Abstract: »The purpose of this essay is to analyze how the different legislative amendments have changed regarding to the crime of rape since the penal code was introduced in 1962. It is a study of the legal history and the changes that has been made, what the bases for these changes were in order to observe why the current debate of whether we should introduce a requirement of consent has aroused. Rape has, since the penal code was introduced, been in the first paragraph of the sixth chapter and this section of the law has been changed five times in total. This essay will illustrate how the protection aspect has been changed from protecting the female honor to defending the sexual integrity and the right to self-determination. It will also illustrate how the focus has transferred from the actions of the victim at the time of the assault to the perpetrator by emphasizing that it is the violation that should be judged and not the sexual act as such.« (Source: Thesis)
