RESIDENTIAL LIMITED LIFETIME WARRANTY


Halquist Stone Granite Countertops are covered by a limited lifetime warranty for residential applications backed by Halquist Stone’s commitment to quality and customer satisfaction.

 

THIS LIMITED LIFETIME WARRANTY (THE “LIMITED WARRANTY”) GIVES A REGISTERED OWNER SPECIFIC LEGAL RIGHTS (IN ADDITION TO OTHER RIGHTS YOU MAY HAVE WHICH VARY FROM STATE TO STATE).  THIS LIMITED WARRANTY IS OFFERED AND ADMINISTERED BY HALQUIST STONE COMPANY, INC., A WISCONSIN CORPORATION (“HALQUIST STONE”).  THIS LIMITED WARRANTY DOCUMENT LISTS CONTACT INFORMATION FOR WARRANTY SERVICE. A COPY OF THE LIMITED WARRANTY IS AVAILABLE AT WWW.HALQUISTCOUNTERTOPS.COM AND/OR IN THE DOCUMENTATION PROVIDED WITH THE PRODUCT UPON INSTALLATION.  THE LIMITED WARRANTY EXCLUDES MARBLE PRODUCTS AND/OR CERTAIN TYPES OF STONE.  CONTACT HALQUIST STONE FOR A COMPLETE LIST OF MATERIALS NOT COVERED UNDER THIS LIMITED WARRANTY.

HALQUIST STONE LIMITS THE DURATION AND REMEDIES OF ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS LIMITED WARRANTY.

HALQUIST STONE’S RESPONSIBILITY FOR DEFECTIVE PRODUCTS, AS DEFINED HEREIN,  IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

 

REGISTERED OWNERS COVERED


  • This Limited Warranty applies to Halquist Stone’s granite countertops (the “Product”) permanently installed in the original purchaser’s residence (the “Registered Owner”) for countertop use during the Warranty Period.
  • This Limited Warranty is non-transferable, except in the case of non-occupying builder owner not taking occupancy who transfers the real property to original resident occupants.
  • A “residence” of a Registered Owner excludes: (i) non-residential real estate including real estate used for commercial, office or institutional purposes; and (ii) any real estate that is rented.

 

WARRANTY PERIOD

This Limited Warranty begins on the date of installation of the Product and remains in effect for the duration of ownership of the home by the Registered Owner so long as the Registered Owner still owns the home where the Product was installed. The Warranty Period shall remain in effect if Halquist Stone repairs or replaces the Product, so long as the Registered Owner still owns the home where the Product was installed.  Halquist Stone may change the availability of this Limited Warranty at its sole discretion for future repair or replacement of the Product.

 

  WHAT IS COVERED UNDER THE LIMITED WARRANTY


  • Halquist Stone’s Product permanently installed by Halquist Stone for residential countertop use.
  • Manufacturer’s (Halquist Stone) defects in fabrication of the Registered Owner’s Halquist Stone Product as determined by the Marble Institute of America, Dimension Stone Design Manual VII.
  • Defects caused by improper installation of the Product by Halquist Stone as determined by the Marble Institute of America, Residential Stone Countertop.
  • Installation (Technical Module).
  • Stains from food and beverages. (See care and use instructions provided below).
  • The Limited Warranty covers only the repair or replacement of the actual section of the material that is determined to be defective by the manufacturer’s investigation. No other cost, expenses, materials, labor, damages or reimbursements associated with the damaged products are covered under this Limited Warranty.

 

WHAT THE LIMITED WARRANTY DOES NOT COVER

 

  • Damage due to (a) improper use; (b) failure to follow the Product instructions or to perform any required preventative maintenance; (c) modifications of the Product by anyone other than Halquist Stone unauthorized repair; (e) normal wear and tear; or (f) external causes such as accidents, neglect, abuse, negligence, mishandling or alteration of the product, acts of God, vandalism, or other actions or events beyond Halquist Stone’s reasonable control.
  • Products moved from their original permanent placement.
  • Natural characteristics of the Product, such as, but not limited to: surface pitting, inclusions, fissures, variations in color, gloss level and texture, depth and clarity.
  • Damage due to physical abuse, such as, but not limited to: excess weight, standing, sitting, walking on, impacts whether accidental or intentional, excess heat, fire or flame.
  • Staining due to chemicals, such as, but not limited to: paint stain, putty oils or residue, oils, acids, metal cleaners, oven cleaners, solvents, and alkalis.
  • Damage or injury caused in part or in whole by acts of God, job site conditions, structural movement or settling, architectural or engineering design, accidents or vandalism.
  • Seam placement or location, size, color or appearance of seams, color match from piece to piece, seam separation or opening due to movement, impacts, excess weight or settling.
  • Commercial or institutional uses or abnormal conditions, such as, but not limited to; use in stores, restaurants, dormitories, offices, exteriors, trains, recreational vehicles, boats or aircraft.

 

REGISTERED OWNER’S REMEDIES UNDER THE LIMITED WARRANTY


  • Upon receipt of a written Warranty Claim, Halquist Stone will inspect the Product.  If damage or defects are deemed to be caused by abuse or other uncovered items outlined herein, the Registered Owner may be billed for a standard service call.
  • Stains from food and beverages will be treated by applying a poultice (or other method deemed necessary) supplied by Halquist Stone. This may take more than one application. New sealer will be supplied after applying the stain removal treatment.
  • Halquist Stone will repair or replace, at its option, the Product found to be defective.  If the Product is replaced, the Registered Owner shall be responsible for detachment and reattachment of plumbing, electrical, backsplash or any other ornamentation attached to the Product. 

 

 

Halquist Stone makes no warranty, express or implied as to the fitness or merchantability of the Product for any particular use or purpose other than as set forth expressly herein.  Halquist Stone shall not be liable for any special, indirect, incidental or consequential damages, losses or expense arising either directly or indirectly from the failure of the Product.

 

Halquist Stone will not be held liable for damages deemed to reside outside of the Limited Warranty coverage.  Halquist Stone shall not be responsible or liable for any delays that may arise in performing Halquist Stone’s obligations under this Limited Warranty due to any cause beyond the Product distributors’ control, including without limitation, acts of God, acts of governments, material shortages or delays, fires, floods or labor problems.

   

LIMITED WARRANTY AND REGISTRATION


To receive coverage under this Limited Warranty, the Registered Owner must:

  • Show proof of full payment.
  • Complete the online Warranty Registration form at www.halquistcountertops.com. This link can also be found on the home page of our website www.halquistcountertops.com.
  • Use only Halquist Stone approved products and procedures.
  • Have your countertop sealed by Halquist Stone every 15 years. (For food and beverage stain protection).

CARE AND USE PROCEDURES 

 

The Registered Owner must carefully follow these care and use procedures in order for the Limited Warranty to remain in effect:

 

Care:
• Always wipe the surface of the Product with a nonabrasive cloth. Halquist Stone recommends the use pH neutral stone cleaner.
• Clean up spills immediately.
• Do not use household cleaning products with acid or ammonia on the Product surface, such as bathroom cleaners, grout cleaners or tub and tile cleaners.
• Do not use vinegar or lemon juice as cleaners.
• Do not use abrasive cleaners.
• Promptly clean any spilled chemical substances such as bleach or drain cleaner from the Product.
• Do not use polishes or waxes on the Product.

Use: 
• Protect the Product surfaces with coasters, trivets or place mats.
• Do not abuse the Product. Abuse includes but is not limited to, use that is unreasonable considering the normal and expected use of a kitchen countertop. Do not drop or place any object of excessive weight on the surface of the Product.
• Do not sit or stand on the Product.
• Protect the Product surfaces by using a cutting board when cutting requires force.

To obtain warranty service under this Limited Warranty, the Registered Owner must contact Halquist Stone during the Warranty Period using the telephone number: 1-262-246-9000 ext. 188 or in writing at: Halquist Stone Warranty Service, N51 W23563 Lisbon Rd. Sussex, WI 53089 Attention: Countertop Department and inform Halquist Stone's warranty service representative of the nature of the problem.  THIS LIMITED WARRANTY IS NON-TRANSFERABLE AND DOES NOT EXTEND TO ANY SUBSEQUENT OWNER OR OTHER TRANSFEREE OF THE PRODUCT. INCLUDING SUBSEQUENT USERS WHO RENT.

 

LIMITATION OF LIABILITY:

THE REMEDIES DESCRIBED HEREIN ARE REGISTERED OWNER’S SOLE AND EXCLUSIVE REMEDIES AND HALQUIST STONE’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY, HALQUIST STONE’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY REGISTERED OWNER FOR THE DEFECTIVE PRODUCT, NOR SHALL HALQUIST STONE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, WHETHER DIRECTOR OR INDIRECT.
