

20. Winner’s List: A list of Contest Winners will be posted on www.youtube.com/projectreport after December 18, 2008 and remain posted until at least February 1, 2009. Additionally, a list of winners may be requested by sending a business-sized, self-addressed, stamped envelope by December 16, 2008 to: YouTube Project Report Contest Winners List Requests, attn: A.
