Fair Debt Collection Act 

Through the Fair Debt Collection Practices Act, consumers are protected from third party debt collectors who engage in unfair deceptive or abusive practices. Debt collectors:

(1) cannot call before 8:00 am or after 9:00 pm.

(2) cannot make false statements or use abusive language.

(3) must provide documentation of what is owed.

(4) must stop calling consumers at work upon request.

(5) must not communicate with consumers about the debt in the future if requested.

Consumers can dispute a debt in writing within 30 days of being contacted by a collector.

Additionally, certain attorney debt collection letters and certain unsolicited credit offers may violate the Fair Debt Collection Practice Act, and those documents may be sent to Shenwick & Associates by fax or e-mail for review.
