DILGs ADM and MASA MASID, Phl entry to Open Government Partnership

Not one but two programs of the Department of the Interior and Local Government(DILG)are in the top choices for the country’s entry to the international Open Government Partnership (OGP).

These are the Assistance to Disadvantaged Municipalities(ADM)followed by Mamamayang Ayaw Sa Anomalya, Mamamayang Ayaw sa Iligal na Droga(MASA MASID).

According to the DILG, the nomination of their two new programs to the OGP bolsters their workforce to ensure proper implementation of both programs for the benefit of the Filipinos.

OGP is a global effort that aims to secure concrete commitments from governments to promote transparency,empower citizens,fight corruption,and harness new technologies to strengthen governance.

The Philippines is one of the eight founding countries of the OGP in 2011,including United Kingdom and United States.

Since its founding, 75 participating countries and 15 subnational governments have made over 2,500 commitments to make their governments more open and accountable.

Through ADM, the Philippines commits to strengthen civil society participation in local planning and development to further improve local governments’ delivery of basic services,”says DILG Undersecretary for Local Government Austere Panadero.

He said that ADM aims to contribute to the full attainment of empowered,responsible,and responsive local government units(LGUs).

Under ADM,the national government transfers funds to municipalities after complying with good governance standards particularly the DILG Seal of Good Financial Housekeeping and the assessment of their Public Financial Management Systems and adoption of corresponding improvement measures.

The fund is used for needed projects identified by 1,373 municipal governments and local civil society organizations. This include water system,evacuation facility,local access roads,small water impounding,sanitation,and health facilities.

Panadero shares that ADM is following a five-year governance road map that generally aims to contribute to the attainment of a fully decentralized basic service delivery in all municipalities. This year, it aims to make Local Development Councils(LDCs)fully functional.

On the other hand,DILG Assistant Secretary for Barangay Affairs and Community Development Roosque Calacat says that through MASA MASID,the country commits to adopt a multi-sectoral and mass-based approach to engage volunteers in the fight against illegal drugs,criminality, and corruption.

MASA MASID is implementing two strategies:advocacy and education campaign;and information gathering,reporting,and monitoring,”he says.

He points out that 18,932 MASA MASID Teams in 802 cities and municipalities have already been trained.

According to the Department of Budget and Management(DBM),ADM is first choice while MASA MASID ranked third among 14 government programs under the Philippine OGP Plan 2017-2019.

DBM says that the voting was facilitated by the Philippine OGP Steering Committee,comprised of government and civil society representatives.

National and local government,civil society,business groups,academe,public sector unions, international development partners,and media voted during the committee’s regional consultations done in the third quarter of 2016.

The Philippine OGP Plan 2017-2019 is part of the requirements to be a member of OGP. Participating countries are required to endorse a high-level Open Government Declaration, deliver a country action plan developed with public consultation,and commit to independent reporting on their progress going forward.###

Sec. Taguiwalo seeks approval for a ‘pro-poor, pro-people’ 2018 DSWD budget

Department of Social Welfare and Development (DSWD) Secretary Judy M. Taguiwalo yesterday presented to the members of the House Committee on Appropriations the proposed budget of the Department for 2018.

“Narito ako ngayon sa diwa ng pakikipagkaisa para bumuo ng isang makatarungan, maka-mahirap, at maka-mamamayang budget para sa mamamayang Pilipino (I am here in solidarity to craft a just and a pro-poor and pro-people budget for our fellow Filipino citizens),” Sec. Taguiwalo said in her opening statement.

“Handa akong makipagtulungan sa layuning tiyakin na ang mga rekurso ng gobyerno na dumadaan sa DSWD ay magagamit ng tama at wasto, at walang napupunta sa katiwalian. Ito ang tagubilin sa akin at sa ating lahat ni Pangulong Duterte, at ito din ang aking personal na prinsipsyo at kinikilalang tungkulin (I am ready to work with you with the goal to ensure that the resources of the government, coursed through the DSWD, will be used right and without any trace of corruption. This is the instruction of President Rodrigo Duterte to us and this is also my guiding principle),” she added.

The proposed budget of the DSWD for 2018 amounts to P137,556,963,000, higher by 7.41 percent from the previous year’s approved budget.

According to Sec. Taguiwalo, the increase in the amount can be attributed to higher personnel services for the salary adjustments of staff based on Salary Standardization Law (SSL 4) and an increase in maintenance and other operating expenses (MOOE) of the Department for the health benefits of all Pantawid Pamilyang Pilipino Program (4Ps) beneficiaries.

“Last year, 1.3 million beneficiaries of 4Ps were removed under the impression that they have already crossed, but we informed the Department of Budget and Management (DBM) that we are still in the process of validating this, so they returned the allocation for the health benefit. Hence, the increase in the budget” Sec. Taguiwalo explained.

The DSWD has a total of 29 programs, activities, and projects under its 2018 proposed budget, three (3) of which have had their allocations cut due to low utilization.

“The top eleven programs of the Department with the highest amount of allocated funds in the 2018 proposed budget include 4Ps with P89.4 billion for 4.4 million beneficiaries; the Social Pension for Indigent Senior Citizens with P19 billion for 3 million beneficiaries; Sustainable Livelihood Program (SLP) with P7 billion for 345,957 poor household beneficiaries; Kalahi-CIDSS community-driven development (CDD) program with P5  billion for 308, 961 poor household beneficiaries; and the Protective Services Program for Individuals and Families in Difficult Circumstances, which has been allotted P3.5 billion,” Sec. Taguiwalo reported.

The programs also include the Supplemental Feeding Program (SFP) with P3.4 billion for 1.7 million children beneficiaries; Disaster Response Rehabilitation with P2 billion for 364,300 individual beneficiaries; provision for center-based clients with P1.5 billion for a target of 11,733 clients­; and Tax Reform Cash Transfer Program with P1.1 billion, which has been included by the DBM and the Department of Finance (DOF) as budget for administrative cost for P200 per month for one (1) year cash transfer program for 10 million poorest Filipino households.

Also included is the Technical Advisory Assistance and Other Related Support Services, a program that capacitates Local Government Units (LGUs), with P891 million; and the Bangsamoro Umpungan sa Nutrisyon (BangUn) Project or the feeding program for malnourished children in Autonomous Region of Muslim Mindanao as directed by Pres. Duterte, with P156 million budget.

The DSWD is ranked 6th in the list of national government agencies (NGAs) with the highest budget allocation for 2018.

Inter-agency efforts in fighting poverty

During the budget deliberation, Sec. Taguiwalo emphasized the importance of close coordination and cooperation between different government agencies in efforts to fight poverty.

“We would like to reiterate that the programs and services of the DSWD are in the final analysis only stop-gap measures when compared to the gaping holes that need to be filled when it comes to addressing widespread and deepseated poverty of the large majority of the Filipino people. It will take the whole of government to fight poverty. Inter-agency efforts are very important,” she explained.

“LGUs and national government agencies must work together to implement genuine social welfare & support programs for the poor nationwide. We want better, more sustainable programs that will empower them and make them independent, helping them fight poverty,” Sec. Taguiwalo added.

“The work load in the Department is enormous, and the problems we face are myriad because they are tightly connected to and rooted in the systemic poverty the Filipino people. We are a department that works very, very hard to serve the poor and those in need, and the duty of the leadership is to protect the DSWD’s resources and ensure that funds are utilized properly and correctly so they directly benefit our clients and beneficiaries who are among the poorest of the poor and the most neglected sectors of Philippine society,” she said.

Present during the 2018 budget hearing were the members of the executive and management committees of the DSWD, the executive directors of its three (3) attached agencies, the regional directors of all field offices, and some employees of the Department. ###

Gov’t to focus on “human side” of Marawi rehab; Reaffirms commitment to provide immediate needs of IDPs

The government task force mandated to spearhead the reconstruction and recovery of Marawi assured the public of its unremitting efforts to address the “human side” of the city’s post-conflict rehabilitation phase.

In a press briefing in Malacañan on Friday, August 11, Office of Civil Defense (OCD) Assistant Secretary Kristoffer James Purisima stressed that the government is taking a more “proactive approach” to rehabilitate communities affected by the ongoing rebellion in Mindanao.

He said Task Force Bangon Marawi remains focused on promptly responding to the needs of internally displaced persons (IDPs) currently staying in evacuation centers and even those who are home-based.

“Remember our stance, whenever there are disasters, whether natural or man-made, proactive tayo. We do not wait to respond. We prepare in order to prevent anything from escalating,” Purisima said.

Purisima said that on top of the physical aspects of the city's reconstruction, the government will do all it can to provide the mental health and psychosocial services that the IDPs need.

“Alam naman natin na dahil matagal na ang ating mga kababayan sa evacuation centers, syempre meron din silang mga nararamdaman… I’d like to believe that is part of our psychosocial intervention… to understand what they’re feeling,” Purisima noted.

“Kasama ‘yan doon sa sinabi ko… na 'human side' ng ating Post-Conflict Needs Assessment. Kasi we’re not just rebuilding a city. We’re rebuilding the lives of people and communities,” he added.

To date, Purisima said around 30,000 displaced Filipinos have availed of the government’s mental health and psychosocial services, which include psychosocial first aid, stress debriefing, and psychiatric treatments to varying age groups.

Purisima clarified that although they do not consider the mental health situation among IDPs as alarming, they are nevertheless prepared to go beyond the basic services and intensify their response for more serious mental health cases.

“I should note that there are a few recorded cases of mental issues. But these are addressed by DOH (Department of Health)… And if there are documented cases, we will respond accordingly,” he assured.

“Kung may kailangan na heightened or elevated level of response or intervention, ibibigay natin ‘yun. Kung kailangan ng most basic, ibibigay rin natin ‘yun… All I can assure the people is that we are providing everything we can for our IDPs on the ground,” he added.

Meanwhile, Purisima said the Singapore Ministry of Defense handed over relief items and equipment for IDPs from Marawi and other affected localities.

Purisima said the Singapore Air Force facilitated the transport of relief items last Monday, August 7, at Laguindingan Airport. The items were immediately transported to Iligan City for eventual distribution.

As for the ASEAN relief distribution, Purisima said a total of 360 personal hygiene kits and one water filtration unit were distributed to the IDPs in evacuation centers located in Iligan city, while a total of 1,655 personal hygiene kits, 432 family kits, and 432 kitchen sets were provided for the home-based IDPs.

For his part, Armed Forces of the Philippines (AFP) spokesperson Brig. Gen. Restituto Padilla clarified that incentives for reports and information provided by civilians and other partners that will lead to the neutralization or the arrest of any member of the NPA, particularly in the island of Negros, was an initiative on the part of the local government.

“We do welcome this initiative on the part of the local government, particularly in Negros. Because we know that they are already fed up with the abuses that are being committed and the violent activities that are being done by this armed group, which has degenerated into a bandit group, primarily concentrating on extortion and arson,” Padilla said.

Padilla expressed hopes that the initiative on providing incentives for the capture of NPAs will be replicated in other areas that are facing similar problems.

Padilla also gave assurance that this will not lead to moneymaking activities by bounty hunters.

“Payments are not given unless the information provided was proven to have been accurate and it led to the arrest or neutralization of a known suspect,” Padilla explained.

“So if these people have arrest orders that have been issued already to them and have been identified and seen somewhere and were reported and led to their arrest, then the bounty will be provided,” he said.

 

Abella welcomes Senate Special Committee on Marawi

During the same press briefing, Presidential Spokesperson Ernesto Abella welcomed the passage of Senate Resolution No. 457, which establishes the Senate Special Committee on Marawi.

Abella noted that the said committee would complement the work of Task Force Bangon Marawi, which is an initiative of the Executive branch of government.

“Indeed, the extent of the damage in Marawi and the suffering of the displaced people need everyone’s assistance and cooperation,” Abella said.

“This is the time to unite as one nation in rebuilding Marawi, which is now in ruins, into a model Islamic city,” he added.

Meanwhile, Abella announced the completion of the Quezon Avenue Flood Control Project in a bid to improve the traffic situation.

He noted that the completion was made possible by the “24/7 construction scheme” of the Department of Works and Public Highways.

The 1.1-kilometer structure includes two additional lanes, measuring 820.62 lineal meters, and will serve as an alternative route to EDSA and to Timog Avenue. ### (PND)

9 August 2017 – Ten years after the adoption of the Declaration on the Rights of Indigenous Peoples, progress in several countries has been made in formally recognizing indigenous peoples, but overwhelmingly they continue to face discrimination, marginalization and major challenges in enjoying their basic rights.

“While indigenous peoples have made significant advancements in advocating for their rights in international and regional fora, implementation of the Declaration is impeded by persisting vulnerability and exclusion, and exclusion, particularly among indigenous women, children, youth and persons with disabilities,” said 40 UN system entities and other international organizations in a joint UN statement, issued on the occasion of the International Day of the World's Indigenous Peoples, marked annually on 9 August.

The Declaration, which was adopted by the UN General Assembly on 13 September 2007, establishes a universal framework of minimum survival standards for the dignity and well-being of the world's indigenous peoples. It is the most comprehensive international instrument on indigenous peoples' collective rights, including the rights to self-determination, traditional lands and culture.

Declaration on indigenous rights stands as “beacon of progress”

“The Declaration, which took more than twenty years to negotiate, stands today as a beacon of progress, a framework for reconciliation and a benchmark of rights,” underscored Victoria Tauli-Corpuz, Special Rapporteur on the rights of indigenous peoples, Mariam Wallet Aboubakrine, Chairperson of the UN Permanent Forum on Indigenous Issues, and the Expert Mechanism on the Rights of Indigenous Peoples in a joint statement on the Day.

“But a decade on, we need to acknowledge the vast challenges that remain. In too many cases, indigenous peoples are now facing even greater struggles and rights violations than they did ten years ago,” they added.

Although some countries have taken constitutional and legislative measures to recognize their rights and identities, exclusion, marginalization and violence continue to be widespread.

With this in mind, Irina Bokova, Director-General of the UN Educational, Scientific and Cultural Organization (UNESCO) said that as custodians and practitioners of unique cultures and relationships with the natural environment, indigenous peoples embody a wide range of linguistic and cultural diversity at the heart of our shared humanity.

“Protecting their rights and dignity is protecting everyone's rights and respecting humanity's soul, past and future,” she said, noting that UNESCO's latest Global Education Monitoring Report provides concrete guidance and policy advice for the advancement of indigenous peoples' rights. The agency also launched the Local and Indigenous Knowledge Systems (LINKS) programme in 2002 to support governments in creating synergies between scientific and indigenous peoples' knowledge.

Voice and empowerment of indigenous women “more important than ever”

For its part, the UN labour agency said the international community must also renew its commitment to promote the empowerment and voice of indigenous women, according to a

While commending the tenth anniversary of the Declaration, along with its own Indigenous and Tribal Peoples Convention, 1989 (No. 169) as instruments guiding public policy and empowering “indigenous communities to pursue their own development priorities,” the International Labour Organization's (ILO) underscored that the situation is far from acceptable.

“Indigenous peoples constitute a disproportionate 15 per cent of the world's poor whereas they are an estimated five per cent of the world's population. Indigenous women are commonly the poorest of the poor, discriminated against because they are indigenous and because they are women,” ILO stressed in a statement.

The statement pointed out that their marginalization and social exclusion must be addressed to achieve the Sustainable Development Goals (SDGs) of the UN 2030 Agenda.

“Our combined efforts – governments, employers' and workers' organizations, indigenous peoples and their organizations, UN partners and others – can go a long way in ensuring that indigenous peoples are not left behind,” concluded the ILO statement.

As Indigenous experts from Canada, Republic of the Congo, Ecuador and Namibia will celebrate the Day at a special event at UN Headquarters in New York, UN offices globally are also holding events and activities, including in Australia, Brazil, Colombia and Mexico.

The UN partnered with Twitter to create a special emoji for the Day, which, with the hashtags #WeAreIndigenous and #IndigenousDay, will be live from 8 August to 15 September as “a new way to engage broader audiences in promoting indigenous peoples' rights.”

National Government spending jumps by 22.6 percent in June 2017, the highest increase thus far


For the month of June, national government spending posted an impressive 22.6 percent growth rate (compared to June 2016), the highest increase so far in FY 2017. This places disbursements at about P1.331 trillion for the first semester, with a minimal shortfall of 0.4 percent vis-a-vis the programmed P1.337 trillion disbursements. This also raises national government spending by 9 percent for the first semester year-on-year.

The accelerated spending in June is attributed to the robust growth in Current Operating Expenditures and Capital Outlays, which increased by 18.4 percent and 34.9 percent respectively. Substantial transfers to government corporations, higher personnel expenditures, and faster utilization of cash allocations by line agencies (typically observed in the third month of the quarter) all buoyed spending in the said time period. In particular, some of the major expenses that contributed to the growth in spending are the following:

Subsidies to government corporations reached P32.3 billion (a 101.3 percent increase year-on-year), owing largely to the P12 billion budgetary support to the NHA as payment for its completed housing projects to support informal settler families and calamity victims; P9.3 billion to the PHIC for the health insurance premiums of senior citizens; and P5.7 billion to NIA for its completed irrigation projects.

Personnel services amounted to P67.1 billion (13.9 percent higher year-on-year) to cover the pension requirements, retirement and terminal leave benefits of employees mostly in the DILG, DND; and the creation and filling of positions in the DepED, DPWH, SUCs, among other agencies.

Infrastructure and other capital outlays reached P51.9 billion (11.4 percent higher year-on-year) due to the implementation of road projects by the DPWH; payments for completed irrigation projects by the NIA; and some capital outlay projects of SUCs for the purchase, construction and renovation of equipment and facilities

The spending data in June 2017 is a testament to the prudent reforms implemented by the DBM as well as the improved budget utilization of line agencies. “Government spending for the year started a little slow as expected. Line agencies were still adjusting with the new administration, and they were easing into their programs and projects under the 2017 Budget,” said DBM Secretary Benjamin Diokno. “However, as the agencies continue to improve in their performance, government spending is picking up with actual disbursements in the first semester of FY 2017 practically mirroring the program – the variance is minimal at P5.9 billion or 0.4 percent,” he added.

Noteworthy is the surge in infrastructure spending as infrastructure and other capital outlays increased by 11.4 percent in June. “This is consistent with the Build, Build, Build program of the Duterte Administration, which will usher in the Golden Age of Infrastructure in the Philippines,” said the Budget Secretary. This puts infrastructure disbursements at P249.1 billion for the first half of the year, 5.3 percent above the targeted disbursements of P236.6 billion for the said time period.

“It is encouraging news that we are on track with our disbursement program. The DBM and the line agencies will continue to monitor and coordinate in our efforts to put an end to underspending so we can realize our disbursement target for the year,” Secretary Diokno elaborated.

For FY 2017, disbursements are projected to reach P2.909 trillion, equivalent to 18.3 percent of GDP.

Cayetano: ASEAN won’t politicize human rights

MANILA, Aug. 4 -- Foreign Affairs Secretary Alan Peter Cayetano said ASEAN places great importance on human rights and will not engage in politicizing it.

In an interface of ASEAN Foreign Ministers and ASEAN Inter-governmental Commission on Human Rights (AICHR), Cayetano said human rights and dignity of human lives would never be compromised in the region.

He noted that AICHR played a crucial role in preserving human rights in ASEAN, as the region faced more challenges in this field as it strengthened ASEAN Community.

“The coming years will bring more challenges in the field of human rights as we aim to strengthen our ASEAN Community and engage the world more extensively,” said Cayetano, who is also the chair of ASEAN Foreign Ministers.

“I am confident that AICHR will be able to help ASEAN reassure all our stakeholder and partners that indeed, ASEAN is placing a great importance to human rights -- if I may add -- without politicizing human rights,” Cayetano added.

He assured AICHR representatives ASEAN Foreign Ministers’ support to promote and protect human rights in the region.

“I would like to take this opportunity to recognize the strong commitment of AICHR in promoting and protecting human rights in the region. AICHR can count on the continued support of the ASEAN Foreign Ministers in its endeavors,” Cayetano said. (KMC/PNA)

President Duterte signs bill providing free SUC education

President Rodrigo Duterte signed the “Universal Access to Quality Tertiary Education" bill into law Thursday night (August 3), considering the long-term economic benefits of providing educational support to poor students.

"I am pleased to announce that last night, August 3, 2017, the President signed into law the enrolled bill," Deputy Executive Secretary Menardo Guevarra announced during the Mindanao Hour press briefing on Friday, August 4, at the Conrad Hotel.

Guevarra said that the bill, which came to the President's desk nearly a month ago, became the subject of a lot of discussions because of its heavy budgetary implication.

"But free tertiary education in state universities and colleges is a very strong pillar or cornerstone of the President’s social development policy," he said.

"So he weighed everything and came to the conclusion that the long-term benefits that will be derived from a well-developed tertiary education on the part of the citizenry will definitely outweigh any possible short-term budgetary challenges," Guevarra explained.

With the passage of the law, Guevarra said they expect Congress to make the necessary appropriations to fund the long-term government program on free SUC education.

The bill's passage will entail a reallocation of resources, particularly after the Office of the President submitted the National Expenditure Program for next year to Congress.

Other sources of funding for the free SUC education would be the official development assistance (ODA) and donations, both local and international entities, according to Guevarra.

The P100-billion estimate of the Department of Budget and Management (DBM) appeared to be on the very high side because it is based on the assumption that all aspects of the free tuition bill will be implemented all at the same time.

He explained that the mandatory provisions of the bill only pertain to the free tuition and other fees pertaining to library, ID, and laboratory fees.

Educational expenses that will be under a certain subsidy is still to be established and administered by the UniFAST Board or the Unified Student Financial Assistance Program.

The bottom 20 percent or those who are really in need will be prioritized in terms of grant of subsidy for education-related expenses, Guevarra said.

Also during the same press briefing, Armed Forces Spokesman Brig. Gen. Restituto Padilla Jr. said the military is closing in on two barangays that are still occupied by the Maute group and its cohorts.

As the military operates in approximately less than one square kilometer, the fighting becomes more intense, complex and challenging, Padilla said.

But the priority is still to rescue the hostages being held by the terrorists as well as secure the remaining residents who did not abandon their homes.

While the AFP wants Marawi City residents to go home, they are still barred from returning because of the dangers posed by unexploded ordinance.

"Kaya kailangan po maintindihan ng ating mga kababayan na sa pagnanais nating maibigay at maibalik and siyudad ng Marawi sa kanila, hindi ganon kadali ito dahil po sa mga hinaharap na ‘yan," Padilla said.

As the military addresses the conflict in Marawi, it is also facing other fronts such as the communist insurgency. Padilla reported that the Armed forces confiscated bombs from two individuals in Bukidnon after a clash with leftist rebels.

The two NPA members are already in police custody and the military is verifying whether they are connected to a particular partylist organization following the recovery of IDs from them.

Despite multiple challenges, Padilla assured the public that the military is working to make communities secure.

"And we can assure you and guarantee you that despite the challenges that we face on many fronts, your Armed Forces and your Police are very much proactively engaged to address all the security challenges that we face with the appropriate measures and programs so that we can better protect our cities, our citizens and all the industries that provide the economic lifeblood of the island," he said.

As of Thursday night, the military was able to neutralize 522 enemies and recover 600 firearms. Civilians rescued stood at 1,724.

Cash donations also continue to pour in. As of 2:45 p.m. Thursday, the amount intended for casualties of the Armed Forces of the Philippines stood at P100,070,804.23.

Of this amount, P1,500,000 have been withdrawn to take care of those soldiers wounded in action. The balance of P98, 570, 804. 23 remains in the bank. For the internally displaced person (IDPs), the total donation is at P873,515.21.###PND

ISIL's 'genocide' against Yazidis is ongoing, UN rights panel says, calling for international action


3 August 2017 – Marking three years since the Islamic State of Iraq and the Levant (ISIL/Da'esh) attacked the Yazidis in Syria, a United Nations-mandated inquiry has called for justice and rescue plans.

“The Commission of Inquiry calls on the international community to recognize the crime of genocide being committed by ISIL against the Yazidis and to undertake steps to refer the situation to justice,” said the expert panel in a statement marking the third anniversary of ISIL's attack on the Yazidis.

According to the Commission, in the early hours of 3 August 2014, ISIL fighters launched an attack on the Yazidis of Sinjar – a distinct religious community whose practice spans thousands of years. Over the following days, the terrorist group executed hundreds of men and took captive thousands of women and children, publicly reviling them as 'infidels.'

In its June 2016 report, entitled They Came to Destroy: ISIS Crimes Against the Yazidis the Commission found that many of the women and girls were taken to Syria where they were sold as chattel and sexually enslaved by ISIL fighters. Boys were indoctrinated, trained and used in hostilities.

“ISIL committed the crime of genocide by seeking to destroy the Yazidis through killings, sexual slavery, enslavement, torture, forcible displacement, the transfer of children and measures intended to prohibit the birth of Yazidi children,” the report concluded.

The genocide is on-going and remains largely unaddressed, despite the obligation of States Party to the Convention on the Prevention and Punishment of the Crime of Genocide of 1948 to prevent and to punish the crime, the Commission said.

The international community must also recognize ISIL is committing the crime of genocide against the Yazidis

“Thousands of Yazidi men and boys remain missing and the terrorist group continues to subject some 3,000 women and girls in Syria to horrific violence including brutal daily rapes and beatings,” the expert body noted.

Pointing out that some women and girls are being held in Raqqa city, the Commission revealed that as the Syrian Democratic Forces and international coalition offensive on Raqqa intensifies, reports have emerged of ISIL fighters trying to sell enslaved Yazidi women and girls before attempting to flee Syria.”

The Commission recommended that all parties fighting ISIL consider plans to rescue Yazidi captives and use all possible to ensure their freedom during on-going military operations.

“The international community must also recognize ISIL is committing the crime of genocide against the Yazidis,” the statement concluded, urging action to refer the situation to justice, “including to the International Criminal Court or an ad hoc tribunal with relevant geographic and temporal jurisdiction as well as to dedicate resources to bringing cases before national courts, whether under the framework of universal jurisdiction or otherwise.”

The Independent International Commission – comprised of the Chair, Paulo Sérgio Pinheiro, Karen Koning AbuZayd and Carla Del Ponte – has been mandated by the UN Human Rights Council to investigate and record all violations of international law since March 2011 in Syria.
