Abstracts:

» Based on 285 rape cases from Dutch provincial courts of law from the period 1811-1920, this article studies how knowledge of body and mind was constructed by doctors and psychiatrists in a legal setting. Doctors examining the bodies of female victims of sexual assault often came to inconclusive findings or disagreed amongst themselves. Around 1900, the influence of forensic psychiatry meant doctors started focussing on the minds and bodies of perpetrators and victims, especially on the hysterical symptoms of the potentially lying female victim. However, judges always retained the final judgement on medical findings and often overruled doctors’ expertise.« (Source: Tijdschrift voor Sociale en Economische Geschiedenis)
»The article discusses research regarding the role of forensic medicine and psychiatry in rape case investigations in the Netherlands from 1811 to 1920. The research is based on 285 rape cases from provincial courts of law, which according to the author, demonstrate inconclusive findings and disagreement amongst doctors and psychiatrists. Beginning around 1900, forensic psychiatry gained credibility although judges retained the right of final judgment on medical conclusions and many times overruled doctor's findings.« (Source: Historical Abstracts)
