Hannibal Free Public Library is a political subdivision in Missouri. The Hannibal Free Public Library Board of Trustees has the exclusive control of the expenditure of all moneys collected to the credit of the library fund, and of the construction of any library building, and of the supervision, care and custody of the grounds, rooms or buildings constructed, leased, or set apart for that purpose. The board, as a body corporate, may sue and be sued, complain and defend, and make and use a common seal, purchase or lease grounds, purchase, lease, occupy or erect an appropriate building or buildings for the use of the public library and branches thereof, sell and convey real estate and personal property for and on behalf of the public library and branches thereof, issue bonds, secured by a deed of trust on any land which they own, for the purpose of the purchase of ground and for the erection of public buildings and for the improvements of existing buildings, receive gifts of real and personal property for the use and benefit of the public library and branch libraries thereof, the same when accepted to be held and controlled by the board of trustees, according to the terms of the deed, gift, devise or bequest of such property. ACCEPTANCE OR REJECTION OF ANY OR ALL BIDS OR QUOTES

The Hannibal Free Public Library Board of Trustees reserves the right to accept or reject any or all bids/quotes or combinations thereof, and to waive any minor irregularities, including without limitation, nonconforming, non-responsive, unbalanced or conditional Bids. The Library Board further reserves the right to reject the bid/quote of any bidder whom it finds, after reasonable inquiry and evaluation, to be non-responsible. The Library Board may also reject the bid/quote of any bidder if the Library Board believes that it would not be in the best interest of the Project to make an award to that Bidder. The Library Board also reserves the right to waive all informalities not involving price, time, or changes in the Work.

PROCUREMENT & DISPOSITION POLICY

The Procurement & Disposition Policy ensures that the Library’s procurement practices are performed in a consistent, objective, accountable, transparent, and fair process. Additionally, this policy ensures that the process will be effective and efficient.

OSHA TRAINING REQUIREMENT

Any and all contractors and subcontractors who contract to work on public works projects shall provide a 10 hour Occupational Safety and Health instruction and safety program, or similar program approved by the Department of Labor, for their employees. All employees working on projects must have completed the course within 60 days of beginning work and shall keep evidence of completion on their worksite. Contractors and subcontractors in violation will forfeit $2500 plus $100 for each worker employed for each day the worker is employees without training to the Hannibal Free Public Library, City of Hannibal, awarding the contract. Public bodies and contractors may withhold assessed penalties from contractors and subcontractors respectively.

SALES AND USE TAXES

Hannibal Free Public Library is exempt from Missouri State Sales and Use taxes on materials and equipment to be incorporated in the Work (exemption # 12537888). Said taxes shall not be included in the Bid. Upon request, the Library will supply Form 5060 to the contractor awarded the project.

MISSOURI'S PREVAILING WAGE LAW COMPLIANCE

Hannibal Free Public Library complies with Missouri's Prevailing Wage Law. Any and all Contractors or Subcontractors hired by the Library are also required to comply. For more information, click HERE.

If Prevailing Wage is required, Contractors must submit a notarized copy of their Compliance with Prevailing Wage Law Affidavit with their application for final payment.

INSURANCE REQUIREMENTS

Hannibal Free Public Library requires contractors and vendors to comply with the City's Insurance Requirements, modified to include the Library, which may be found HERE. Proof that Insurance requirements have been met must be provided with other Contract Documents before the Notice to Proceed (NTP) will be issued to the contractor selected to perform the work. Hannibal Free Public Library and the City of Hannibal must be named as additional insured.

APPLICATION FOR PAYMENT

Following completion of the work by the Contractor and acceptance of the work by the Library , application for payment will be accepted. It must be submitted to Hannibal Free Public Library no later than the 5th of the month. Checks will be released by the 22nd of the month for invoices submitted on or before the 5th of the month. Checks will be released by the 22nd of the following month for invoices submitted after the 5th of the prior month. Larger projects may include provisions for partial payment(s) at work milestones, provided these are stipulated in the contract.
