"Town of Merton" Ordinance

AN ORDINANCE TO CREATE §20.06(2A) AND §20.06(2B)

OF THE GENERAL CODE OF ORDINANCES OF THE TOWN OF

MERTON RELATING TO ESTABLISHING AN EMERGENCY

SLOW NO  WAKE SPEED LIMIT AT TIMES OF HIGH WATER

ON OKAUCHEE LAKE, UPPER OCONOMOWOC LAKE, LAKE

KEESUS, MOOSE LAKE AND NORTH LAKE

            The Town Board of Supervisors of the Town of Merton, Waukesha County, Wisconsin, do ordain as follows:

 

            SECTION 1.  Section 20.06(2A) is created to read:

 

20.06 OKAUCHEE LAKE, UPPER OCONOMOWOC LAKE,  LAKE KEESUS,      MOOSE LAKE AND NORTH LAKE.

 

(2A)    EMERGENCY SLOW NO WAKE SPEED AT TIMES OF HIGH WATER 

                      ON OKAUCHEE LAKE.

 

            (a)      Definitions.

 

1.         “High water” means when the waters of Okauchee Lake and Upper Oconomowoc Lake exceed an elevation of 875.1 msl as based upon the USGS benchmark and/or when the Chairman of the Town Board of Supervisors of the Town of Oconomowoc or the Chairman of the Town Board of Supervisors of the Town of Merton determine conditions warrant declaring that an emergency exists requiring reduced boat speed.  When the high water elevation has been reached, either Town Chairman may make the high water declaration. 

 

2.         “Slow no wake” has the meaning specified in §30.50(12), Wis. Stats.

 

3.         “Motorboat” has the meaning specified in §30.50(6), Wis. Stats.

 

(b)       Slow No Wake Speed Required.  No person shall operate a motorboat at a speed in excess of slow no wake on Okauchee Lake and Upper Oconomowoc Lake for a period commencing two hours after a high water condition has been declared until the declaration of the high water condition is repealed.

 

(c)        Notice.  Notice of a high water condition shall be posted at the public launch site at Road T in the Town of Oconomowoc or at the commercial boat launch at the Golden Mast, also in the Town of Oconomowoc, by publication of a notice in the Lake Country Reporter, and by public service announcements on radio and television.  The posted notice shall state the time of the declaration of a high water condition. 

 

(d)       Posting Requirements.  This ordinance shall be posted at the Department of Natural Resources boat launch on Road T and at the Golden Mast launch site.

 

(e)       Criteria to Become Effective.  This ordinance shall not become effective unless the Town of Oconomowoc and Town of Merton, having jurisdiction over the lakes, have enacted identical ordinances. 

 

SECTION 2.  Section 20.06(2B) is created to read:                   

 

20.06 OKAUCHEE LAKE, UPPER OCONOMOWOC LAKE, LAKE KEESUS, MOOSE LAKE AND NORTH LAKE.

 

(2B)    EMERGENCY SLOW NO WAKE SPEED AT TIMES OF HIGH WATER 

                      ON LAKE KEESES, MOOSE LAKE AND NORTH LAKE.

 

            (a)      Definitions.

 

1.         “High water” means when the waters of Lake Keesus, Moose Lake and North Lake reach an elevation where wave action will potentially damage piers or other shoreline facilities and will cause erosion to the shoreline to the detriment of the environment and the water resource and when the Chairman of the Town Board of Supervisors of the Town of Merton determine conditions warrant declaring that an emergency exists requiring reduced boat speed.  In the opinion of the Town Chairman, when the high water elevation has been reached, the Town Chairman may make the high water declaration. 

 

2.         “Slow no wake” has the meaning specified in §30.50(12), Wis. Stats.

 

3.         “Motorboat” has the meaning specified in §30.50(6), Wis. Stats.

(d)       Posting Requirements.  This ordinance shall be posted at the Moose Lake Department of Natural Resources public boat launch on CTH “C”, at the Lake Keesus Town of Merton public launch site at Woodrest Road, and at appropriate locations in the vicinity of North lake.

 

            SECTION 3.  EFFECTIVE DATE.  This ordinance shall become effective upon passage, posting and publication as required by law.
