Abstract: »The objective of the present work is to analyze the way in which the identity of the victims of statutory rape cases is built, using the intersection of childhood studies and gender theory. The novel “Lolita”, written by Vladimir Nabokov, is used as a metaphor and starting point to reflect about how hegemonic constructions of childhood, gender and sexuality in are present in the cultural imaginary, and how it impacts criminal procedures. In order to achieve that, all the habeas corpus Court rulings of the Brazilian Supreme Court that deal with statutory rape in the last 20 years will be analyzed. Considering that the Brazilian State is constitutionally bound to protect children, there is a really progressive child protection law in place, trying to balance the notions of protection and autonomy within the framework of the best interest of the child. In order to better articulate this balance between autonomy and protection when it comes to sexual consent in the criminal justice system, a brief study of the concept of autonomy, and its limitations within identities marked by power imbalances, is made.« (Source: Thesis)
